    Default Secession petitions filed in 20 states

    Petition for Texas to secede from US reaches threshold for White House response

    An online petition that calls for the State of Texas to withdraw from the U.S. and create its own government on Monday reached the required signature threshold to receive an official response from The White House.

    The petition on WhiteHouse.gov asks the Obama administration to "peacefully grant the State of Texas to withdraw from the United States of America and create its own new government." The petition had surpassed 34,000 signatures as of Monday evening. It was created by a person self-identified only as "Micah H." from Arlington, Texas.

    The petition cites the nation's economic woes as an issue and says that the condition of Texas' budget and economy make it "practically feasible for Texas to withdraw from the union."

    Online petitions on WhiteHouse.gov that get sufficient support are reviewed by White House staff and "sent to the appropriate policy experts." To be searchable on WhiteHouse.gov in the first place, petitions currently need to get 150 signatures within 30 days. To get an official response, petitions need 25,000 signatures within 30 days.

    Similar petitions from other states have also been filed including: Alabama, Arizona, Arkansas, Colorado, Florida, Georgia, Indiana, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, New Jersey, New York, North Carolina, North Dakota, Oklahoma, Pennsylvania, South Carolina and Tennessee. However, unlike the petition from Texas, none of these states had reached the 25,000-signature threshold to get an official White House response as of Monday evening.

    According to the Texas State Library and Archives Commission, a 1866 proclamation signed by then-President Andrew Johnson clearly spelled out that no state had the right to leave the union:

    "...It is the manifest determination of the American people that no State, of its own will, has a right or power to go out of or separate itself from, or be separated from the American Union; and that, therefore, each State ought to remain and constitute an integral part of the United States..."

    The flurry of petitions are likely just the consequence of voters unhappy with last week's presidential election results. University of Texas at Austin Assistant Professor Jason Casellas told NBC News that's likely the case in Texas, where 57 percent of the state population's vote went for Republican Mitt Romney.

    Catherine Frazier, press secretary for Texas Gov. Rick Perry, told NBC News Monday that the governor "believes in the greatness of our Union and nothing should be done to change it."

    "But he also shares the frustrations many Americans have with our federal government," Frazier said in a statement. "Now more than ever our country needs strong leadership from states like Texas, that are making tough decisions to live within their means, keep taxes low and provide opportunities to job creators so their citizens can provide for their families and prosper."

    Just my humble opinion, but there is a section of the Republican party that is really acting like a bunch of whiney bitches.

    You lost, get over it, move on.

    One of the weakest incumbent Presidents in modern history, and you guys (Republican leaders, not you voivod) actually managed to make him look like the answer, even though he has been part of the problem.

    If the current Republican party was in charge in 1984, Walter Mondale would have been President.

    Just wait until Texas is a blue state in about three election cycles, then it won't even be fucking close.

    Well all I know is if this country decides on civil war, I put my money on the conservatives with guns over the liberals with their Apple Products and biodegradable grocery sacks.

    Relax its a joke.

    I look at this two ways. One is "get a life and deal with it" however a part of me agrees with these people. I mean think about how our country has drifted off course the last 50 years. I know some love entitlements, government programs, etc but some think back romantically to a simpler age where government was out of our lives. When you see that people are too ignorant to even understand or grasp what is changing and vote based on party and skin color, well maybe it is a lost cause. Sorry but when 59 wards in Philly voted 100% for Obama with Romney not getting a single vote, something is seriously wrong. That is 19,000 to 0. Well people get fed up.

    Maybe if the Internet was around in 1860 or 1776, you would see something similar to the anger being displayed today. Maybe not. The only reason why any of this is in our history books is because enough people got pissed off and tried to do something about it. Maybe this is the start of something larger? Most likely it isn't but you never know.

    Default Justice Scalia shoots down secession.

    Last night, TheBlaze reported that residents of 27 states had filed petitions with the White House to be allowed to secede from the union. As of today, that number has swelled to 47.

    But could it actually happen? Do states even have a right to secede anymore? The answer, according to arguably the most respected conservative Justice of the United States Supreme Court, is an unequivocal “no.”

    Over at New York Personal Injury Attorney Blog, author Eric Turkewitz recounts an interesting story of how his brother, a screenwriter, managed to apparently coax an answer out of Scalia on precisely this topic:

    Dan is a screenwriter (whose screenplay Tranquility Base was just named a finalist at the Vail Film Festival, and previously took top honors elsewhere). Back in 2006 he started working on a political farce that had Maine seceding from the United States and joining Canada.[...]

    So, on a lark, he wrote to each of the 10 Supreme Court justices (including O’Connor) with this request:

    I’m a screenwriter in New York City, and am writing to see if you might be willing to assist me in a project that involves a unique constitutional issue. My latest screenplay is a comedy about Maine seceding from the United States and joining Canada. There are parts of the story that deal with the legality of such an event and, of course, a big showdown in the Supreme Court is part of the story.

    At the moment my story is a 12 page treatment. As an architect turned screenwriter, it is fair to say that I come up a bit short in the art of Supreme Court advocacy. If you could spare a few moments on a serious subject that is treated in a comedic way, I would greatly appreciate your thoughts. I’m sure you’ll find the story very entertaining

    I told Dan he was nuts. I told him his letter would be placed in the circular file. And then Scalia wrote back. Personally.

    And what did Justice Scalia say? Pretty much that not only could Maine not secede (ironically enough, Maine is one of the three states that has no secession petition on the White House website), but the question is so firmly settled that it could not even get a hearing before the Supreme Court, because the United States government would refuse to entertain it:

    I am afraid I cannot be of much help with your problem, principally because I cannot imagine that such a question could ever reach the Supreme Court. To begin with, the answer is clear. If there was any constitutional issue resolved by the Civil War, it is that there is no right to secede. (Hence, in the Pledge of Allegiance, “one Nation, indivisible.”) Secondly, I find it difficult to envision who the parties to this lawsuit might be. Is the State suing the United States for a declaratory judgment? But the United States cannot be sued without its consent, and it has not consented to this sort of suit.

    I am sure that poetic license can overcome all that — but you do not need legal advice for that. Good luck with your screenplay.
    So there you have it. No right to secede exists, and residents of those 47 states are just blowing smoke. Nevertheless, it says something that the topic seems to come up every time a polarizing president is reelected.
