    Well, yeah, but under the circumstances he fucked his truck up and didn't appear to affect anyone else so it turned out about as good as could be expected.

    The law says deadly force if you ďreasonably believeĒ death or great bodily harm is imminent.

    As soon as the gun is drawn, the guy clearly backs away. I have a hard time believing that if someone stops what theyíre doing, backs up, theyíre no longer acting like a threat. Doesnít mean they couldíve become a threat, but the whole point of ďreasonableĒ is we are supposed to judge the personís fear.

    If it's based on your level of fear, when you murder someone, in Florida, immediately piss your pants. This will help demonstrate to authorities just how afraid you were. It's like a wet "get out of jail free" card.

    I would think that the general consensus here is that he was in the clear to draw his weapon but he should not have fired as the guy clearly backed away once he saw the firearm. That should be the whole point of drawing the weapon, to deter the perpetrator from continuing to be the aggressor. Once that is achieved there is no justification in pulling the trigger IMO. Not in this situation anyway.

    This guy ought to be charged with something. Manslaughter maybe? At a very minimum he should probably have his ability to carry a firearm revoked.
    The only genre I really know is Van Halen.

    Agreed. Itís a problem when the sheriff misunderstands the law heís meant to enforce. He says it allows for subjective belief. It doesnít.

    Since I was a boy, my father taught me not to get into a physical fight with someone unless my intention is to kill them Ė that is, only engage physically when your life is on the line. How many times do we read a story about someone getting punched or shoved and then the victim hits their head on the ground and dies? In this case, that shove wasnít some prepubescent boyhood posturing - that was frigginí violent.

    Now as far as the shooter; yep, he sucks. He didnít start the violence but he started the confrontation and then tops it all off with killing the guy in very questionable circumstances. Iím an Army vet and very comfortable with my pistol but I choose not to carry because I donít want to be put in a situation where Ineed to kill someone. In a conflict, he who shoots first usually wins. If a young kid pulls a knife on me for my wallet, the best life preserving action for me is to draw and fire. If I donít have a gun, maybe he just gets my wallet, maybe I get stabbed and recover, maybe I talk him out of it. If I have a gun, heís dead. No thanks. And for all you guys who carry (my father and brother both do), more power to you and Iím glad you are out there but at this stage in my life, unless you come into my home, I donít want deadly force at the tip of my fingers.

    Just take his conceal carry permit away for life. At home? All good. On his person in public? No. Let him challenge it in court if he wants but at least show that a man's life was worth something.
