    Broward recount shenanigans: 46,000 Democrat votes “found” after election day, with more to come

    UPDATE: This story has been updated to reflect the fact that at approximately 2pm Eastern, the Broward County Supervisor of Elections posted another 11,300 votes (which broke 70-30 in favor of Democrats). This new tranche of ballots have just triggered a mandatory machine recount in the governor’s race and a hand recount in the U.S. Senate race.

    Republicans Rick Scott and Ron DeSantis may be in trouble. Despite clear margins of victory for both men on election night, Democrat election supervisors in Broward and Palm Beach counties say they aren’t done tallying up votes. Two days after the polls closed on Tuesday night, Democrat candidates Bill Nelson and Andrew Gillum benefited from nearly 46,000 Democrat votes that have been “found” in those counties and added to the statewide election outcome, throwing Florida into a partisan uproar over mandatory hand and machine recounts and the possibility that the integrity of the election process has been compromised.

    Nelson already has his lawyer promising that Nelson is going to prevail, and a close advisor to Gillum posted on social media that he is aware of at least 20,000 “more” ballots that he alleges have yet to be counted:

    But it is unclear how the Gillum camp could possibly know the number of outstanding ballots – if any – especially since Broward County Supervisor of Elections Brenda Snipes claims she has no idea how many ballots remain to be counted:

    “Not sure. I’m really not sure. But we are working on those,” Snipes told CBS4 News in Miami.

    Republicans have expressed frustration with Snipes, who has a long history of election “snafus.” Just days before the 2016 presidential election, Republican poll watchers discovered that Snipes and her team were illegally opening vote by mail ballots – which traditionally come from Republican voters – behind closed doors and away from the supervision of the canvassing board, whose job it is to oversee and certify the election outcome.

    “This looks like intentional incompetence,” said one Republican strategist who declined to be identified. “We see it every election cycle down there. Democrat election supervisors can’t really be this incompetent, so it raises the question of whether or not they are intentionally failing to protect the integrity of the vote counting process. There’s only one reason to do that, and that’s to rig the outcome for Nelson and Gillum.”

    On election night, Florida governor Rick Scott led incumbent Senator Bill Nelson by nearly 60,000 votes. The next day, Scott watched his lead inexplicably shrink. Overnight, enough new Democrat votes had been “discovered” to close the gap by 22,000 ballots. Later that day, Scott watched as Democrats in Broward added another batch of Democrat ballots favoring Nelson. This time around, it was enough to shrink Scott’s lead by another 10,000 votes.

    The oddities in Broward continued again on Thursday. When Scott went to bed last night, he held a close but still decisive 30,000 vote lead. When he woke this morning, like clockwork, Broward County again had added a large tranche of Democrat votes. At about 2pm, Broward had discovered another 11,300 votes and when they were counted, they broke roughly 70-30 percent for Democrats. As of right now, Scott leads Bill Nelson by just 22,000 17,344 votes, triggering a mandatory hand recount.

    Those new votes also reduced Governor-elect Ron DeSantis’s margin of victory to just 38,515 votes, or 0.47 percentage points based on the total turnout of 8.2 million votes cast. Anything less than 0.5% triggers an automatic machine recount.

    Representatives from both the Scott and DeSantis campaigns say they have attorneys and representatives on site in Broward and Palm Beach, attempting to monitor the situation, but some Republicans are concerned about partisan poll workers gaming the system during a machine recount, where poll workers manually feed ballots into a machine, rather than the actual voters themselves, as happens on election day. Worse, in the case of hand recount, Snipes and her staff may be free to determine the voter’s “intent” rather than simply allowing machines to read the ballots.

    “Once we get to that level,” said the Republican strategist, “it’s going to get crazy. With Brenda Snipes running the recount in Broward County, Florida voters should be very, very concerned about the integrity of this process.”

    Rubio warns of Dem lawyers 'descending on Florida' to 'try and steal' key statewide races




    Florida Republican Sen. Marco Rubio on Thursday charged that two Democrat-controlled counties in the state, in possible violation of election law, have been reporting a "slow drip" of tens of thousands of additional ballots favorable to several Democratic candidates for statewide office, including incumbent Sen. Bill Nelson.

    Liberal lawyers, Rubio said in an extraordinary series of tweets that alleged incompetence if not outright complicity by Florida officials, are "descending on" the state in a calculated attempt to "change the results" and "try and steal" races for Senate and agriculture commissioner.

    Rubio's explosive posts come as a recount now appears imminent in Florida's high-profile gubernatorial contest between Democrat Andrew Gillum and Republican Ron DeSantis, based on new vote totals -- even though Gillum has already conceded.

    "Florida law requires counties report early voting & vote-by-mail within 30 minutes after polls close," Rubio wrote on Twitter. "43 hours after polls closed 2 Democrat strongholds #BrowardCounty & #PalmBeachCounty are still counting & refusing to disclose how many ballots they have left to count."

    Florida statutes mandate that the "canvassing board shall report all early voting and all tabulated vote-by-mail results to the Department of State within 30 minutes after the polls close" and that "thereafter, the canvassing board shall report, with the exception of provisional ballot results, updated precinct election results to the department at least every 45 minutes until all results are completely reported."


    The state code continues, "The supervisor of elections shall notify the department immediately of any circumstances that do not permit periodic updates as required."


    Vote totals in several major races in the state are changing rapidly, on an irregular schedule and sometimes late into the evening. GOP Senate candidate Rick Scott, also Florida's governor, was ahead of Nelson by roughly one-fourth of one percentage point as of Thursday morning, according to The Tampa Bay Times. The paper also said the agriculture commissioner candidates were separated by only 0.06 points. That race flipped in favor of the Democratic candidate on Thursday afternoon.

    Broward County reported that significantly more votes were received in the agriculture commissioner contest than the much higher-profile Senate election. An attorney for Nelson's campaign suggested a computer error might explain that anomaly.

    In the closely watched gubernatorial race, DeSantis' held a narrow 0.52-percentage-point edge over Gillum as of Thursday morning, extremely close to the 0.5 percent threshold needed to trigger a machine recount. Gillum has conceded the race, although his decision is nonbinding.

    But by Thursday afternoon, unofficial figures had DeSantis up by just 38,515 votes out of the more than 8 million cast -- a lead of just 0.47 percent, low enough to trigger a mandatory recount, according to The Tallahassee Democrat. No recount has yet been announced by Florida's secretary of state, and the first unofficial count is expected to be verified Saturday by Florida's secretary of state.

    "On Tuesday night, the Gillum for Governor campaign operated with the best information available about the number of outstanding ballots left to count," Gillum's campaign said in a statement Thursday evening. "Since that time, it has become clear there are many more uncounted ballots than was originally reported. Our campaign, along with our attorney Barry Richard, is monitoring the situation closely and is ready for any outcome, including a state-mandated recount."

    Without providing legally sufficient justification, Rubio said, Democrat-controlled Broward and Palm Beach counties on Wednesday afternoon continued to report new ballots, cutting into Scott's already-thin lead and flipping the state's agriculture commissioner race to Democrats. Provisional ballots cast by voters without proper identification or at the wrong location are factoring into the late results, and Florida officials have rejected campaigns' requests for the identity of those voters, citing federal and state law.


    Palm Beach County Supervisor of Elections Susan Bucher told Fox News that Palm Beach is still counting about 2,000 mail-in ballots where voters circled or highlighted (by drawing an arrow pointing at the candidate’s name) their choice, instead of filling in the appropriate bubbles.

    Under Florida law, the state elections department is allowed to determine voter intent. Bucher told Fox News that elections department staff is going through each of the 2,000 mail-in ballots, and where voter intent is determined, a worker is filling in a new ballot on behalf of the voter. Where voter intent cannot be determined, the ballot is sent to the canvassing board to undergo review.

    Elections officials are also reviewing 1,500 military and overseas ballots which are still being counted. Florida law allows military servicemembers to mail or fax ballots in. A provisional vote report is due in Tallahassee on Saturday by noon.


    "#Broward election supervisors ongoing violation of #Florida law requiring timely reporting isn’t just annoying incompetence," Rubio wrote. "It has opened the door for lawyers to come here & try to steal a seat in the U.S. Senate & Florida Cabinet."

    Broward county election officials did not immediately return Fox News' request for comment.

    Rubio added: "Now democrat lawyers are descending on #Florida. They have been very clear they aren’t here to make sure every vote is counted. - They are here to change the results of election; & - #Broward is where they plan to do it."

    Under Florida law, if the margin in any race hits 0.25 percent or lower, a manual recount of any ballots set aside from the machine recount will be ordered -- reminiscent of the scene in the 2000 presidential election, when the country was gripped by images of poll workers counting votes deciphering hanging chads by hand.

    The Supreme Court voted by a 7-2 majority that Florida's recount in that race violated the Equal Protection Clause of the Constitution because each country and precinct adopted varying standards for how it would conduct the recount. By a 5-4 vote, the Supreme Court ended the recount on other grounds.



    Rubio made clear he has no confidence in the integrity of South Florida's election officials, suggesting a posssible GOP-led court challenge might be looming.

    "A U.S. Senate seat & a statewide cabinet officer are now potentially in the hands of an elections supervisor with a history of incompetence & of blatant violations of state & federal laws," he wrote, linking to a Miami Herald article describing several scandals that have gripped Broward County’s Elections Department.


    Earlier this year, a judge found that Broward Elections Supervisor Brenda Snipes had illegally destroyed ballots in a 2016 congressional contest, leading the governor's office to assign election monitors to supervise her.

    “I think the problems are blown out of proportion,” Snipes said in October, in an interview with The Miami Herald. “Broward is nitpicked to the bone. Other places have the same problems, different problems. It’s just that they are not spotlighted like we are.”

    Marc Elias, Lawyer Tied to Clinton Campaign & ‘Pee Dossier,’ Leads Dems’ Florida Recount Efforts



    Marc Elias, the attorney who infamously retained Fusion GPS to produce the largely discredited anti-Trump dossier on behalf of Hillary Clinton’s 2016 presidential campaign, has been retained to represent Sen. Bill Nelson’s recount efforts in Florida.

    The Florida Senate race is likely headed to a recount after late reporting from Broward County lowered Gov. Rick Scott’s lead to about 17,000 votes, meaning the election is within the .25% margin necessary to require a hand recount. The race has already reached the 0.5 percent threshold to require a machine recount.


    In a conference call with reporters, Elias claimed that optical-scan machines may not have registered ballots that were poorly marked, and he contended that Nelson would emerge victorious from a recount, which has not yet been officially authorized.


    We believe that at the end of this process, Sen. Nelson is going to be declared the winner,” Elias said.

    Elias added: “We’re doing this not just because it’s automatic, but we’re doing it to win. A significant number of ballots have not yet been counted and, because of the size of Florida, we believe the results of the election are unknown and require a recount.”

    Elias is widely considered one of the most powerful attorneys associated with the Democratic Party. He is chair of the Political Law Group at the Perkins Coie law firm. Elias represented Hillary Clinton’s 2016 presidential campaign as well as the Democratic National Committee. He was brought in by Nelson’s campaign to oversee official recount efforts.



    Last year, the Washington Post reported that in April 2016, Elias and his law firm Perkins Coie retained Fusion GPS to conduct the firm’s anti-Trump work on behalf of both Clinton’s 2016 presidential campaign and the DNC. The work resulted in the publication of the dossier authored by former British spy Christopher Steele.

    Through Perkins Coie, Clinton’s campaign and the DNC continued to fund Fusion GPS until October 2016, days before Election Day, the Post reported.

    While it is not clear how much the Clinton campaign or the DNC paid Fusion GPS, the UK Independent, citing campaign finance records, reported that the Clinton campaign doled out $5.6 million to Perkins Coie from June 2015 to December 2016.

    Records show that since November 2015, the DNC paid the law firm $3.6 million in “legal and compliance consulting.”



    Steele reportedly met with the FBI on July 5, 2016 to report his purported findings about Trump and Russia. The Steele dossier was reportedly utilized by the FBI in part to conduct its probe into Trump over the unsubstantiated Russia collusion claims.

    According to House Intelligence Committee documents, the questionable dossier was also used by Obama administration officials to obtain a FISA warrant to conduct surveillance on Carter Page, who briefly served as a volunteer foreign policy adviser to Trump’s campaign. The political origins of the dossier and issues relating to Steele’s credibility as a source were kept from the FISA court, a House Republican memo documents.

    Besides its role in sending funds to Fusion GPS, Perkins Coie also reportedly helped draft the outside firm CrowdStrike to aid with the DNC’s allegedly hacked servers.



    CrowdStrike is the third-party company ultimately relied upon by the FBI to make its assessment about alleged Russian hacking into the DNC. The DNC reportedly did not allow the FBI to gain access to servers that were suspected of being hacked, instead coming to an arrangement with the federal agency in which CrowdStrike carried out forensics on the servers and shared details with the FBI.

    In Florida, meanwhile, Republican Ron DeSantis, the former Congressman who won the gubernatorial election, is now within the .5% threshold required for a machine recount.

    Opponent Andrew Gillum has not officially asked for a recount and that effort is considered a longshot, but Gillum’s campaign on Thursday hinted at challenging the ballot counting.

    “On Tuesday night, the Gillum for Governor campaign operated with the best information available about the number of outstanding ballots left to count. Since that time, it has become clear there are many more uncounted ballots than was originally reported,” stated Gillum’s communications director, Johanna Cervone. “Mayor Gillum started his campaign for the people, and we are committed to ensuring every single vote in Florida is counted.”

    Recount: Scott attorneys demand answers from Broward County, FDLE launches investigation

    Attorneys for Florida Governor Rick Scott have filed a lawsuit demanding public records from Broward County that will help them answer three crucial questions about the outcome of the U.S. Senate race between Scott and Democrat Bill Nelson: how many voters cast ballots, how many ballots have been counted, and how many ballots remain to be counted.
    Broward County Elections Supervisor Brenda Snipes told reporters earlier today that she could not answer those questions, even as her office has posted new ballot counts that have allowed incumbent Senator Bill Nelson to close the gap between he and Rick Scott by more than 46,000 votes in the two days after election day.

    Scott addressed reporters at the Governor’s mansion at 8:20pm about the lawsuit. During his remarks, he outlined his concerns, which centered on the absurd number of ballots that have been “discovered” in Broward and Palm Beach County over the past two days. He also accused Snipes of forcing election watchers to stand behind a glass wall far from the counting process and without any way to hear any discussion among the vote counters.
    The lawsuit filed on Scott’s behalf in the 17th Judicial Circuit in Broward County, names Snipes as the defendant. The lawsuit states:

    Voting in the 2018 General Election concluded November 6th, 2018. Two days after voting has concluded, the Supervisor of Elections is unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed. The lack of transparency raises substantial concerns about the validity of the election process.

    In addition to the lawsuit, Scott has ordered the Florida Department of Law Enforcement to launch an immediate investigation into what he calls “shenanigans” in Broward County.
    As of the time of this post, Scott still leads Nelson by a slim margin of just over 15,000 votes (the official number continues to dwindle with every new batch of ballots found in Democrat counties).

    So no matter who is running, Florida is pretty much split 50/50 every election cycle, for the past 20 years, and it's down to a few thousand votes?? Something seems fishy.

    Florida Official Overseeing Vote Count Destroyed Ballots

    The Florida official put in charge of counting votes in Broward County — the most liberal county in the state — for the gubernatorial and Senate race previously destroyed voter ballots, a judge ruled, and was most recently accused of not removing dead voters from the voter rolls.

    Broward County Board of Elections Supervisor Brenda Snipes is in charge of vote counting in the area and has yet to disclose how many ballots are still not counted despite the election for governor and Senate occurring two days ago.

    Currently, in the Senate race, Republican Rick Scott is leading Democrat incumbent Bill Nelson by more than 20,000 votes. Nelson is hoping for a blowout in Broward County to push him over the edge for re-election.

    Snipes was confronted by local media about why the vote count in Broward County has taken so long.

    “Could I please get a moment to go into the room and find out?” Snipes asked the group huddled around her. “OK, when I come back I’ll let you know.”

    “But, Dr. Snipes, it is now Thursday,” Weinsier said. “We are still counting ballots in Broward County.”

    “We’re counting five pages or six pages for each of the people who voted,” Snipes said.

    “But other counties have been able to do it,” Weinsier said.

    In May, a judge ruled that Snipes had violated state and federal law after she destroyed voter ballots in the state’s 2016 congressional election. In the race, former Democratic National Convention (DNC) Chairwoman Rep. Debbie Wasserman Schultz won re-election by less than 7,000 votes against Democrat primary challenger Tim Canova.

    The next year, when Canova asked to review the paper ballots in the race, it was revealed that Snipes destroyed the ballots only 12 months after the primary. Federal and state law mandates that ballots not be destroyed until 22 months after an election.

    The case exposed that Snipes’ staff had opened ballots in private in 2016 on election day.

    Just last year, Snipes’ office was taken to federal court by President Trump’s administration after being accused of keeping felons, noncitizens, and dead voters on the voter rolls in Broward County and at one point having more voters on the rolls than actual voters in the district.




    Sen. Marco Rubio (R-FL) blasted the slow-moving vote counting in Broward County and the fact that Snipes — despite her scandals — is in charge of the process.

    “Broward election supervisors ongoing violation of Florida law requiring timely reporting isn’t just annoying incompetence,” Rubio posted online. “It has opened the door for lawyers to come here & try to steal a seat in the U.S. Senate & Florida Cabinet.”

    Florida Teacher Discovers ‘Provisional Ballot Box’ in Storage Room


    A Florida teacher found and reported a box containing potentially uncounted ballots on Thursday — two full days after extremely close midterm elections in the Sunshine State.

    Schoolteacher Lakeisha Williams of Miramar Elementary School told the New York Post, “I went into the area that we use for storage and saw it in there.”

    The provisional ballot box was apparently left behind by election workers earlier in the week.

    Williams did not open or look inside the box — and instead told the principal about it.

    The principal then contacted a local state representative.

    One big problem: The provisional ballots needed to be received by county officials before 5 p.m. on Thursday.


    The extra ballots could potentially make a difference — with both the state senatorial and gubernatorial race results so close.

    Republican Gov. Rick Scott led Democratic incumbent Bill Nelson by just 17,000 votes at 0.2 percent of the vote for the Senate seat.

    Republican Ron DeSantis was leading Tallahassee Mayor Andrew Gillum (shown above at top of this article) by about 30,000 votes at 0.4 percent to become governor.

    Gillum is also considering the possibility of seeking a recount now, in response to his close but failed bid.

    He was down by just one percentage point when he conceded defeat in a tough election battle that went late into the night on Tuesday.

    But that already small loss has since narrowed even more.

    Scott filed a lawsuit in response to the growing effort among liberals to push for recounts.


    Scott and the National Republican Senatorial Committee (NRSC) are alleging that officials there are hiding critical information about the number of votes cast and counted in the Democrat-heavy district of Broward County, Fox News reported. They also argue that the election supervisor in Palm Beach County illegally assumed voter intent when reviewing damaged or incorrect absentee ballots.

    The RealClearPolitics (RCP) polling average had showed DeSantis struggling in the polls during the months leading up to the election. He was trailing by 2.5 to 4.5 percentage points but was eventually able to bridge that gap to about one percentage point in the middle of October.

    Gillum was among the handful of up-and-coming Democratic candidates who have pursued a more progressive agenda. He supports impeaching President Donald Trump, abolishing the U.S. Immigration and Customs Enforcement (ICE) agency, and backing taxpayer-funded Medicare for All.

    Sen. Bernie Sanders (I-Vt.) is among the notable progressives and self-described socialists who backed his campaign.

    “This is the United States of America. Why are we still counting votes days after the election was over?” Fox News host Laura Ingraham said on Friday morning on “The Laura Ingraham Show” about this issue.

    “These provisional ballots that they set aside … ‘Oh, we’ll count it if we need it.'”

    “They can’t count all of the votes, the most powerful country on the earth, in 24 hours?” she added. “It is a complete travesty.”

    The midterms overall drew a considerable amount of attention. The Center for Responsive Politics released a report last week projecting that the current midterm elections would be the most expensive ever, at more than $5.2 billion. President Trump held dozens of rallies across the country to stir support for conservative candidates in the midterms.

    Ingraham also said on Friday morning about the activities in Florida, “Still counting votes [today] — give me a break.”
