Michael Anthony's cousin told me first hand sometime around 1995 how David Lee Roth tried to sue for the rights to the band name Van Halen after they parted ways in 1985.

Michael Anthony's cousin told me first hand sometime around 1995 how David Lee Roth tried to sue for the rights to the band name Van Halen after they parted ways in 1985.

I think that David should have lost that suit. But I also think that the VH brothers were wrong for not continuing to do CVH songs (more than the 3 they --Hagar-- chose) in concert. It was a coincidence that the band's name was Van Halen. DLR put his own stamp on the band, and the band allowed that, and then when Roth quit, bartered on the VH name, which every fan associated with David Lee Roth. Van Hagar would have been a better representation for what followed, as Sammy Hagar did not come into the band to "replace" the role of DLR, but to go in a different direction.

If Arnel Pineda, after joining Journey, had said, I'll only sing 3 Steve Perry Journey songs of my choosing in concert, then it would have been dishonest to keep the name of the band Journey.

If William Duvall after joining AIC, had said, I'll only sing 3 Layne Staley AIC songs of my choosing in concert, then it would have been dishonest to keep the name of the band as AIC.

It had to do with money, Sam talks about it in interviews, his book, his unpublished book that was leaked.

His check from live shows was larger the fewer original lineup songs were in the setlist, and was larger with more of his solo tunes in the setlist.

That's why there was the 1-1 deal (would assume Leffler came up with that), one solo Sam song for every CVH song.

I also believe has said recently, before Ed died even, that he regrets doing that, it was penny wise and pound foolish.

At the time, with the animosity in VH towards DLR, I am sure they were all ok with DLR getting less money any way they could.

Van Halen with Sammy was a very good live band, but the setlists definitely could have and should have been much better.

The best mix of CVH tunes with Hagar hits was on the Van Halen 3 tour in ‘98.

One big glaring difference with VH though, 2 of the members of the band have that last name. Dave would have his ass handed to him. Seeing how 2 of the 3 voting band members are Van Halen’s. And mike would’ve sided with them had this came about.

Actually no it really was a money thing. Certainly in the beginning which Sam has talked about.

But I’m sure Sam didn’t like Dave’s lyrics. They write nothing alike as we have discussed about a million times here so I wouldn’t be surprised if Sammy couldn’t get into Dave lyrics. They are completely different songwriters in every way possible.
