Youtube pulled all my Van Halen stuff down

I had reunion interviews from '96 and the VMA's and a few other things and they took them down. Im curious, does anyone know how this happens? Does someone have to turn you in or something? How else would they know? Because there's tons of Mtv stuff on there that havent been taken off. It says "This video is no longer available due to a copyright claim by Viacom International Inc."

Not Eddie, but Viacom. They own the copyright and thus the right to enforce it, even if it appears enforcement is selectively. The other thing to keep in mind is that while it is very, very unlikely, the other stuff may actually be licensed to be up there.

Viacom owns MTV.

It is in YouTube's best interest to take anything they believe to pirated down anyway or they face vicarious or contributory liability. If you think I am kidding, I'm not. Record Labels have been very successful in going after "the middleman" even if their only involvement was to provide a venue for the distribution of pirated material. See Fonovisa v. Cherry Auction (organizer of swap meet found both contributorily and vicariously liable for copyright infringement for sales of infringing albums by a vendor; "One who, with knowledge of the infringing activity, induces, causes, or materially contributes to the infringing conduct of another, may be held liable as a ‘contributory’ infringer.”)

Frankly, YouTube is playing with fire and it is only a matter of time before they are burned UNLESS they show that they were trying to stamp out such activities.

And yes, I am an actual, honest-to-God licensed attorney.

It might delay them finding it but you do run the risk (albeit probably small) of putting yourself in "harm's way" if it is found. Actively attempting to conceal it might get YouTube off the hook and leave you more exposed. Now, I would have said nobody is going to mess with you but given the increasing number of suits for illegal music downloads, who knows how bored Viacom's legal department is. Most of the new downloading suits brought against individuals are intended to scare the shit out of everyone else. The question becomes, do you want to risk being the legal guinea pig for Viacom?

This happens to a lot of videos on YouTube. Supposely more go down then there was before google bought it but I havn't heard any proof from that.

Then again if MTV was in the tags then of course it'll get pulled. They don't their on air workers to know about music.

The WWE did the same thing and filed a lawsuit against you tube just a year ago. Though there are still a good portion of wrestling videos out there with different pseudonyms .But like Legally Insane said, you don't want to risk it.
