    Andrew from Melodicrock just mentioned that he heard from an unverified source that there will be no music from VH this year because of a certain "contract" still running until the end of this year.
    Is this the Ray Danniels contract?
    If it is, then it is really safe to say that VH are really idiots for signing a contract which willl have kept them silent for a full 5 years.
    That's gotta be the worse business move in all of music history!

    But one thing I don't understand is this: I understand they don't want to release anything undert the current contract. But that doesn't prevent them from RECORDING an album during that time which they can release on the next day the contract expires.
    So if this was really the reason then I suppose they would be in the studio with a vocalist as we speak finishing up tracks, and there would be some rumours floating around.

    It doesn't seem to be the case, so I don't think this is the real reason for the delay.

    Andrew, any thoughts?

    It also doesn't explain the 'silence'.

    I'm not an attorney, but I have never seen or heard of a contract where, in the fine print, it says 'if manager is fired by band, band cannot comment for 5 years'.

    It SEEMS if the Ray Daniels contract was the MAIN reason for the hold-up (excluding Ed's physical and personal problems), that Ed, Al or Mike could say, AT LEAST, something to the effect of...'legal issues keep us from commenting at this time'.

    I hope, when or if the silence ever ends, we get a good explanation.

    I was of the understanding that Ray was let go when Gary left in November of 1999. If that is true, and VH refuse to this day to put out material that would make money for their former manager, why did they attempt to reunite with Dave in 2000??? If VH and Dave had gotten along in mid-2000, were they then planning on waiting until early 2004 to put out some music? That makes no sense at all!

    Personally, I don't believe that the hold-up is due to Ray.

    Perhaps Ray isn't/wasn't the total reason that the band hasn't done anything but maybe their thinking is that since they're so close to the experation now they might as well wait it out. Who knows?

    Yeah, but Ed did say things were going good until the lawyers got involved. Maybe that's when they discovered the issue with RD.

    More than likely it was a combination of the percentage or guarantee Dave wanted plus Ed's realization of what the band would contractually have to pay RD.

    Nonetheless, I agree the silence is a joke...

    Sammy has eluded to VAN HALEN being "shackled" due to legal reasons in a few of his most recent interviews. These situations certainly are not uncommon in the music business. Does anyone recall the years PRince was tied up with his legal issues. Even George Michael went round and round with I believe SONY. I don't ever recall these artists ever giving any specific information at the time either. Many times there are gag orders on court proceedings as well. I suspect that the long silence is a combination of legal issues and health and personal reasons. While this is speculation, I would also suspect that Edward and the boys also realize the cash cow they may have complete control over with WB out of the picture. Ensuring this "cash cow" stays under their control is probably a very involved process. While it's hard, we just have to be patient. [img]graemlins/thumb.gif[/img]

    there are several types of contracts whose tentacles are far-reaching and prohibitive to circumvent. They may have fired RD, but the terms of the contract may have a buyout clause that is theoretically more $$ than what he would get on albums that are unreleased.So they may be saving a ton of money by paying him for all these yrs, as a % of unreleased material.
    on top of that, he probably has rights to anything recorded for distribution during this time, hence no studio sessions, that we know of.

    i wish eddie just put jam sessions on a website for free.

    I don't know anything about the contract except for that Ray Danniels would get paid up to 5 years after his contract with the band expired, with a lower amount each year. No one really seems to know if the guy is still with the band or not. If he's gone then the band is only paying the exit clause put in by Hagar I believe. Of course I don't know if the exit clause included payment of anything released/recorded in the 5 years.

    This shit is so old it makes me sick. If the brothers were dumb enough to keep Ray in the loop for 5yrs. it certainly is one of the dumbest decisions ever made. Sam and Van Halen were still selling out arenas and putting out platinum records but when Ray entered the picture a series of dumb decisions flushed everything down the crapper. How the fuck they could have choosen a dumb ass manager over a friend and musical brethren is beyond me but let's hope they've learned from their mistakes. Let's hope we hear something from the boys soon, it's been way too long.

    Someone mentioned in this thread that they knew of the "5-year Ray clause"...Do we have any real info that there is a 5 year clause? Just wondering...

    If this is true, this is a fucking joke...that a "manager" of any type could be holding up the greatest Rock n' Roll band in history from putting their "art" onto tape...it's a travesty of the n'th degree.

    Imagine if Miles Davis, Mozart, or the Beatles were held back from giving the planet Earth their art for 5 years. Ray Danniels should be ashamed of himself for the dis-service he is doing to fans of "legendary" music. I don't think Ray has a moral right to do this, and should settle this issue with Van Halen. I sometimes hate to put Van Halen in the same sentence as Miles Davis, but in reality Eddie Van Halen is a music God at their level, and should be treated with a special level of respect.
