10-Year-Old Found Guilty of Homeless War Veteran Beating

DAYTONA BEACH, Fla. — A 10-year-old boy is guilty of beating a homeless Army veteran two months ago, a judge ruled Thursday as the child was in court shackled and wearing an oversized white jumpsuit.

Circuit Judge John Watson found the boy guilty of aggravated battery in the March 27 attack in which John D'Amico was beaten and stoned. D'Amico, 58, has undergone numerous operations, including reconstructive surgery to his face.

The boy, another 10-year-old and Jeremy Woods, 17, ganged up on D'Amico as he and a friend walked through a crime-ridden Daytona Beach neighborhood, prosecutors said.

The boy found guilty Thursday will be sentenced May 24 and could be held in the juvenile system until he turns 21, depending on the judge's decision.

The other 10 year old pleaded no contest to misdemeanor battery on April 19. He faces up to a year in juvenile detention when he is sentenced June 18. He has been released to an aunt in Michigan.

Woods has been charged with aggravated battery and faces up to 15 years in state prison if convicted. He has pleaded not guilty.

You know, we use to get our ass beat and we were better for it. I was just reading a story about how multiple teachers are getting beat up by kids at school now (look for the story about the teacher that took the kid's IPOD away). Basically, since kids have more rights than God down here right now, the teachers are afraid to defend themselves. Not to mention the kids have NO CONSEQUENCES anymore.

Think about if a high schooler came at you (let's say the kid was 16). Some of those kids are as big as I am. But YOU would get sent to jail and the kid would be made to look like a victim. I'm to the point where if they came at me, I'd kick their ass and deal with the consequences later. You can't be a punching bag. And yes, us more mature adults are suppose to know and DO KNOW better and we aren't suppose to do that. The problem is, nobody has bothered to teach their kids that anymore! And since kids are quite often allowed to do whatever they want anymore, they don't know any better.

Where exactly were this kid's parents when all this was going on? And I don't wanna hear the old "you can't be watching them at all times" excuse, because while it may be true you can't keep a hawk's eye on your kids 24/7, you can detect signs of behavioral problems if you pay attention. In that case, you get them help, and you monitor them heavily. Spin it however you want, but anyone who does shit like this has some behavioral problems.

Am I apologizing for the kid's actions? No. But I refuse to blame him entirely. Parental accountability needs to become a major issue in this society.

Ironically, it was a witness for the defense, a neighborhood man, who gave the most damaging testimony. The man said he watched the attack from a few feet away. He said he saw both youngsters standing over D'Amico and throwing stones and bricks at him.

Watson said: "The youth worked in concert with (the other 10 year old) after the victim was down, having fallen over the wall and at a time when the victim was in a defenseless position, and threw not only rocks, but bricks."
