I hope this is the right place to put this.
Anyway,I would say no, because Gary didn't do Dave's Tia Chi solo Isn't this the proper place to draw the line? I don't think that Sammy has Vic play 316 right?
P.S. no matter what some of you might say, Gary's "twirling" in Sydney was not an attempt to duplicate Dave's solo

LRHRN has a pretty fair tribute to The Who...

Hell no. How can a band that has 3 founding members be a tribute band.

If you want to be real picky, there were only 2 founding members. The band was started by Dave, Ed and Alex. Mikey is not the original bass player. Mike Stone was.

At least I think that was his name.

I gotta go with "No", since they had an album they were touring in support of and actually played material from.

If you use the same logic to describe Van Halen with Cherone as some on this site have described Dave solo, then yes, they were acting as a tribute band when they played Classic Van Halen songs without Dave.

HOWEVER, I do not subscribe to this point of view; I believe that if you had a hand in writing/recording a particular song, you should be able to play it live all you want without being called a "tribute band".
