Police: 5th Graders Charged After Classroom Sex

NEW ORLEANS -- Five Louisiana fifth-graders were arrested Tuesday after an investigation into allegations that students had sex in an unsupervised classroom.

Union Parish Sheriff Bob Buckley said after 44 years of doing this work, nothing shocks him anymore but this comes pretty close. The alleged incident took place March 27 at the Spearsville school in rural north Louisiana.

Four students -- two 11-year-old girls, a 12-year-old boy and a 13-year-old boy -- were arrested on charges of obscenity, a felony. Buckley said an 11-year-old boy who was the alleged lookout was charged with being an accessory after the fact.

The school has grades kindergarten through 12.

On the day the incident took place, an assembly for sixth- through 12th-graders was called to discuss a stabbing death in which a 15-year-old Spearsville student was accused. The fifth-grade class of about 15 students normally would have been supervised by a high school teacher during that time. But, Buckley said the teacher was at the assembly, and the class was inadvertently left unattended.

The investigation showed that two males and two females had sex in the classroom while the 11-year-old boy acted as a lookout. The incident came to light the next day when a student who had been in the classroom told a high school student, who then informed a teacher.

The students were booked and then released to their parents custody. Buckley said it's unclear what a juvenile would face in penalties if convicted. For adults, however, conviction on obscenity in the presence of someone under 17 carries a $10,000 fine and from two to five years in prison.

I don't understand how the kids could be charged? As sick as it is...they're the same age. Did these boys rape the girl? I guess it doesn't really matter....but a part of me wonders how this could be a crime...granted....I don't know how a teacher could not see this...and also saying what I am saying makes me sick...but how could these kids be charged...their just kids.

The teacher should be responsible....bottom line. Kids are kids...I just never thought at such a young age...they would do something like this....

Hell when I was 11...I didn't even know how....to....

They were all arrested so go figure. God damn criminals they must be.

Some state's laws have it a crime for a child under 13 to engage in sexual activities no matter how old the others are. I know in Texas charges will be filed if the child is under 13.

I read in another article on this topic that the principal said it was getting blown out of proportion and made into a bigger deal than it should be. I'm sorry but as a principal I guarantee some heads would be rolling. As far as the teacher, I believe she taught older students as well and had been at a presentation and had not made it back to school yet. There was a 5th student who played "lookout" while the action went down.

I didn't see anybody question why a 13 year old was in 5th grade. He obviously should be at least a 7th grader.

Oh, and lewd behavior is also a crime. It's not like they'll actually go to jail. Also, if the principal doesn't understand why this is a big deal then he needs to find another job.
