    Default WTF Florida 'Loud Music" murder trial hung jury

    drunk guy fires 10 times on a fleeing car full of unarmed teenagers because of an argument over their loud music and the jury can't make a decision on the murder charge



    jury convicts him of attempted murder, but can't decide on murder charge?

    they recognize that he attempted to murder someone and someone died, but they can't declare that murder?

    he lied to the police and tried to get his fiance to lie for him on the stand about a non existent shot gun he "saw" before he fired, what a piece of crap this guy is

    JACKSONVILLE, Florida (Reuters) - A north Florida jury convicted a white, middle-aged man on Saturday of three counts attempted murder for opening fire on a car of black teenagers during an argument over loud rap music, but could not reach a verdict in the death of a 17-year-old in the car.

    Michael Dunn, a 47-year-old software engineer, fired 10 rounds at an SUV carrying four teens in a Jacksonville gas station parking lot in November 2012, killing black teen Jordan Davis.

    The jury said it was deadlocked on the most serious charge of first degree murder against Dunn, forcing judge Russell Healey to declare a mistrial on that count.

    The jury also found Dunn guilty on a fifth count of firing into an occupied vehicle.


    The trial has drawn international attention because of racial overtones and Dunn's claims of self-defense.

    The sequestered jury began deliberating on Wednesday afternoon after a week of testimony and spent 30 hours trying to reach a verdict.

    Dunn, who had no prior convictions, testified earlier this week that he began shooting in a state of panic after he thought he saw the barrel of a gun in the back window as Davis started to get out of the car.

    Prosecutors said Davis, who had no arrest record, used foul language when confronting Dunn after the argument broke out, but was unarmed and never posed a physical threat.

    The failure to reach a verdict on the first degree murder charge is a blow for the prosecution and the Davis family.

    But the guilty verdicts on the three charges of attempted murder against the other teens in the SUV, means that Dunn still faces at least 60 years, legal analysts said.

    Classic case of an overcharge.

    They were hung on the 1st degree murder charge, which the prosecutor, much like the Zimmerman trial, overcharged based on pressure and not on the evidence. For 1st degree murder you have to show the defendant planned on killing the victim. Most of the time it is shown with a clear motive or with decisive planning, but in this case it was all based on his "frame of mind," which is very difficult to prove in court.

    Basically, the prosecutor attempted to show that race was the primary motivator because he used terms like "thug" or talked about the "black subculture." My guess is if that is what quantifies as wanting to go out shooting black people, a majority of America would be in trouble.

    He's still going away for at least 60 years, which means he's in for life anyway. This isn't a "blow" to anyone as the article suggests.

    is a jury not given the option of convicting someone of 2nd degree or manslaughter if someone is charged with first degree? This seems very strange.

    The jury getting hung up on the 1st degree murder charge doesn't make sense but at least he'll die in prison. And I'm happy his fiance did the right thing and told the truth on the stand--even though it basically put the final nail in the coffin for him.

    He was just another paranoid asshole, who, unfortunately, owned a gun. Good riddance.

    yeah the fiance did the tough thing and told the truth....hard thing to do with someone you love

    this is a case of a guy who had no business being in the possession of a gun in his condition....apparently he had been drinking rum and cokes all night at his son's wedding and he and the fiance stopped off to buy wine before going to their hotel

    when he got to the convenience store it was said he parked so close to the other car that he couldn't get his own door open....so yeah probably drunk already and parking that close probably antagonized the kids in the car

    whole parking lot and this guy had to get himself into this

    drunk, paranoid probably with at least some preconceived opinions of these kids, but firing 10 shots into a car as it pulls away....crazy...what is Florida? the wild west?

    they have to do some serious looking at their stand your ground law, because people are misinterpreting it to a terrible result

    According to the NY Times, the jury was not able to agree on lesser charges that automatically apply, including 2nd and 3rd degree murder and manslaughter.

    Also, from what I understand, Dunn did not use "stand your ground" in his defense.

    guys like this perfectly summarize why i don't like people having the right to have a gun outside of their own home. Situations should have ended with nothing end with a dead person instead. So stupid.

    the defense attorneys didn't want to use it because it is so controversial, and because they didn't want to tip their hand.

    What I was stated was that people are misinterpreting what "stand your ground" means and to terrible consequences. People are thinking that they have the right to fire away if they feel scared...like the guy in the movie theatre. Stand your ground means that you do not have to retreat if you are in fear for your life and there should be a reasonable standard. Just being yelled at...even if someone is yelling " I could kill you" should not be what you need to feel afraid for your life. They need to look at this law it's too vague...but instead they are expanding it

    The question is are people misunderstanding it or are we hearing about these cases because stand your ground is under fire by many people...

    My brother in law carries a gun, but he has to go down in some of the worst spots in Atlanta and so I don't blame him at all.

    Going through the roughest places unarmed is stupid.

    One of his co-workers got his back window shot out.

    I don't get why people are up in arms over this. The guy is going to die in prison for what he did....what is there to be outraged about?
