    NY county clerk says he won't enforce law giving drivers' licenses to illegal immigrants, warns of voter fraud

    An upstate New York county clerk says the legislation that lets illegal immigrants apply for drivers’ licenses not only violates federal law but could also lead to voter fraud and damage national security.


    Erie County Clerk Michael Kearns grabbed headlines this week after promising not to issue drivers' licenses to illegal immigrants despite the measure being signed into law by Gov. Andrew Cuomo on Monday.


    Kearns told “Fox and Friends First” on Thursday morning that the law has homeland security implications in addition to being illegal.

    “This is very important. This is not only about the law, but security and voter fraud. In the auto bureaus in New York, people can register to vote and there was a discussion on the assembly and Senate floor, the sponsors of the bill said there are already people in New York who are voting illegally,” he said.


    The county clerk dismissed claims by the county election commissioner that voter fraud is "nonexistent” in the state and that the new law won't affect the situation.

    “I don't buy that because we know, I spoke with ICE and one of the things they told me and conveyed to me is that when they apprehend people who are here illegally, one of the forms of identification they have is a voter card,” Kearns said.

    “In the auto bureau, with the new technology in New York, with voter law, people are asked to fill out a form to vote. We know there's already fraud. Talk about security, homeland security, we know this document, a license, which is a privilege in New York, will be a gateway document for people not only to vote but to commit fraud and crimes,” he added.


    Cuomo, even though he signed the bill, apparently raised concerns about the legislation amid fears that federal immigration authorities could use state license information to target immigrants for deportation.

    The governor asked for a legal review by the office of Attorney General Letitia James, who said she supports the bill but wouldn't speculate on the federal response.

    But Kearns said that the legislation is “in conflict with federal law” and no tinkering would solve the issue of the legality – all while U.S. citizens aren’t easily getting proper documentation.

    “The thing that really upset me is you have veterans and senior citizens coming in, I have to turn them away when they don't have proper documentation. You need a higher standard for a citizen than someone here illegally,” he said.

    The county clerk also stressed that the bill won’t make the communities safer and thus he won’t abide by the law that doesn’t even have a mandate, in his view.

    “I met with Homeland Security and ICE, and they conveyed to me the concern that it will make our communities more dangerous. This is an opportunity, a gateway document to change people’s identity. We are talking about serious information here,” Kearns said.

    “I'm not going to violate federal law. I took an oath of office to defend the Constitution and I will continue to do that. We are not going to issue drivers' licenses. There is no funding coming back from Albany, it’s an unfunded mandate.”

    Ripe for fraud: Hundreds of U.S. counties have more registered voters than living people who are eligible to vote

    Counties across the U.S. are keeping dead people, felons, and former residents on their voters rolls in violation of federal law, leaving the opportunity for voter fraud wide open — and the feds aren't doing anything about it.


    What are the details?


    RealClear Politics' investigative unit published an in-depth analysis Thursday, revealing the widespread practice of counties nationwide who refuse to clean up their voter rolls. The report showed Los Angeles is California's worst offender, and further found that 400 counties out of America's 2,800 "have voter registration rates over 100 percent."

    Author Mark Hemingway wrote, "In sum, America's voter rolls are a mess — and everyone knows it. While voter registration rates are over 100 percent are not proof of fraud, they certainly create opportunities that otherwise wouldn't exist, such as voting twice in different precincts or the potential for requesting and filling out absentee ballots."

    Much of Hemingway's piece echoes the concerns of attorney David Roland, who proved election fraud in St. Louis after the 2016 election. Roland revealed widespread violations of absentee ballot laws in a scheme used against his client, Missouri House candidate Bruce Franks, who lost his primary election to a fellow Democrat.

    That case was further bolstered by the St. Louis Post-Dispatch, which found specific examples of the misdoings. A new election was held, and Franks won in a landslide.

    Roland told TheBlaze, "We would all like to believe that our public officials are conducting fair and lawful elections, but the risks and the consequences of election fraud are so significant that citizens have to look over their shoulders."

    Hemingway also addressed the contentious 2018 gubernatorial race, "where Democrat Stacey Abrams has still not formally conceded to now-Gov. Brian Kemp, because during his tenure as secretary of state, she observed, 'more than a million citizens found their names stripped from the rolls.'"

    According to National Review columnist Dan McLaughlin, Democrats view such tidying up as a violation of prospective voters' rights. He retweeted Hemingway's article Thursday, saying, "According to Democratic Party orthodoxy, it's 'voter suppression' to remove people from the rolls who are not citizens, not residents, or not living. In the real world, keeping the voter rolls up to date is just good government."

    McLaughlin further noted, "The fact that Los Angeles County has 1.6 million more registered voters than eligible voters is a California problem. In a national popular vote system, it could become a national problem. 1.6 million is larger than the population of 11 states."

    Calif. Begins Removing 5 Million Inactive Voters on Its Rolls

    Los Angeles County has started the process of removing from its registration rolls an estimated 1.5 million inactive voters who have moved, died or become ineligible to cast a ballot, an effort to comply with federal election law and a court settlement with Judicial Watch, a conservative watchdog.

    The county, the most populous in the United States, recently mailed notices to the inactive voters in an effort to verify their residency status and whether they are still alive. It’s the first time in 20 years that Los Angeles County has cleaned its voter rolls, having previously interpreted the federal law requiring it as not mandatory.

    Under the terms of the settlement, voters who do not respond in the next two federal elections must be removed from county registration lists.

    In addition, California’s top election official has put all 58 of its counties on notice that they must also purge inactive voters from their rosters. The updated California National Voter Registration Act Manual, published in March 2019, lays out the federal maintenance requirements for county voter rolls.

    To drive that message home, the California Secretary of State’s office delivered a training presentation to election officials in every county regarding the federal list-maintenance requirements.

    There were an estimated 5 million inactive registrations in the state as of November 2016, the latest figures available, according to a Judicial Watch analysis of data published by the U.S. Election Assistance Commission.

    Judicial Watch President Tom Fitton called the state’s response to the January legal settlement a “victory for clean elections in California” that would “set another national precedent for other states to take reasonable steps to ensure that dead and other ineligible voters are removed from the rolls.”

    Judicial Watch in 2017 sued the county and state voter-registration agencies, arguing that election officials were not complying with a federal law requiring the removal of inactive registrations that remain after two general elections.

    Inactive registrations, for the most part, occur when voters move to another country or state or pass away but remain on the rolls. The lawsuit alleged that Los Angeles County, with its more than 10 million residents, has more voter registrations than it has citizens old enough to register, with a registration rate of 112% of its adult citizen population.

    The entire state had a registration rate of 101% of age-eligible citizens, the lawsuit said, citing U.S. Election Assistance Commission data.

    The settlement is the third statewide voter-registration legal agreement or court order reached between Judicial Watch and states; the others were reached with government entities in Ohio in 2014 and Kentucky last year.

    Secretary of State Alex Padilla’s office did not respond to a RealClearPolitics request for comment.

    Earlier this year, when the state’s settlement with Judicial Watch became public, Padilla asserted that state officials "have and will continue to meet the goals of the National Voter Registration Act" — the federal law at issue in the case — in "maintaining the accuracy of voter rolls and increasing the number of eligible citizens who register and vote."

    Padilla also tried to assure California voters that the action would not lead to "unnecessary removal of active and eligible voters."

    "Safeguards remain in place to ensure voter-list maintenance procedures are followed before canceling any voter registration records," he said in a statement, which also hailed California as a leader in implementing election reforms to improve voter participation.

    The California Department of Motor Vehicles process of automatically registering drivers to vote, which began in late April of last year, was credited with boosting voter registration and turnout to historic highs.

    Nearly 4 million new voters registered or updated their registrations since the motor-voter system has been up and running – 1 million of them were previously eligible to vote but not registered, bringing the total number of registered voters to 20 million, according to Padilla.

    But critics argue the rush to get the new automated system up and running before the 2018 primary came with serious costs that have hurt public perceptions of the state’s ability to run fair and accurate elections. Ernst & Young is preforming an independent review of the rollout to determine the extent of problems and whether they persist.

    Months after the election, an extensive investigation by the Los Angeles Times found that the new system was plagued by glitches responsible for upwards of 100,000 inaccurate voter-registration records, including wrong party preferences, voters incorrectly being designated as wanting to vote by mail and at least 1,500 noncitizens wrongly allowed to register to vote.

    The system also suffered from a serious cyberattack during the middle of its botched 2018 rollout by what appeared to be hackers in Croatia. Padilla’s office did not disclose the hack until media reports exposed it earlier this year, months after the 2018 general election.

    The motor-voter law requires the DMV to electronically transmit information on drivers who are eligible to vote and who visit the Golden State’s DMV offices to voter rolls, unless they opt out.

    There are also still-unanswered questions about the number of illegal immigrants and other noncitizens who may have voted in the June primary and November gubernatorial and congressional midterm election. California officials still cannot say whether noncitizens voted, the Sacramento Bee reported, but Padilla’s office is investigating the issue.

    Judicial Watch attorney Robert Popper has said the issue of noncitizen voting is a separate matter from the inactive voter registrations, the policing of which he said has been lagging across the country since the Justice Department signed a consent decree during Bill Clinton's presidency stipulating that inactive voter registrations couldn't be removed despite the NVRA requirements.

    “They were litigating against their own statute,” Popper told RealClearPolitics. “Since then, what California has been doing is sending a notice to voters to try to verify if they have moved or died but then not removing them from the rolls.”

    The Supreme Court decided a case last summer that determined that the removal of inactive registrations is mandatory under the NVRA.

    While Popper said he couldn't cite a specific example of voter fraud stemming from the inactive lists in California, he argued that letting voter-registration rolls remain messy and full of inactive registrations opens the door to fraud and undermines confidence in the integrity of the voting system.

    Additionally, Popper said having bloated and inaccurate voter registration rolls makes it more difficult for the democratic process to work by hampering political groups in their efforts to send targeted mailings and pursue get-out-the-vote efforts.

    Obama gets political again, launches initiative to fight gerrymandering

    Former President Barack Obama is back in the political arena, announcing a new initiative to combat partisan gerrymandering — though Republicans say the efforts are really about helping Democrats.

    The "Redistricting U" program, which is part of the "All on the Line" campaign, aims to recruit and train individuals to take up the fight against drawing congressional districts based on partisan interests.


    “Training is at the heart of organizing. It’s why I’ve always made it a priority — from my 2008 campaign until now," Obama tweeted Monday. "And it’s why I’m proud to announce @allontheline’s in-person training initiative, Redistricting U."




    Republicans, though, have accused Democrats of making it sound like they want fairness — when in reality they are hoping to place their party in a better position.

    “If anyone tells you that @EricHolder is ‘fighting against gerrymandering’ and for ‘fair maps,’ just look at the form his organization filed with the IRS,” former Wisconsin Gov. Scott Walker tweeted last week. “The truth: their mission is to ‘FAVORABLY POSITION DEMOCRATS FOR THE REDISTRICTING PROCESS.’”





    "Redistricting U" was created in February after Obama merged his Organizing for Action group with former Attorney General Eric Holder’s National Redistricting Action Fund.

    According to "All on the Line's" website, "Redistricting U" will be “sending dedicated trainers to cities across the country to train volunteers, give them the tools to impact the redistricting process in their state, hear from them on how to best make change in their communities, and empower them to be leaders in the movement for fair maps.”


    The organization is focused on impacting the redrawing of congressional districts, which will take place in 2021 following the collection of data in the 2020 census. They warn against “rigged electoral maps drawn with surgical precision by politicians to preserve their party’s political power and silence the will of the people.”

    Partisan gerrymandering was a hot topic in the spring, when the Supreme Court declined to weigh in on the issue, determining in a ruling in two cases that the judiciary should not get involved because it is a political issue best left to lawmakers.

    One of the Supreme Court cases, Benisek v. Lamone, involved North Carolina, where Republicans had benefited from gerrymandering. "All on the Line" identified North Carolina as one of 10 “priority states,” along with Arizona, Colorado, Florida, Georgia, Michigan, Ohio, Pennsylvania, Texas, and Wisconsin.


    Not on that list is Maryland, where Democrats had been accused of unfairly drawing district maps at the expense of Republicans in the Supreme Court’s other partisan gerrymandering case, Rucho v. Common Cause.

    Since leaving office in January 2017, Obama has largely stayed out of the political limelight, though he has occasionally weighed in on political issues, like gun control. He has been known to enjoy the perks of his post-presidency: it was reported last week that the Obamas placed an offer on a 29-acre estate in Martha's Vineyard that had been listed at nearly $15 million.


    The 44th president also recently made headlines in relation to the 2020 Democratic race in a recent New York Times report that revealed he may have tried to talk former Vice President Joe Biden out of seeking the presidency. Obama has not endorsed Biden in the race.

    Lawsuit: More Than 2.5K Dead People Are Registered to Vote in Detroit

    More than 2,500 dead Americans remain on the voter rolls in Detroit, Michigan, according to a federal lawsuit filed this week.

    The Public Interest Legal Foundation (PILF) filed a lawsuit in federal court this week against the city of Detroit for allegedly failing to maintain their voter rolls, including keeping more than 2,500 dead Americans aged 85 and older on the rolls.

    After obtaining voter data from the state of Michigan earlier this year, PILF researchers said they discovered that a number of registered voters had either “impossibly old” or “disqualifying young” date of births. In one case, for example, PILF researchers said they found that a registered voter stated they had been born in the year 1823.

    In addition to dead voters remaining on the voter rolls, PILF alleges that Detroit’s voter registration rate as of 2016 for the citizen voting-age population stands at 106 percent — indicating more voters on the rolls than those who even live in the city.


    PILF also states that Detroit has about 4,788 registered voters who have been flagged as having potentially registered to vote twice or even three times. Another roughly 16,500 registered voters allegedly do not have dates when they actually registered to vote.

    PILF President J. Christian Adams said in a statement:

    The City of Detroit is failing to perform some of the most basic functions owed to its citizenry. The city government’s nonchalant attitude toward addressing evidence of dead and duplicate registrations exposes yet another vulnerability in our voting systems as our nation works to improve election security before November 2020. Making a federal case out of this was necessary, and I hope we can achieve a resolution before the polls open.

    Michigan GOP Chairwoman Laura Cox said in a statement that the lawsuit seems to have shed light on fraud and incompetence taking place in Detroit:

    When thousands of dead people are registered to vote and there are more people registered than are eligible to vote in the city of Detroit either someone is trying to commit fraud or there is gross incompetence within the Detroit city clerk’s office.

    The lawsuit was filed in the U.S. District Court for the Eastern District of Michigan. The case number is 2:19-cv-13638.

    Judge orders 234,000 purged from Wisconsin voter rolls

    PORT WASHINGTON, Wis. – An Wisconsin judge on Friday ordered the state to remove hundreds of thousands of people from Wisconsin's voter rolls because they may have moved.

    The case is being closely watched because of the state's critical role in next year's presidential race. Ozaukee County Judge Paul Malloy also denied the League of Women Voters of Wisconsin's petition to intervene.

    Lawyers for the League and for the Wisconsin Elections Commission indicated they will appeal and asked Malloy to stay his ruling pending those appeals, but he declined.

    At issue is a letter the state Elections Commission sent in October to about 234,000 voters who it believes may have moved. The letter asked the voters to update their voter registrations if they had moved or alert election officials if they were still at their same address.

    The commission planned to remove the letter's recipients from the voter rolls in 2021 if it hadn't heard from them. But Malloy's decision would kick them off the rolls much sooner, and well before the 2020 presidential election.


    Before Friday's hearing, Democratic statet Attorney General Josh Kaul said in an interview that quickly removing voters from the rolls would cause "clear harm to Wisconsin voters." That's because some people who haven't moved would likely lose their ability to vote, at least for the time being.

    "Any time people have to go through extra steps to vote, and certainly re-registering is a significant additional step, the result is that fewer people end up voting," he said. "Fewer people will be registered. A number of people will have to re-register."

    Three voters sued the commission last month with the help of the conservative Wisconsin Institute for Law and Liberty. They argued election officials were required to remove voters from the rolls 30 days after sending the letters if they hadn't heard from them.

    They asked Malloy to issue an injunction that would require election officials to purge their rolls. Kaul, commissioners and others say that would lead to some people getting knocked off the rolls who shouldn't be.

    But Malloy went further than issuing an injunction. In granting a writ of mandamus – essentially a court order that a government official or agency do its job – he said he was convinced the commission had a clear, positive, plain legal duty to purge the voter rolls within 30 days.

    "I don't want to see someone deactivated, but I don't write the law," said Malloy, who was appointed to the bench in 2002 by Republican Gov. Scott McCallum and has been re-elected by voters.

    He said the commission didn't like the policy so it set a new one without following a formal rule-making procedure that would have included notice to the public and a chance for input.

    "There's no basis for saying 12 to 24 months is a good time frame. It's not that difficult to do it sooner," he said near the end of a two-hour hearing. "If you don't like (it), you have to go back to the Legislature."

    Democratic Gov. Tony Evers on Twitter railed against the ruling.

    "I won the race for governor by less than 30,000 votes," he wrote. "This move pushed by Republicans to remove 200,000 Wisconsinites from the voter rolls is just another attempt at overriding the will of the people and stifling the democratic process."

    Elections officials sent the letters based on information compiled by the Electronic Registration Information Center, or ERIC, a coalition of 28 states and Washington, D.C., that tries to keep voter rolls as accurate as possible.


    ERIC flags voters who file address changes with the post office or register vehicles at new addresses.

    The Elections Commission, which consists of three Democrats and three Republicans, doesn't want to immediately remove people from the voter rolls because in some cases their information is faulty and the voters haven't moved. For instance, people could be flagged as having moved if they registered a vehicle at a business address instead of their home address.

    Voters who are removed from the voter rolls, whether correctly or mistakenly, can regain the ability to cast ballots by re-registering online, at their clerk's office or at the polls on election day.

    Of the 234,000 letters that were sent, about 60,000 were returned as undeliverable as of Dec. 5, according to the Elections Commission. As of then, about 2,300 recipients of the letters said they continued to live at their address and about 16,500 had registered to vote at new addresses.

    Wisconsin is perhaps the most heavily targeted state in the 2020 presidential election. Republican Donald Trump narrowly won the state in 2016 after it went to Democrats in presidential elections for decades.

    The letters went to about 7% of Wisconsin's registered voters, but were concentrated more heavily in some parts of the state than others.

    Milwaukee and Madison – the state's Democratic strongholds – account for 14% of Wisconsin's registered voters but received 23% of the letters.

    Across the state, 55% of the letters went to municipalities where Democrat Hillary Clinton out-polled Trump in 2016.

    New York May Give Automatic Voter Registration to Illegal Aliens with Driver’s Licenses

    Democrats in the state of New York may soon give illegal aliens the ability to automatically register to vote when they apply for a driver’s licenses at any state Department of Motor Vehicles (DMV) office.

    Reports have circulated that Democrats in the New York State Senate are looking this year to quickly pass a new law that automatically registers New York residents to vote in elections so long as they obtain a state-issued driver’s license.

    Those licenses, available at DMVs, are now provided to all eligible New York residents — including illegal aliens.

    Last year, Democrats sought to give automatic voter registration to all illegal aliens who obtained driver’s licenses with the state’s new law that allows the illegal population to legally drive.

    Currently in New York, American citizens only need a driver’s license to register to vote, and although applicants are required to swear that they are eligible to vote, state election officials have previously admitted that “it’s basically an honor system.”

    In June of last year, New York Republicans warned Breitbart News that the ultimate goal of Democrats in the state is to register all noncitizens and illegal aliens to vote in state and federal elections.

    In California, where illegal aliens are allowed to obtain driver’s licenses as well, voter fraud has become common across the state. In 2018, the state’s DMV admitted that it had registered 1,500 non-eligible voters, including noncitizens, over the course of just six months.

    Government Accountability Institute (GAI) research director Eric Eggers told Breitbart News in 2018 that California’s laws giving driver’s licenses to illegal aliens and its latest law known as “ballot harvesting” — which allows political operatives to collect voters’ ballots and deliver them to polling stations — is potentially contributing to mass voter fraud across the state.

    DHS Prepares Push on States Giving Drivers’ Licenses to Illegals

    President Donald Trump is preparing a pushback against the states — including New York — which are giving drivers’ licenses to many hundreds of thousands of unidentifiable illegal migrants.
    Officials at the Department of Homeland Security have been directed to draft an “operational assessment” of the license rules for illegal migrants. The study will be provided on January 15 to Chad Wolf, the acting secretary of at the DHS.

    “The Trump Administration takes the mission of protecting the Homeland very seriously, and unfortunately more than a dozen states have adopted short-sighted policies that endanger our communities and put people at risk,” said a statement from spokeswoman Heather Swift. She continued:

    Laws like New York’s greenlight law have dangerous consequences that have far reaches beyond the DMV. These types of laws make it easier for terrorists and criminals to obtain fraudulent documents and also prevent DHS investigators from accessing important records that help take down child pornography and human trafficking rings and combat everything from terrorism to drug smuggling. Never before in our history have we seen politicians make such rash and dangerous decisions to end all communication and cooperation with the Department of Homeland Security law enforcement. The Secretary is prepared to take every measure necessary to ensure the safety and security of the homeland and we look forward to the recommendations of our agents and officers in the field.

    The assessment may be used for lawsuits against the states’ driver identification laws, and to defeat state lawsuits against the federal agencies from enforcing the federal Real-ID identification rules against travelers.
    The assessment may also help White House officials mount a P.R. offensive against the sanctuary cities and states during the run-up to the 2020 election.

    Hundreds of thousands of the roughly 725,000 illegal aliens are now eligible to receive driver’s licenses to legally drive in the sanctuary state of New York despite never supposedly to having been in the country.
    The new law, known as “Green Light NY,” comes with a new set of obstacles for American citizens from New York who encounter the Immigration and Customs Enforcement (ICE) agency.
    ICE has been banned from the New York state ID database, making it impossible for ICE agents to quickly check the immigration status of anyone they come in contact with. This provision means agents have no way to verify the validity of New York state-issued IDs.
    An ICE official told Breitbart News:
    “If you can’t run a license number, there’s no way to know that’s a legitimate license or if you printed that on your computer. That is going to require additional work on [ICE’s] part and there are real security concerns.”
    In addition, the blockage of the state’s database prevents ICE agents from using the verification system to check records in violent criminal cases involving human trafficking, child sex crimes, gang activity, and child exploitation.

    The New York law is expected to provide drivers’ licenses to at least 250,000 illegals over the next few years.
    That giveaway is a boon for companies, such as Uber Eats, Door Dash, and Grub Hub, who can now trim their payrolls by hiring cheap illegals instead of actual Americans. In fact, the New York law was pushed by FWD.us, which was formed by investors to expand the flow of cheap workers and consumers into the United States.
    “I’m so honored to be part of the @GreenLightNYDT coalition,” said a tweet from Eddie Taveras, a Latino progressive activist and lobbyist for the billionaire-funded FWD.us advocacy group. “We fought for this bill every step of the way via a grassroots movement centered on inclusion & transparency,” said Tavernas, whose FWD.us employers include numerous wealthy West Cost investors, such as Mark Zuckerberg and Matt Cohler, a partner at the Benchmark Capital investment firm.

    In 2011, Cohler helped launch Uber Technologies with an $11 million investment for 11 percent of the company’s shares. That investment is now worth almost $8 billion. Cohler sat on Uber’s board and helped launch FWD.us. Cohler’s Benchmark firm also invested in another food delivery firm, Grubhub.

    So let’s contextualize this a bit. These were caught and canceled. Of the 1,500, only six actually voted in the 2018 election. None of the 1,500 were licensees under the AB-60 law, which grants licenses to illegal immigrants.

    By contrast, when Wisconsin was looking to enact voter ID, the court concluded 300,000 eligible voters would not have the documents necessary to be able to vote.

    Nevada's vote-by-mail primary stirs fraud concerns, as unclaimed ballots pile up: 'Something stinks here'



    Red flags are being raised about the all-mail voting system being used in Nevada’s most populous county ahead of the state’s June 9 primary election amid reports that thousands of ballots are being sent to inactive voters -- fueling concerns about the possibility of voter fraud and ballot harvesting.

    Thousands of ballots have been sent out by the Clark County Election Department to inactive voters – those who have not voted in recent elections, a roster that can include people who either have moved or are deceased – and the envelopes are piling up in post office trays, outside apartment complexes and on community bulletin boards in and around Las Vegas.


    The excess ballots have drawn complaints from local residents, who worry that anyone could pick up a ballot off the street and cast a fraudulent vote, as well as from Republican Party officials in the state who see a nefarious motive behind the vote-by-mail system being employed by the Democrat-dominated Clark County Commission.

    “What’s going to happen with these things, they’re not secured at all and there are thousands of them just sitting here,” Jenny Trobiani, a postal worker in Clark County who told Fox News that she has seen hundreds of ballots being mailed to inactive voters.

    “This just seems fraudulent to me, something stinks here,” she added.

    While the coronavirus pandemic has elevated the conversation surrounding mail-in ballots to the national stage, the debate over the issue has been batted back and forth between Democrats and Republicans in the Silver State for a while.

    Most recently, the Democratic National Committee, the Democratic Congressional Campaign Committee and progressive political nonprofit Priorities USA dropped a lawsuit against Clark County after officials agreed to implement multiple changes to voting in June that included sending out ballots to inactive voters, reviewing every flagged mismatched signature by at least two reviewers of different parties, and opening up two additional in-person voting sites.


    “The Clark County Registrar made the right decision in moving to mail ballots to all registered voters -- not just those deemed ‘active,’ expanding the number of in-person polling locations, and updating their signature review process,” Nevada Democrats said in a statement earlier this month.

    According to the court filing, the changes will cost county taxpayers at least $323,000.

    Democrats are still miffed that the state’s existing election laws outlaw “ballot harvesting” – calling the statute unconstitutional and raising the specter of further litigation. Ballot harvesting, or the practice of allowing political operatives and others to collect voters’ ballots and turn them in en masse to polling stations, has drawn bipartisan concerns of fraud from election watchers.

    The decision by Clark County officials to agree to Democratic demands has vexed Republican Party leaders in the state.

    “The Democratic county commissioners were working with the Democratic Party on some kind of backroom deal,” Rick Gorka, the deputy communications director for the Republican National Committee, told Fox News. “If Trump was accused of doing this, there would be an outrage.”

    Republicans argue that sending out ballots to inactive voters will make the polling process ripe for fraud.

    “Anyone can turn in a ballot they pick off the ground,” Keith Schipper, the Nevada Trump Victory communications director, told Fox News. “This is a dangerous proposition.”

    Schipper added that with Democrats vowing to continue legal action to overturn the state’s ban on ballot harvesting, Republicans are concerned about how the issue will affect the outcome of November’s presidential election in a key battleground state.

    “They made it pretty clear they will continue with the lawsuit to make sure they get what they want for the November election,” Schipper added.

    Ballots being sent to inactive voters may be a concern for the GOP in Nevada, but nationally Republicans have also railed against ballot harvesting as they worry they’ll see another scenario like the one during the 2018 midterm elections in California’s Orange County.

    Despite holding substantial leads on Election Day, many Republican candidates in California saw their advantage shrink, and then disappear, as late-arriving Democratic votes were counted in the weeks following the election. Many observers pointed to the Democrats' use of ballot harvesting as a key to their success in the elections.


    In Orange County, Calif. – once seen as a Republican stronghold in the state – every House seat went to a Democrat after an unprecedented 250,000 vote-by-mail drop-offs were counted, the San Francisco Chronicle reported.

    “People were carrying in stacks of 100 and 200 of them. We had had multiple people calling to ask if these people were allowed to do this,” Neal Kelley, the registrar for voters in Orange County, said at the time.

    California had recently legalized ballot harvesting ahead of the election. In 2019, a GOP operative in North Carolina was arrested related to alleged ballot harvesting, which is prohibited in that state.

    Several states have enacted some restrictions on the practice, while others have expressly allowed it or failed to regulate it at all. According to a 2019 analysis by Ballotpedia, 24 states and the District of Columbia permit someone chosen by the voter to return mail ballots on their own, with nine of those states adding some specific exceptions.

    Twelve states outline who specifically can return ballots (such as family members or caregivers); and one state explicitly requires that only voters can return their ballots. Eleven states establish a limit on the number of ballots that a so-called "harvester" can return.

    I would argue that tying mail in ballots to SSN's is the only way to make sure it is a valid ballot.

    Compare the ballot to the SSA's database, and if it is a SSN for a living citizen, that is a good step A that it is a valid ballot.
