    Default M.A. Not Going After VAN HALEN For Songwriting Credit

    Former VAN HALEN bassist Michael Anthony says he's looking forward to hearing the band's new album because it includes material that he recorded with the group before they got signed in the 1970s.

    Speaking to the U.K. digital radio station Planet Rock, Anthony said, "They [the current lineup of VAN HALEN] played a show in New York the other week. There was [a] song they played called 'She's The Woman', which is actually a song that was, basically, written before I even joined VAN HALEN."

    During the same interview, Anthony said he has no plans to go after his former bandmates for songwriting credit on the reworked compositions on the new VAN HALEN album, "A Different Kind of Truth", despite their former policy of crediting all members equally. "I don't want to do anything," he said. "I just let it be." He added, "And, hey, it'll be nice to hear some of those old songs again that I haven't played in a long time."

    VAN HALEN lead singer David Lee Roth spoke with the Los Angeles Times about the making of "A Different Kind Of Truth". In a new interview, Roth admitted that the band has gone back into its archives to find previously unreleased material upon which to build the record. He explained, "It's material that Eddie [Van Halen, guitar] and I generated, literally, in 1975, 1976 and 1977. Usually fellas in our weight division will kind of gamely — or ironically, wink, wink — try to hail back to it (but) keep a safe, mature distance from it."

    "A Different Kind Of Truth" is due out February 7 and is Roth's first album with the band in 28 years.

    On the current condition of Eddie, who has been in and out of rehab over the years, lost a third of his tongue to cancer and had a hip replacement, Roth said, "He's doing really well. He's lucid, he's sober, he's playing. You know, I don't know if Ed has ever felt good. There's a thin line between rage and great work. He really never enjoyed his fame or success, and that might be part of what compels him."

    Roth also commented on the band members' turbulent past history, saying, "We accused each other of betrayal and thievery and lies and treachery, and it was all true. We were all guilty. Dig up the past, and it's going to get all over everybody. And, man, do we have a past..."

    VAN HALEN will begin a North American tour on February 18 in Louisville, Kentucky.

    The bigger question is COULD Mike go after them even if he wanted to?

    Mike may just be playing it off, but what exactly did he sign away for the '04 tour?

    He may have no recourse at all.

    I doubt he does, bass lines usually don't count. And even though they split everything four ways back then, I don't think they ever published them.

    By legal standards, I don't think the bass lines for any of these songs would constitute as being an integral part of the melody. He might have an argument for She's The Woman, but that's about it.

    But hell, Mike doesn't care, he's stinking rich anyway, with a great gig.

    I'm betting he couldn't go after them if these songs weren't published at the time. Whatever the answer, he's being classy about not even trying. Unless there's risk of calling into question the royalties he's earned and still receives for the songs that were published and recorded in the early years. In other words, laying claim to these "new" tunes could open a can of worms so to speak about the original publishing deal. I could be way off on this and am merely speculating but such disagreements are not uncommon in the world of publishing.

    Mike was never a songwriter, he will be the first to admit this.

    The best he could probably ever hope for getting in court is an arranging credit, but why bother?

    Mike's too cool a dude to be trivial like that.

    Yep, I agree. The band split songwriting credit four ways probably just to make everyone happy, regardless of who did or didn't write. Mike probably isn't going after them because he probably didn't write anything. Arranging credit...that's a songwriting credit, but like DD said above, Mike's too cool a dude to be trivial like that. I bet he'd rather make amends with the rest of Van Halen - not to join, but just to make peace and tie up loose ends - than give anyone in the band more reasons to dislike him, justified or not.

    The article gives the impression that he's somewhat keeping up with what the band is doing. He knew they played She's the Woman @ Cafe Wha. I really have a ton of respect for MA. Very professional musician, on and off stage.

    They had a 4 way split on publishing rights. This music wasn't published back then. I'm not an attorney but I think the royalties, etc are based on publishing rights. Old demos weren't published.

    Interestingly, my drummer works for Alfred publishing which has VH. He said their catalog is increasing sales with the new ablum coming out, tour and press...

    I think that in the end...Mike Anthony makes more money with this happening even if he isn't in the band.
