Default Right now our government is doing things we think only other countries do

Reason number 4,567,342 why the drug war is awful: asset forfeiture

DEA regularly mines Americans' travel records to seize millions in cash
Brad Heath, USA TODAY 11:23 a.m. EDT August 11, 2016
The Drug Enforcement Administration is closely watching how Americans travel in order to seize drug money in major cities across the country.

WASHINGTON — Federal drug agents regularly mine Americans’ travel information to profile people who might be ferrying money for narcotics traffickers — though they almost never use what they learn to make arrests or build criminal cases.

Instead, that targeting has helped the Drug Enforcement Administration seize a small fortune in cash . . .

Okay, so here is some quick background. Federal law allows law enforcement to take anything they believe was used in the commission of a drug crime and keep it even if there are no resulting charges or convictions. The assets are forfeited and the cash value is split 80% to local PDs, 20% to the feds.

So in this particular case, the DEA isn't interested in making a case, bringing charges, getting a conviction, getting information on trafficking, or anything of the like. They are only interested in seizing the cash. What they have done is create a vast network of informants in major cities at major hubs of travel and they report anything they believe to be suspicious. This is done without the consent of companies like Amtrak or major airlines. The DEA gets a tip that is as innocuous as someone buying a one-way ticket to another state in cash. There is not enough to get a warrant, so the DEA simply shows up and asks if they can ask some questions. Then they ask to search their belongings. If they refuse, drug dogs can be brought in. Now, you have to remember that police can make dogs hit whenever they want to, so they hardly ever don't find evidence of drugs.

However, if you happen to have a lot of cash on you and there is anything else they deem suspicious, they give you a receipt for the cash, take it, and let you go. That's it. They suspect the cash of being used in a drug transaction, but have no interest in anything other than taking it and letting you go.

It's still quite the racket that the drug war has become a front for stealing cash from people.

This happened to a dude not long ago who was able to show he was traveling to perhaps buy a tractor and he had brought cash. He had the add, the texts, and the seller on the phone. They took it anyway. Finally prosecutors decided to return the money, and a freaking judge said no, he couldn't have it. What country is this?
