    Default here we go again... Police officer shoots man to death in Cincinnati traffic stop

    The dead man, who was shot in the head, was Samuel Dubose, a 43-year-old father of 13 children, according to CNN affiliate WKRC-TV. A CNN records search showed that Dubose had more than 60 arrests.

    Authorities identified the officer as Ray Tensing, who has five years' experience in law enforcement and who has worked for the University of Cincinnati Police Department for more than a year. He is white.



    According to the Cincinnati Police Department, which is handling the investigation, Tensing saw Dubose driving without a front license plate around 6:30 Sunday evening and tried to pull him over. Police said Dubose continued for about a mile before stopping the car.

    Tensing asked several times to see Dubose's driver's license, Cincinnati police said. Instead, police said, Dubose handed the officer a bottle of alcohol.

    According to police, Tensing asked Dubose to step out of the car, at which point a struggle ensued.

    "There was a struggle at the door with Mr. Dubose in the vehicle and the officer outside the vehicle, and the vehicle sped away," Cincinnati police Lt. Col. James Whalen told reporters.

    Tensing fired a single shot, hitting the driver in the head. Tensing fell to the ground as he fired the shot, bruising his legs and tearing his uniform, Cincinnati police said.

    It appeared that Dubose did not have a weapon, according to police.

    Dubose's mother, Audrey, said her son was "full of love," CNN affiliate WLWT-TV reported.

    "Know that my son was not a violent person," she said. "My son ... he got stopped a lot but he never tried to fight."

    Tensing was wearing a body camera, police said. They also said they have received surveillance video from nearby buildings but have yet to view it. No dashboard camera video is available, police said.

    Unreal, why do people not just do what cops ask when pulled over? I can see this type of behavior from youth but this is a grown ass man with 13 children.

    I'm trying to care about this....but I don't. It sounds like this guy made some really bad decisions leading up to this incident and it ultimately cost him his life.

    Especially given all of the marches and news stories, you would like a black man being pulled over (or anyone for that matter) would be extra cautious to not put himself in a perilous situation.

    I am shocked the officer didn't accept the peace offering from this guy! Clearly the offering of the alcohol was his way of saying let's chill and talk this out over a nice cocktail.

    This is about something larger Samuel Dubose.

    Yeah, he may not be someone a lot of people feel sorry for, and I have read stories that put his total children closer to 20. The Cincinnati Enquirer studied his rap sheet and of the 60+ items it was all non-violent (suspended license, window tinting too dark, misdemeanor possession) except for an assault charge that was dropped.

    I've talked about this before, but when you make something illegal, you have to realize that you can't predict how officers will react and you can't predict how people who are pulled over will react, so you must be comfortable with at least some people dying when we make something illegal and compel your enforcers, the police, to intervene.

    In this case, it was not having a front license plate. All of the states that border Ohio do not require one. In fact, 19 total states do not require one. Ohio lawmakers regularly discuss this, and want to get rid of it, but law enforcement in Ohio won't allow it.

    That's not surprising for two reasons. One, Ohio uses camera technology attached to cruisers that scan license plates and alert the patrolmen to outstanding warrants, stolen cars, and "be on the lookout" alerts. Two, it's an excuse to pull cars over. And that is the big one. The more reason police have to pull you over, the more cars they can pull over, the more often they can find drugs OR suspicion of drugs, which means they can take your property. Ohio laws on this are more strict than other states, but you don't ever have to be convicted, the burden of proof in keeping the property is on the accused, and Ohio law enforcement made $80 million from 2000-2008 under equitable sharing with the DOJ.

    But that's not all. The story seems to be that the officer pulled him over for not having a front license plate. After asking for his license, Dubose handed the police an unopened bottle of alcohol. The officer asked him to step out of the car, and that led to some sort of struggle.

    The officer was uninjured at this point, and according to police, Dubose drove away. The cop then fired at him as he was driving away, hitting him in the head and killing him. The car continued for another block before stopping. The officer was injured in a fall after firing the shot.

    Now, here's where it gets good. None of the footage the police have has been released. But the officer has 48 hours to speak with his representatives before going on the record, which is plenty of time to try and concoct a story, if necessary, that justifies the killing of a guy who, according to the police's version of events, was not an immediate threat to the officer or another's life. And why is it that the police are quick to put out footage when the incident doesn't involve an officer and have such restraint when it does?

    Maybe no one on this board will shed a tear for this guy, but his actions were not deserving of death by any standard. And we should also examine whether or not it is in a free person's best interest to give police essentially limitless reasons to pull you over. Perhaps they should have a good reason, which doesn't include having a front license plate.

    doesn't seem to be a struggle on the level of the Michael Brown struggle. And according to the story, he was shot while driving away. If the story played out the way it was written, seems as if the cop should've reached for his radio instead of his gun - he did not seem to be in any immediate danger.

    Dude! The perp had a struggle / tangle with a cop. And he had like 60 or so "problems" etc. So he bails out in a car speeding away. I'll guess he wasn't driving away slowly making sure he didn't break any traffic laws. He's already proved he's a fucking problem. He could have hit a car with a family and fucking killed them too. While he was obviously following the law and what not driving away. Get the fuck out of here with that shit, billy. He's WAS a problem and would have continued to be.

    Remember, the idea that law abiding citizens don't have entanglements with cops is false.

    In each of these scenarios, however, we have a citizen who, because the law is so complicated, probably has no idea what a cop can and cannot order you to do. In the case of Sandra Bland, the officer asked her to put out her cigarette. Sure, she was annoyed and verbally combative, but she didn't have to put out her cigarette. But because she didn't put it out, the officer ordered her out of her car. While it was not a lawful command to ask her to put out her cigarette, it was a lawful command to get out of the car.

    It doesn't seem out of the realm of possibility that a cop can't demand you get out of a car simply because you changed lanes without signaling. But a TX statute says you cannot refuse a 'lawful order' and SCOTUS ruled in 1977 that a police officer can order you out of your car absent of any probable cause to do so. So Bland was in violation of the law once she said, "No."

    The problem here is that we have citizens that doesn't necessarily know the ins and outs of the law, and officers who do. And it is the officer's job as a professional to diffuse and deescalate situations, not escalate them.

    Yes, she was obviously annoyed. But that is no excuse for the officer to escalate the situation with sarcastic statements like, "Are you done?" or to order her out of her car because she wouldn't put out her cigarette, which she didn't have to do. My sister in law got a 'warning' for speeding. The officer, at the end, reached into her car, tapped her dash, and condescendingly said, slowly, as if to a child, "See that big red needle there? That tells you how fast you're going." Having a mouth on her, she put the warning into his face and said, "Just give me a GODDAMN ticket then."

    The officer walked away. But it's possible he could have ordered her out of her car, manhandled her, and I guess, according to you, shot her in the head if she walked away from him groping her.

    In the Dubose case, we don't know what happened. But according to the official account, Dubose was driving away and no danger to the officer or anyone else. If that turns out to be wrong, fine. But according to what the police say happened, the officer murdered him.
