    Default Injured Hispanic Custodians sue after not being able to read warning sign in English

    DENVER (CBS4)- A group of Hispanic custodians at the Auraria Campus in downtown Denver are claiming they are victims of discrimination.

    They’ve filed a complaint against the campus operator that could be reviewed by a federal judge.

    What started out as a miscommunication over a schedule change for employees working the graveyard shift has become a full investigation by the Equal Employment Opportunity Commissi

    Too many things have happened to me there that I don’t even know how to explain it,” said Auraria custodian Bertha Ribota.

    Ribota said she was injured at work because she couldn’t read a warning sign that was in English.

    “If I could speak English I wouldn’t have the problems that exist,” said Ribota.

    Last week 12 custodians from the Auraria Campus filed an EEOC complaint against the Auraria Higher Education Center, which is the organization that maintains the campus for Metro State University of Denver, the Community College of Denver and the University of Colorado Denver.

    “What is sort of a neutral business practice, that they speak English on campus and it’s an English-only campus has a discriminatory impact on this group of workers,” said attorney Tim Markham.

    The complaint accused the campus of purposely leaving employees that only speak Spanish in the dark on the terms and conditions of their employment, changes in their working status, safety and more.

    When asked if it was a problem those employees were not being informed of those things in their native language, campus spokesman Blaine Nickeson replied, “I don’t know if that’s a problem. I think it’s one of the concerns. I will go on to say there’s not a statute to translate.”

    Campus operators said there is no state law requiring complete translations. It is standard at other universities in Colorado.

    The Auraria Campus believes employees should understand some basic English.

    “It’s not our goal to provide every document translated or every conversation translated. Our employees are expected to interact with members of the public and that interaction we expect them to be able to understand English,” said Nickeson.

    The EEOC could take several weeks to review the case. If they find actual damages the Department of Justice would get involved.

    Oh what bullshit

    I think I will go buy some Dos Equis and if I am stopped on way home for DUI, I will tell them I do not read / understand Spanish and therefore it is not my fault and that it is the company's fault and they discriminated against all non-Spanish speaking / reading individuals

    I find this sort of thing really infuriating, to be honest. To me, it's akin to going to stay with someone, in their home, and then expecting them to change their décor, furniture, and habits, just to suit YOU - when, in fact, you should be doing all you can to integrate into their way of life and be appreciative of their hospitality! It's just basic good manners, apart from anything else!

    If a person chooses to live in another country, then it should go without saying that they have also made the choice to accept the customs and language of their hosts. To expect otherwise is sheer rudeness! And, to be perfectly frank, if one is not prepared to accept those basic tenets, then there is another option open to the ungrateful guest: Leave.

    I pretty much agree. Why come here if you don't want to adapt to american culture? Stay where they hell you are if you don't want to accept that.

    I'm going to Germany in about 2 weeks. I've been boning up my on my German because I know thats what the language is. I'm aware that they ALSO speak english but its still nice to know some words in German.


    How fucking hard is it for immigrants to do the same? If your going to be here, legal or otherwise, learn some fucking english or go back to where you came from! Why the fuck should I get someone to translate for me when the prominent language is english?!?!

    I don't know enough about the story, but it seems to me that if you're going to hire/use employees that don't speak English and warning signs for dangers they may encounter cannot be understood by them, then you're probably asking for trouble.

    Those who come here should learn the language. In America, English is the language of power and you will have limited success if you do not speak or understand it. But it seems to me you either hire the people that reflect what you expect (for an English only family) or you make accommodations for who you do hire. If you hire people that don't meet your expectations and then don't make accommodations, you're asking for something like this to happen.

    I have to say that the attitude that immigrants are disrespecting America by refusing to learn english really kinda burns me.....nothing could be further from the truth.....first of all, these folks are not only doing whatever possible to take care of their families, they are doing jobs that most American born people refuse to do..... they, almost to a man (and woman), make a concentrated effort to learn to verbally communicate.....where they run into trouble is when they are asked to read, comprehend, and write in english and many of them, due to their education level, have trouble doing that in spanish, let alone english.....as an employer of predominately spanish speaking immigrants, I feel it's not only my obligation, but my duty as a responsible member of my community to offer all paperwork regarding job descriptions, w-4 forms, I9 forms and employee handbooks in spanish if wanted/needed.

    With all due respect, you're a part of the problem. I don't care if Americans don't want to cook in kitchens or do this job or that. That's not the point. Only in America is it seen as a burden to actually EXPECT people wanting to be a part of the American dream to make a concerted effort to learn English and to be able to read, write and comprehend it. My experience has been that they do the MINIMUM to GET BY in regards of learning the language because after all they don't REALLY need to, do they when they have enablers like you, corporate America, and the Government making it easy for them. If they are too dumb to fill out a form or understand it then that is THEIR problem. Life isn't easy and everybody has their cross to bear.

    I think this is completely unfair. The people working at those jobs don't get the "American Dream" and they never will and they know that. Their children might. It's those kids that should learn the language. My mother and mother-in-law can't write in English and can't read it all that well either. They can barely read enough to survive (after being here for 40+ years) but if you handed them a document in English they'd have no clue what it was. My father took years to be able to read and write english because this wasn't his first priority when he came here, working like a fucking dog was. And your country needs people who will work like fucking dogs as does mine because our kids ain't interested in that. So we get these people from parts of the world that have shitty situations and we use them. And they come here and they work at jobs we would never take. For you to tell these people that "life isn't easy" is a fucking joke. What would you or I know about not having an easy life? My lord. Our hard times is when we can't get a wifi signal on our cell phones. Talk to someone who came here as an immigrant in 50s or 60s who worked manual labout jobs and ask them what life was like for them.
