    im sure what u guys are saying is probably what happened, re: someone syncing up the song with clips of the video. but as far as song publishing goes - because an artist uses one publisher (ASCAP or BMI) doesnt mean he/she/it can only use that publisher's song catalog to cover. you can basically use any song u want as long as u get permission (if you wanna record it that is).

    Not only was it not delivered via davidleeroth.com but it was in Real Media this time while QuickTime before. Someone who is using Final Cut Pro or Premeire to edit the original films wouldn't save in Real format all of a sudden so there's a chance this was put together by TK or someone else...

    First off, forgive me for not wanting to post in the sprawling mess of a bash-fest that other thread has become.

    Now then,
    As far as I can gather: "In The Navy," the song by the Village People, is licensed by BMI, but Dave isn't. So he doesn't have rights to use it. So it's possible he didn't use it at all, and someone put together the clip in question on their computer, by syncing part of the video to the Village People song.

    Correct me if you know better.

    Not that the video is any less atrocious without the audio than it is with. I'm just sayin'. I must admit that I'm looking forward to seeing the rest of the DVD, if it gets released.

    Hide Your Sheep, good call. I think I was confusing the permissions necessary to COVER a song with the permissions necessary to USE as song (as for a movie soundtrack.) See, when a song in the BMI database is covered by another artist, that cover artist has to be listed in the database as well. But I guess in this case, it's NOT a "cover" because they are actually using the original recording (ASSUMING that the clip is legit in the first place.)

    i went rhru dealing with all those publisher's BS when i was trying to get permission to use certain tuens for the last film i did. they can be a pain - just like now i have to deal with the screen actors guild and they are a pain in the ass.....

    I asked Ray Luzier last week during the Sabian.com online chat about the "In the Navy" video. He didn't know what I was talking about. When I explained that a 1 minute clip was floating around featuring the Village People song... he said that they never had anything to do with that song and that he didn't think it came from the Roth camp.
