    Gregg Jarrett: The Trump impeachment inquiry is already in big trouble. Here's who Democrats have to thank





    The clown show known as an "impeachment inquiry" is getting more comical and hapless by the day.

    Consider the latest remark from the circus master himself, California Rep. Adam Schiff, (think Bozo, not Pennywise). The Democratic chairman of the House Intelligence Committee says he doesn’t want Republicans turning the impeachment proceedings into a “sham.” The hilarious irony is lost on no one. Schiff has already managed to accomplish it all on his own.

    At first, Schiff wanted the faux “whistleblower” who triggered the impeachment farce to testify. Then, suddenly, he didn’t. What changed? In the interim, evidence emerged that Schiff and/or his staff colluded with the “whistleblower” before the complaint was ever filed and then lied about it, earning Schiff “Four Pinocchios” from The Washington Post.


    The chairman now wants to conceal his own role in engineering the pretext for impeachment and his subsequent deceit. This is why he has insisted that the “whistleblower” remain anonymous, despite no such right, guarantee, privilege, or entitlement written in the law, as I explained in an earlier column. Even though the undercover informant (reportedly working for the CIA) does not qualify for whistleblower status under the law as determined by the Department of Justice, any effort by Republicans to call him as a witness will be blocked by Schiff.


    But Schiff’s machinations are more malevolent than masking the key witness. Those he will call to testify are already on record dishing up prodigious plates of multiple hearsay and rank speculation. It is obvious from the released transcripts of the heretofore “super top-secret” inquisition that none of them have any firsthand knowledge of a “quid pro quo” allegedly demanded by President Trump.

    For example, Bill Taylor, the acting ambassador to Ukraine who will testify on Wednesday, told Schiff’s committee that it was his “understanding” there was a link between U.S. security assistance and an investigation of Joe and Hunter Biden. How did Taylor arrive at his opinion? He heard it through discussions with other diplomats, although there is no indication that any of these individuals had direct knowledge of anything. The chain of hearsay went something like this: the European Union Ambassador Gordon Sondland told National Security Council official Tim Morrison who, in turn, told Taylor that there was a purported "quid pro quo."


    But wait. If Sondland was the original source, where did he get his information? He initially testified that in a brief phone conversation with Trump, the president explicitly told him, “I want nothing ... I want no quid pro quo.” Sondland added that he “never” thought there was a precondition on aid. Later, he revised his testimony to state, “I presumed that the aid suspension had become linked to the proposed anti-corruption statement.”

    Ah, yes. He "presumed." Reliable witnesses do not assume or presume anything. If they do, it is nothing more than supposition that should be discarded like yesterday’s trash.

    My favorite purveyor of assorted hearsay is another star witness for Schiff this Wednesday. Deputy Assistant Secretary of State George Kent testified that he “believed” there was a “quid pro quo” after speaking to Taylor who spoke to Morrison who heard it from Sondland who, as noted, “presumed” a precondition. This is conjecture built on triple hearsay. It is not evidence, it is junk. If this were a court of law, the presiding judge would instruct the jury to disregard such testimony and strike it from the record.


    Under cross-examination, these witnesses readily admitted they had no firsthand knowledge of the president’s intent during his telephone call with Ukrainian President Volodymyr Zelensky. They simply propagated and repeated rumors and innuendo in their diplomatic echo chamber. But that has not stopped Schiff from pretending that they are valued witnesses. With the chairman’s encouragement and guidance, they have offered their interpretations of the Trump-Zelensky conversation. It reminds me of Schiff’s own dramatic interpretation of the phone call, which was nothing more than an unconscionable fabrication designed to smear Trump.

    A transcript of the real conversation is the best evidence of what actually occurred. Indeed, it is the only relevant and material evidence. Nowhere is there a demand, condition, or pressure for a “quid pro quo” that made an investigation of the Bidens contingent on U.S. military assistance. This is corroborated by Zelensky who is on record stating that there was no blackmail involved and no pressure applied. “Nobody pushed me,” Zelensky said. “We had a great phone call,” he added. “It was normal.”

    The Ukrainian government has confirmed that it was unaware that U.S. aid had been temporarily suspended until almost five weeks after the call with Trump. As noted in my previous column, it is impossible for there to be a “quid pro quo” when the recipient of the “quid” is oblivious to the existence of the "quo."

    In the court of public opinion, Schiff increasingly reveals himself to be the court jester playing the fool. He presides over an investigatory charade that is anathema to fundamental fairness and due process.

    If the inquiry was equitable, both sides would be able to call their own witnesses. Yet, the House of Representatives passed its impeachment measure giving Schiff the right to veto GOP witnesses. He has already made it clear that he will do so, rejecting a request that the faux “whistleblower” testify. It is clear that other witnesses, including Schiff and/or his staff, will also be rejected.


    To his credit, Sen. Lindsey Graham, R-S.C., has made it clear that if the unidentified informant who precipitated the impeachment "witch hunt" is not allowed to testify in the House, “this thing is dead on arrival in the Senate.”

    In truth, it was DOA the moment Schiff was put in charge of this clown show.

    ICIG complaint alleges Trump-Ukraine whistleblower may be soliciting illicit donations




    EXCLUSIVE: A newly filed complaint to the Intelligence Community Inspector General (ICIG) alleges that the whistleblower whose allegations touched off House Democrats' impeachment inquiry may have violated federal law by indirectly soliciting more than a quarter-million dollars from mostly anonymous sources via a GoFundMe page.

    The complaint, which was filed last week and obtained by Fox News, alleged the donations from roughly 6,000 individuals "clearly constitute" gifts to a current intelligence official that may be restricted because of the employee's official position pursuant to 5 CFR 2635.203 and other statutes. To date, the GoFundMe has raised over $227,000.

    The complaint also raised the possibility that some of the donations may have come from prohibited sources, and asked the ICIG to look into whether any "foreign citizen or agent of a foreign government" contributed.

    Tully Rinckey PLLC, the law firm representing the individual reporting the allegations, is closely guarding the identity of their client, though Fox News is told the individual is the holder of a top-secret SCI security clearance and has served in government.

    "I have not seen anything on this scale," Anthony Gallo, the managing partner of Tully Rinckey PLLC, told Fox News, referring to the fundraising. "It's not about politics for my client -- it's whistleblower-on-whistleblower, and [my client's] only interest is to see the government ethics rules are being complied with government-wide."


    Fox News reported in September that the nonprofit Whistleblower Aid worked with the whistleblower's attorneys at the Compass Rose Legal Group to start the GoFundMe.

    Fox News has reached out for comment to whistleblower attorney Mark Zaid, who is reviewing the complaint. The ICIG's office declined to comment when reached by Fox News.

    The Office of Government Ethics (OGE) warned federal government employees earlier this year that they "may not accept any gift given because of the employee's official position," meaning that the gift would "not have been given had the employee not held the status, authority, or duties associated with the employee's federal position."

    The OGE also cautioned that gifts may not be accepted from "prohibited sources," including anyone who "conducts activities regulated by the employee’s agency" or who "has interests that can be affected by the performance or non-performance of the employee’s official duties."

    The whistleblower's attorneys have called the GoFundMe a way to "help support the Intelligence Community Whistleblower [to] raise funds," and the GoFundMe page itself states that "A U.S. intelligence officer... needs your help" in the form of a "crowdfunding effort to support the whistleblower’s lawyers."

    The fundraising page claims that "donations will only be accepted from U.S. citizens." But, the majority of the GoFundMe donors to the whistleblower's campaign were not named, and legal experts have told Fox News that the ICIG likely would need to subpoena the website to obtain more information on their origins.


    The new ICIG complaint alleged that the donations through the GoFundMe page indeed constitute a "gift" for a federal employee, and that they were made due to the whistleblower's official "status, authority or duties." It further alleged that the whistleblower and his legal team appeared to be exploiting their access to classified information.

    "[M]y client believes ... that the federal employee you are protecting and their attorneys apparently have strategically weaponized their alleged whistleblowing activities into a very lucrative money-making enterprise using a charity incorporated under a different name than the trade name it is using for fund-raising purposes, which would appear to my client to be a clear abuse of the federal employee's authority and access to classified information," Gallo wrote in the letter to ICIG Michael Atkinson, the same government watchdog who originally received the Ukraine complaint from the whistleblower.

    That paragraph was a reference to Whistleblower Aid, which is also known as Values United, co-founded by Zaid. (Values United tax documents show it paid $258,085 for advertising and consulting services to West End Strategy Team, whose founder Matt Dorf was quoted on the group's website saying he "influences progressive politics, skillfully shifting the conversation to achieve the goals of West End Strategy clients.")

    "We are requesting you investigate whether [criminal statutes or regulations have] been violated by the federal employee you are protecting when they reportedly requested an investigation into a matter that they had no direct personal knowledge of, and on account of which they were able to obtain sizeable gifts from unknown persons because of their official duty," Gallo concluded.


    The Ukraine whistleblower's complaint -- about President Trump's effort to pressure Ukraine to announce politically advantageous investigations -- triggered an impeachment inquiry that will shift into a public phase this week with the launch of House hearings. Trump's GOP allies have sought to learn more about the whistleblower motivations, however, and Trump himself has criticized Zaid -- after Fox News reported last week that the attorney had tweeted about the beginning of a "coup" against the president in 2017.

    Zaid later defended the tweets as reflecting "the sentiments of millions of people" at the time. The law firm has also demanded the White House stop attacking the whistleblower, reportedly warning that Trump’s rhetoric and activity are putting the individual in danger.

    The latest ICIG complaint, meanwhile, noted that the Internal Revenue Service's criminal investigations division has been notified.

    GoFundMe campaigns have seen a surge in popularity in recent months, as former FBI Deputy Director Andrew McCabe and former FBI agent Peter Strzok have each established campaigns that raised tens of thousands of dollars.


    But, those campaigns began after McCabe and Strzok left government service, making the whistleblower's GoFundMe a unique fundraising effort. Fox News is told the ICIG typically replies to complaints swiftly.

    "I hope that it's acted on expeditiously," Gallo told Fox News. "The time is ripe to address these issues."

    But this is an opinion piece. It's noted on the top of it. CNN is supposed to be covering the news, not offering opinion. And to call their stuff slanted at this point is a wild understatement,

    Impeachment Frenzy: TV Networks Blast Trump With 96% Negative News


    With virtually no chance Senate Republicans will vote to remove President Trump from office, House Democrats’ drive for impeachment is more likely aimed at creating a deluge of negative daily headlines hoping to cripple Trump going into next year’s election. If that is indeed Democrats’ goal, then the three broadcast networks are doing everything they can to help achieve this partisan objective:

    ■ Overwhelmingly Negative: MRC analysts have reviewed all coverage of President Trump and his administration on the ABC, CBS and NBC evening newscasts since 2017. Following the beginning of the impeachment inquiry on September 24, this coverage has been even more hostile than normal: Out of 684 evaluative comments included in these broadcasts, a whopping 96 percent have been negative, vs. a meager four percent that have been positive.

    (Methodology: To determine the spin of news coverage, our analysts tallied all explicitly evaluative statements about the President or his administration from either reporters, anchors or non-partisan sources such as experts or voters. Evaluations from partisan sources, as well as neutral statements, were not included.)

    ■ All About Impeachment: TV’s fascination with Democrats’ impeachment push has crowded out nearly all other news about the administration. During the six weeks since Speaker of the House Nancy Pelosi announced the start of the inquiry (September 24 through November 5), the ABC, CBS and NBC evening newscasts churned out 398 minutes of coverage to the Ukraine scandal, or more than three-fifths of all administration news during this period (645 minutes).

    This nearly matches the 438 minutes of airtime these newscasts produced during the most hyper-intensive six weeks of the Russia “collusion” scandal, starting when the President fired James Comey as FBI Director on May 9, 2017 (and media talking heads began railing about Trump’s “Watergate”) through June 20 of that year — weeks that also included the appointment of Robert Mueller as special counsel on May 17 and Comey’s much-ballyhooed congressional testimony on June 8.


    ■ Secret Sources: With most of the developments behind closed doors, the majority of the networks’ impeachment coverage has been based on secret leaks from anonymous sources. Out of 172 news reports, a large majority (59%) relied on unnamed sources for their facts about the impeachment probe. This is slightly higher than when we first checked in late October, when 57 percent of impeachment stories used anonymous sources.



    ■ Even Negative Spin on Baghdadi Death: Only two other Trump administration topics have been granted much airtime since the inquiry began: the successful U.S. mission that led to the death of ISIS leader Abu Bakr al-Baghdadi (45 minutes before it faded from the newscasts), and the earlier decision of the President to pull U.S. troops out of northern Syria (121 minutes).

    The withdrawal of U.S. forces was given witheringly (98%) negative coverage on all three networks, whose journalists routinely framed it as “abandoning” an ally (the Syrian Kurds) in the fight against ISIS.

    But while media coverage of the U.S. mission against al-Baghdadi was mostly positive, the President’s role in it was not. Out of nine evaluative statements about the President himself, two-thirds (67%) were negative. These focused on his refusal to brief congressional leaders, as well as his belittling description of the cruel ISIS leader’s last moments (“He died like a dog....He died like a coward....Whimpering, screaming and crying.”)

    “It’s possible that President Trump’s bellicose language about the manner in which he died could actually inspire some ISIS fighters to retaliate,” NBC’s Courtney Kube speculated on the October 27 Nightly News.

    ■ Silent on Economic Success: Despite record highs in the stock market and a fifty-year low in the unemployment rate, the President’s handling of the economy was given a stingy 4 minutes, 6 seconds of airtime during these six weeks, or less than one percent of all Trump administration news (645 minutes).

    ■ Impeachment Diverting Airtime from 2020 Democrats: TV’s heavy coverage of impeachment has essentially smothered coverage of the Democratic presidential race, which drew a meager 110 minutes of coverage during these six weeks — barely a third of the airtime granted to the 2016 campaign during these same weeks in 2015 (312 minutes).

    Nearly half of this year’s campaign coverage (51 minutes) was about Joe Biden, his son and the Ukraine, leaving only 59 minutes for non-impeachment related topics. The next most-covered campaign event, Bernie Sanders’ heart attack, drew just 16 minutes of airtime.

    ■ Boosting Biden: But when it came his Ukraine dealings, Biden has received the best press of his campaign (71% positive), as some journalists repeated a mantra that “there is no evidence of any wrongdoing” (ABC’s Jon Karl, September 24), while others traveled to the Ukraine to make the same point. “Did you ever see any evidence of wrongdoing by Joe Biden,” CBS’s Roxana Saberi asked an ex-deputy prosecutor. “Never, ever,” came the reply.

    No news source has ever been unbiased. None ever will be. But any news organization is responsible for reporting and verifying the facts in stories. Any semi-intelligent reader should be able to filter those facts from even the most biased source. But they typically don't bother. People look for "evidence" of what they already believe to be true, and that's all the effort they give. This sad fact paints the media into a corner because there is no market for scrupulously analyzed news. The incentive is to shout. To provide dopamine hits to a pre-programmed audience who doesn't want to be challenged. I say that not to excuse the media, whose job it is to rise above the din. I say it merely to point out that organizations respond to incentives. We get lousy reporting (from both sides) because we reward such coverage with views, clicks, comments, etc. We are getting the "news" we demand, sadly. And those of us who don't deliberately seek multiple viewpoints are worse than misinformed.
