Default Are the brothers making money of Cabo Wabo?

Apologies if this has been discussed, but I recently reread the two chapters (19 & 20) from Red Storm Rising, and in chapter 19 Hagar discusses how he bought out everyone who had a stake in the cantina.

"Believe me," lamented the Red Rocker, "the papers I had to sign with the
brothers to get the club was a really shit deal for me. The terms were
unbelievable. For instance, if I ever made a penny selling it, I would
have to repay the band the money they wrote off on their taxes. Next, if
I ever brought the concept to the United States and tried to franchise
it, they would get fifty percent of the profits forever. That same deal
also extended to anything associated with the Cabo Wabo name. I had to
sign all these documents that stated in the event anyone got sued, I paid
all the costs. It even said in the contract that I could not let the
club interfere with the band. If Eddie and Al voted that it was not a
good time for me to travel to Cabo because they needed me, I couldn't go.
God's truth that fucking clause was in there. I had to agree to all
these conditions, otherwise there was no deal."

Did Hagar franchise it by bringing the Cabo Wabo to Lake Tahoe and Hawaii? Is this deal valid or did Hagar have a loophole of some kind? Just wondering if anyone has any insight into this.

The venues in the state are not called "Cabo Wabo" per se. That's probably the loophole. If they were still making money off of it, they'd be far friendlier towards Sam, me thinks. The "tattoo" incident described in the book wouldn't have happened.

I'd heard this stuff somewhere before, and I always wondered if that was the case, why Eddie had such a problem with Sam pimping cabo but then Ed would turn around and sell you anything he could stripe.

I assume this went down after the first split in 1996. Why the brothers would need Sam? Insight into the future train wreck of 2004? Who knows.

I thought I heard that part of the agreement for the 2004 tour was the brothers gave up their rights to any interest in US clubs.

I've always been curious as to what motives were really behind the 2004 tour. I suppose its always plausible that it really was an attempt to get the ship that is Van Halen uprighted, but after years of hearing what was done to get it off the ground, just more or less makes it sound like it was a means to an end. A. Gets Mikey cut off from the rest of the band for good, B. Sammy gets the sole rights to do with Cabo as he pleases and C. Gets the world aware of Wolfgang having talent. D. Most of all, tests the waters to see if Van Halen is even a feasible money maker after all those years of silence. I could be wrong, but in the world of Van Halen who knows.

This is what I heard as well. That's why all the CW have opened up in the States since 2004
    Cabo x 20
    Van Halen x 11
    Sammy x 20+
    DLR x 2

I've always suspected the '04 tour was all about tying up contractual loose ends, and seemingly fair redistribution between all camps. Then they might take a shot at being a band again. No fucking way in hell say I.

I thought Sammy bought out Dick and Dan's interests in the whole Cabo thing around '94, hence the friction that led to Sam's departure from the band in '96. The Bros thought the thing would go nowhere financially and were pissed after Sam bought them out, that the thing actually turned a major profit for Sam...but I could be wrong.

according to Sam's book, VH gave up rights to Cabo in exchange for Sam's rights to the VH logo. I think they kind of got screwed on that one.

Talk about a no brainer financially. It more likely they willingly grabbed their ankles. Opie and Andy have always been shrewd business men. Sam probably didn't even have to ask for that deal.
