    A resolution adopted Thursday by the legislative council of the campus' Associated Students calls for removing all flags from the common lobby area of student government offices.

    Written by student Matthew Guevara of the School of Social Ecology, the resolution states: "The American flag has been flown in instances of colonialism and imperialism" and notes that flags "construct paradigms of conformity and sets homogenized standards."

    Banning the United States flag on a campus of higher learning funded by the state and federal governments? Seriously? Sounds like the students need to study history. The U.S. is not perfect, but it's a lot better than many countries.

    The resolution goes on to say that "freedom of speech, in a space that aims to be as inclusive as possible, can be interpreted as hate speech."

    The resolution passed on a 6-4 vote by the student legislative council, with two abstentions.

    The resolution "is not endorsed or supported in any way by the campus leadership," according to a statement on UCI's website written by Associated Students President Reza Zomorrodian.

    The measure is likely to be short-lived, however.

    The student government's five-person executive cabinet is expected to meet Saturday to vote on a motion to veto the resolution, the statement said.

    If vetoed, the resolution would head back to the legislative council, which would have to pass the measure with a two-thirds majority to override the veto.

    Writing on the UCI Associated Students Facebook page, Zomorrodian said he opposed the resolution.

    "Though I understand the authors' intent and supporters' intent," he wrote, "I disagree with the solution council has come to."


    Writing below Zomorrodian's remarks, one commenter called the students traitors. Some military veterans wrote that they were disturbed and disappointed by the students' action. One wrote that the American flag symbolizes "principles of freedom" that service members fought and died to uphold.

    UCI junior Daniel La, 21, said he didn't think the vote was "representative of the school."

    "There's a lot of students that aren't happy about it," he said. "I don't personally agree with it either."

    Saw this a few days ago. If you are accepting federal and state money either through grants, loans or other forms of federal and state funding, you don't get to ban the flags in my opinion.

    Private university? You can do whatever the hell you want.

    what the fuck are you guys doing? One of the best things about your nation is the pride you all have in your flag. If that student Matthew Guevara thinks the flag represents "colonialism and imperialism" and is so ashamed of it that it shouldn't be seen then maybe he should choose to live somewhere else.

    I agree with this 100%. As a matter of fact, if you feel you should ban the U.S. Flag, then don't use the public roads the government put down to get to work.

    Here is what I find funny. Represents colonialism. Ok yet you are attending University that resides in a state which the USA took via a war. The prior owners of California took the land from the Native Americans. So you hate what the flag stands for yet you attend school on property that was acquired via the flag?

    It's a public university, so they can't squash your first amendment rights. Courts have been pretty clear on this.

    Most clearly, students generally may not be expelled, suspended, or otherwise disciplined for what they say in student newspapers, at demonstrations, in out-of-class conversations, and the like. The Supreme Court made this clear in Papish v. Board of Curators, 410 U.S. 667 (1973), and Healy v. James, 408 U.S. 169 (1972). Lower courts have followed suit, especially in the late 1980s and 1990s cases that have struck down student speech codes. See, e.g., Dambrot v. Central Michigan Univ., 55 F.3d 1177 (6th Cir. 1995); Iota Xi v. George Mason Univ., 993 F.2d 386 (4th Cir. 1993); UWM Post v. Univ. of Wisc., 74 F. Supp. 1163 (E.D. Wis. 1991); Doe v. Univ. of Mich., 721 F. Supp. 852 (E.D. Mich. 1989).

    Of course, displaying an American flag is a form of speech, so no way this can be justified.

    The flip side is that, as repugnant as it is, this also includes racist speech by students at University of Oklahoma. There are no first amendment exceptions for racist speech, speech that is exclusionary, or even speech that "has created a hostile educational environment for others," which is the reasoning of University of Oklahoma.

    So, yeah, when it comes to public universities, you can display a flag and you can say repugnant things.
