Default British Hacker Not to be Extradited to the US

Just wondered what you guys thought of today's decision by the British Home-Secretary to prevent the extradition of a British man accused of hacking into US military computer systems.

Let me guess, those who were fighting his extradition are predominantly considered to be liberal huh?

Sounds like Mrs. May has it under control. I mean it's not like he was messing with our nuclear program. He was just looking for U.F.O.'s!

Not sure what you're getting at here..? Certainly those fighting his extradition were doing so on Human Rights grounds - does that make them 'liberal'? Or, in this case (I'd argue), compassionate and sensible?

Personally, I think it was the right decision not to extradite him. The man has Asperger's syndrome and the mental age of a child. As Van Fan says, he was looking for little green men not military secrets.

More worrying is how lacking in security the US systems were...If this man could access top-secret information from his home computer then that IS cause for concern!

I also think that the American officials up in arms over Ms May's decision are actually mortally embarrassed and trying to draw attention away from their own inadequacies with regard to protecting state secrets.

So if one who is "ill" but apparently intelligent enough to hack our system, commits a crime against the U.S. it's okay under the "Human Rights" banner to not face consequences? He's been fighting it for a decade too which leads me to believe he is actively participating in his defense.

what's the human rights issue? Are they threatening capital punishment in this case?

I suggest you do some research into Asperger's syndrome. (The film "Rain Man", whilst focusing on autism rather Asperger's, is actually quite an accurate depiction of this sort of syndrome). A sufferer can be frighteningly intelligent and yet have no concept as to the consequences of their actions.

From what I can gather, no, they were suggesting 60 years' imprisonment.

BTW, CC, if you read the article, you'll see that the man accused WILL still face "consequences" - he'll be subjected to trial in this country rather than the US, that's all.

Sorry, not buying the whole "'idiot savant" excuse. This right here says it all for me.

The home secretary's decision to block this extradition is extremely significant. She had an obligation under the Human Rights Act to take into account new evidence about Gary McKinnon's health.

    How convenient.

As I said, he will still face trial - just at the hands of a justice system which isn't trying to 'save face' - which, with the best will in the world, is what I (and countless others) believe the American authorities are trying to do in this instance.

interesting. We've had a few cases of Canada refusing to extradite but most had to do with capital punishment (which was abolished here decades ago).

I think that the British authorities had reason to believe that the man accused would be at very real risk of taking his own life (I think that that may be the "new evidence" to which CC referred).

And what will justice consist of in the UK? Probation and a few months of out patient therapy? I bet this guy doesn't spend one day in jail.

I see a larger problem in that I notice a lot of countries do not like to extradite their citizens accused of crimes to the U.S. They think our laws are draconian and it pisses me off. You may think 60 years is harsh but in reality he wouldn't have spent no more than a couple given his "mental faculties".

if a lot of your allies are refusing to extradite to your country then dare I say that maybe, just maybe, they aren't the problem.
