Default Canadian courts strike down prostitution laws

boy, am I divided on this one. On one hand, anything that would make these women and men safer, is a good thing and anything that could eliminate the human trafficking for the sex trade is a good thing. Not sure that I am ready for a world that accepts prostitution as a career tho. I can only think that it would be a soul killing way to make a living

just one of those things that falls into my "shouldn't be illegal, should be obsolete" file

Prostitution: Canada Axes Sex Worker Laws

    9:51pm UK, Friday 20 December 2013

Sex workers have overturned Canada's anti-prostitution laws six years after they were blamed for the murders of several prostitutes by a serial-killing pig farmer.

Laws against keeping a brothel, making a living from prostitution, and street soliciting were all overturned by the country's highest court.

Parliament now has a year to respond with new legislation.

The court found that Canada's prostitution laws "violated the guarantee to life, liberty and security of the person".

"The law (...) punishes everyone who lives on the avails of prostitution without distinguishing between those who exploit prostitutes and those who could increase the safety and security of prostitutes, for example, legitimate drivers, managers, or bodyguards," the ruling said.

Other countries around the world, particularly in Europe, are having similar debates.

Earlier this month, France's lower house of parliament passed a bill that would decriminalise prostitutes and fine their customers.

Sex-trade workers in Canada stepped up their fight for safer working conditions following the serial killings of prostitutes by Robert Pickton in British Columbia.
Scott and Lebovitch, two of three current and former sex workers who initiated a challenge to Canada's prostitution laws, embrace at the Supreme Court of Canada in OttawaValerie Scott and Amy Lebovitch hug after winning the case
He was convicted in 2007 of killing six women whose remains were found on his farm outside Vancouver. It is alleged he fed the bodies to his pigs.

Pickton's victims were drug addicts and prostitutes in a poor district of Vancouver, on Canada's Pacific coast.

Years earlier, authorities had closed down a Vancouver house for sex workers that many had considered a safe haven.

The brothel was closed as several prostitutes started to disappear - raising fears that a serial killer was prowling the streets.

"I am shocked and amazed that sex work and the sex work laws that affect our lives on a daily basis will within a year not cause us harm anymore," said Amy Lebovitch, who brought the case along with Terri-Jean Bedford and Valerie Scott.

Justice Minister Peter MacKay said the government was "concerned" by the decision.

He said ministers were "exploring all possible options to ensure the criminal law continues to address the significant harms that flow from prostitution to communities, those engaged in prostitution, and vulnerable persons

She was warned. She was given an explanation. Nevertheless, she persisted.

I think this is something you could call a "consensual crime." Adult A wants to pay for sex and adult B wants to accept money for sex. Making it a crime is really tough for me to swallow. The worst parts of this come from the black market.

    I support this change.

Me too. I never understood the logic behind the laws. If a woman gives it away for free, that's ok, but if she charges for it, it all of a sudden becomes a crime?

C'mon. That is one in a pretty good list of things I think should be legal, and I wouldn't partake even if it was, like drugs.

Let's figure out how to not run a 30% deficit in most of the western world, then maybe we can start worrying about morality crimes.

I'm for legality of prostitution as long as the tax off if it goes against state and federal debt with no obstructions .

    EXACTLY

I did research and read a lot into this and it's proven that sex work laws drive it underground and expose women to profiteering and immensely dangerous work conditions, and it's not prostitutes who carry disease, it's promiscuous men, that's also proven.

And countries like Australia and the Netherlands who have regulated sex work have strict provisions in place to protect all involved. It beats the hell out of outright illegality.

I have mixed feelings on the issue. This decision means nothing though, the feds will merely clarify the law.

Our current feds will fight it, they've made their stance on the lower classes perfectly clear, they think criminals are driven by evil rather than socio economic circumstance and they probably think these women are disease ridden whores intent on corrupting children.

Wouldn't be shocked. Lot of hypocrites in these debates.

    Once more with emphasis.

The government has no business telling you who to fuck, provided no children or coercion are involved. The government also has no business telling you what to exchange for sex, whether it be money, food, property, or just mutual feelings. If you accept the premise that you are a free person, then whether you like it or not, you also accept the premise that you are free to offer your feelings and affections to anyone under any circumstance, and and that others are free to do the same, even if you find it weird or unsavory.

Any law that attempts to limit or control consensual sex between legal adults is unconstitutional, unfair, tyrannical and unecessary.

One day, you dolts will listen to us "kooky" libertarians.

    TK
