Subject: Intellectual Property Rights Clarification

From the lawyers....

"There has been recent discussion as to the enforcement of the VH logos and
5150 trademarks, and the Frankenstein design. The VH logos and 5150 have
been registered as trademarks in the U.S. and other countries. The
Frankenstein design is a U.S. registered copyright. Owners of
intellectual property rights have the right to stop any infringement of
their rights, however, our enforcement activities typically have targeted
those who are infringing for their own commercial gain. These enforcement
activities are not new.

Here is the good news - if you want to use the Frankenstein design on a fan
website, just become a licensee at NO CHARGE. In about a week, additional
details about the process will be made available through
www.van-halen.com. One of the conditions for a Frankenstein license will
be that you agree not to use the VH logos or 5150 mark, or sell anything
with the Frankenstein design.

To sum up, we are asking that all use of the VH logos and 5150 mark come to
a stop. All unauthorized use of the Frankenstein design must also stop,
however, we will be licensing the Frankenstein design for use on fan sites."

and they changed there tune a little since I talked to her on Monday. That's a good thing
but it's still a little to far with the fan sites as far as I'm concerned.

Ok, so what he's saying is that, if you become a licensee, you can use the frankenstein, but you can't sell it? WTF!! I don't get it.

This doesn't make any sense? You mean, just to paint my POS harmony guitar with red and white stripes I have to get a license? What's next? Are we going to have to get a license to listen to Van Halen now too?
