The Andrew Bennett Book
I’m just curious how he got a well-to-do publisher like Simon & Schuster behind a book that is clearly fucking illegal.
I’m assuming they do have a legal department that checks for things like copyright infringement and so forth? So fucking weird.Webmaster

Yeah, this is a mystery. Do we know if AB is still living in the states? If Simon and Schuster are just the distributors they almost certainly have contractual protection with whoever is the actual publisher. They may not know about the litigation and we know nobody on ED’s side has done anything such as sending a cease and desist letter.
Wolf’s reply leaves any doubt he does not have an agreement to do what he’s doing. And there would be a dismissal of the injunction if there was a subsequent or new agreement.Destructo

When Bennett attempted to sell that 5150 video and audio package in limited quantities for $500 each a few years ago it looked fishy as hell to me. Then I read about the issues and lawsuits here and my thoughts that this guy is under-handed with this release were confirmed. This book of his then starts being sold by him about a year ago, and it too seemed sketchy. I listened to a podcast with Bennett about the book, and he seemed smug and dishonest to me in it. This lawsuit document confirms this guy has no business profiting off his past work with EVH. I
Does Bennett do any current work in the music industry? I can't believe anybody would want to hire him after his transgressions with EVH.

well the guy seems to have lots of high praise and respect for Eddie so I don't understand why he is screwing him over with this book. This interview was from right after Ed passed. It just seems so messed up to me...

I’m sure you would know this better than me:
I was just glancing over the 2015 settlement agreement and under releases, both parties agreed to waive, release and acquit existing claims including breach of contract. Would that include the prior confidentiality agreement from 7-8 yrs prior?
Also, the only mention in that settlement was regarding “EVH Content” which was the video footage. Is there anything on the Affidavit and Assignment section that implies other content such as photographs? The confidentiality agreement seems to be worded that way but the settlement seems to nullify that?
Legal documents get very confusing...

He’s not screwing anybody over with this release, really. By all accounts it might be illegal, yes. But the sales from this book will be in thousands of dollars, if that.
He was also very complimentary towards Ed in the book. But there was definitely some bitterness over how he was let go.

The question is also: where was management in all this?
I guarantee you that if you want to do a documentary of Metallica rehearsing, you can't just walk up to James or Kirk and deal the whole thing with them. You have to deal with their publicist, then the guys at Q Prime (management), the assistants, etc. Contracts are drawn - there's a whole structure that will take care of things like that.
Where was that structure in VH's case? How could a band that big decide things in such an amateurish way? Where was Irving Azoff or their publicist?Little Dreamer

Good point. Metallica is a much, much bigger musical and business entity than VH is/was in 2004 but still a very interesting point.
But this wasn't like Andrew approached Ed looking for a gig. Ed/Matt approached him. Hell, Ed let Craig Gass live at 5150 for a few months in early 04 right as the reunion rehearsals were starting, after meeting him like two times.
I think if this was post 2008 and Ed was sober and of right mind he would have told Azoff to contact the guy he wanted, to negotiate terms. Knowing Azoff the guy probably wouldn't have got much anyways (much like the band Mr. North who opened for them in 04; management restricted the amount of merchandise they were allowed to sell, what they were allowed to sell and also took 20% of their merch profits which amounted to about $900 a night while VH was making $200k....and they weren't getting paid for the shows), but he would have at least had a contract.

One of my sons has met the one Dixie Chic from York PA thru his job many times. She may be famous down south but 9 out of 10 in Hanover PA don't even know her.
