Thumbs down Edmonton teacher fired for breaking 'no zero policy' won't get job back

EDMONTON - A veteran Edmonton teacher who was fired for giving zeros to students who didn't hand in their homework or take tests will get to keep money he was previously awarded but he won't get his job back.
The Alberta Court of Appeal has dismissed both an Edmonton School District appeal and a cross-appeal by former teacher Lynden Dorval.

Back in the summer of 2014, a Board of Reference ruled that Dorval had been unfairly suspended and fired, and awarded him two years' salary and a top-up to his pension.

The school board wanted the courts to throw out that judgment while Dorval was looking to be reinstated, but the appeal court ruled things should be left as they are.

Several months after Dorval was fired, the school board reversed its no-zero policy that barred teachers from giving students a grade of zero.

Dorval has since retired, but has publicly declared the new rules are just a reworking of the old policy and teachers still aren't allowed to make decisions on marks and grades.

Dorval had been a teacher for 35 years.

Good decision. Got his full pay for the time missed as he shouldn't have been fired. Can't believe they thought they would get away with such a ridiculous decision. Horrible way to end a long career.

If you don't hand in homework or take a test, what grade is a teacher supposed to give out?
Taylor Swift is nice to look at. Adele can sing.

David Lee Roth did the impossible. He made Van Halen better. Deal with it!

I thought it was another "teacher doin dirty deeds with student" story, and I was trying to figure out what kind of thing was the "no zeros" policy!

it puts the teachers in an impossible spot because the kids know they can't fail them. Teachers aren't allowed to fail kids here unless the parent signs off on it. It's the most ridiculous policy in the world. The thought behind is it to not kill the kid's confidence by leaving him back a year, but it's a whole lot better than pushing into another grade he's incapable of handling.

Sounds more like a personal issue between him and the superintendent to be honest

Since when can HS teachers not fail students without the parents' permission? This has got to be new.

Are kids still held back a grade? It happened in my school in the 70s and 80s often enough to notice. Usually one of the primary grades, like 2nd or 3rd. I don't recall junior high or high school kids being held back, but teachers weren't afraid to give them a D or an F, and they'd end up having to repeat that class for a quarter or take summer school or something. One of my best friends in high school was held back in elementary school at least once, maybe twice -- he was/is two years older than I. I seem to remember him telling me that his teacher(s) had a conference with his parents to let them know what she intended to do, and I don't think it was to get their consent.

It seems silly to me not to allow kids to fail occasionally. We all miss the mark at something at some point, whether it's failing a class or playing on a winless basketball team (ugh). In my experience, I learned as much from falling down as from accomplishing.

    That's an elementary thing.

This firing is just about a school board having a policy and the teacher refusing to follow it. I happen to agree with the teacher in this case

Stupid policies like a "no zero" policy are why so many young people are ill equipped to deal with the real world. There are no participation trophies at most jobs. If you fail, and keep failing at your job, you get fired. SMFH.
