    Default Lawsuit: Cracker Barrel could have done more to prevent deadly shootings

    BROOKLYN, OH (WOIO) -

    A lawsuit filed over a deadly shooting rampage at a Cracker Barrel restaurant places some of the blame on workers.

    The shooting happened last year at the Cracker Barrel in Brooklyn. The lawsuit has just been filed in Cuyahoga County Court by Attorney Terry Gilbert.
    Kevin Allen stormed into the Cracker Barrel and shot his wife, Kate. Then, he shot his two young girls. One was even hiding in a bathroom.

    Now, this lawsuit says the restaurant showed a "conscious disregard" for safety. In other words, they didn't do enough to protect the victims and witnesses.
    Terry Gilbert filed the suit for the brother of the woman killed. Gilbert says,

    Before calling 911, Kate Allen called a friend. He heard Kate asking Cracker Barrel employees for help and a place to hide but she didn't get it.
    Gilbert told 19 Action News, "she was on the phone with a friend, and he heard this conversation, and the manager said, 'sorry we don't get involved in domestics.'"

    Brooklyn Police took heat because they didn't rush in. They killed Kevin Allen as he came out. But the suit is only against Cracker Barrel.
    Gilbert added, "It should send a message to any chain or large restaurant that there should be some kind of plan in place, not just, 'we don't get involved.'"

    We called cracker barrel headquarters for a response. We were told we'd hear back, but a spokesperson has not called back yet.

    Gilbert told WTAM 1100's Bob Frantz that Kate told a manager she was in danger,even showing the manager a shot-gun shell Kevin had given to her as a threat. Gilbert says a friend also contacted management that night and told them Kate and the girls should be hidden from Kevin. Management did not want to intervene in the family issue.

    Kevin Allen left the restaurant briefly that night, a few minutes later he returned with a firearm and fatally shot his wife and daughters. Kevin was later killed by police gunfire as he tried to drive away after the attack.

    CLEVELAND -- The family of Kate Allen, who along with her daughters died following a shooting at a Cracker Barrel, has filed a lawsuit against the chain that operates the Brooklyn restaurant.

    Terry Gilbert, the lawyer representing the family, said the lawsuit claims Cracker Barrel was negligent the night of the shooting in April 2012.

    "It could have been prevented. And they didn't even try. And we want to get to the bottom of it. We want to get their policies and procedures and security measures," said Gilbert.

    Kevin Allen, Kate Allen's husband, showed up at the Cracker Barrel and shot his wife and two daughters, reports say. One daughter was hospitalized, but died from her injuries about a month after the shooting.

    Kevin Allen was shot and killed by police when he exited the restaurant and refused to surrender.

    Gilbert says new evidence shows staff knew Kevin was a threat.

    Gilbert says a hostess and manager knew of a shotgun shell inside Allen's pocket, and talked to a friend of Kate's by phone, begging them for help and protection.

    Kate also called 9-1-1, telling police she'd just informed her husband she planned to leave him and he was not taking it well.

    "The manager just said, well, we don't get involved in domestic matters," said Gilbert. "And there was about three or four minutes until [Kevin Allen] came back into the restaurant and started shooting."

    Gilbert says companies concerned for their customers' safety should see the nation's rash of shootings, questions about mental health and gun control, and put a protocol in place to keep things like this from happening again.

    "If the fire alarm goes off, you don't just sit around and wait for the fire. You do something, you take certain steps," said Gilbert.

    I have sympathy for the family but there's a lot more going on here than just the restaurants failure to hide these people

    chances are if the guy walked in there and didn't find her, knowing her car was outside...he would have shot his way thru the restaurant until he did

    terrible thing for those employees and witnesses to have to go thru
    but how can you trait wait staff to deal with something like this

    I thought the suit was wrong to begin with, but I didn't even think of it in your terms, Daisy - and you are probably right. My initial thought was, instead of trying to hide out at Cracker Barrel, why didn't she just get out of there while she had the chance?

    I heard the lawyer this morning on a local radio show and definitely don't agree with his stand.

    He was saying that since Cracker Barrel is a multi-million(billion?) dollar company, they have the funds to properly educate their staff to handle situations like this among other events. When it was brought up that its not a waitresses job to handle an event like this, he mentioned the manager should know what to do.

    Then it was brought up about his law office and he of course backtracked. The morning show host said "they should call 911 and that is about it."

    He actually didn't come off as intelligent so I am guessing this lawyer is kind of a hack job. Sounded like if GW Bush was in a debate.

    Its scary to think if this goes through because it sets precedent. School districts can be sued because Teachers didn't do enough to protect their kids
