    Default Student told to take U.S. Flag off his bike

    Apparently being patriotic is becoming a crime. I'd be outraged.


    DENAIR, Calif., Nov. 11 (UPI) -- Officials in a California school district said a middle school student was told to take a U.S. flag off his bike to avoid "racial tension."

    Denair Unified School District Superintendent Edward Parraz said Cody Alicea, 13, was told not to fly the U.S. flag from his bike while at Denair Middle School after complaints from other students, KCRA-TV, Sacramento, Calif., reported.

    "(The) First Amendment is important," Parraz said. "We want the kids to respect it, understand it, and with that comes a responsibility."

    Parraz said racial tensions boiled over at the school this year around the Cinco de Mayo holiday.

    "Our Hispanic, you know, kids will, you know, bring their Mexican flags and they'll display it, and then of course the kids would do the American flag situation, and it does cause kind of a racial tension which we don't really want," Parraz said. "We want them to appreciate the cultures."

    Alicea's parents said he flies the flag from his bike as a tribute to veterans in his family.

    "He's got that flag on his bike because he's proud of where he comes from," Alicea's father, Robert Kisner, said.

    Alicea folds up the flag and keeps it in his backpack while attend class, the TV station said.

    The First Amendment does not only cut one way.

    Just as the Mexican kids are free to fly whatever fucking flag they want too (though, I would kick their fucking illegal ass parents out of the country), the kids that are actually proud to live in this wonderful country have the right to fly the US flag as well.

    It is amazing to me that people that can't wait to get the fuck out of their own country and come here are treated better than people who were born and raised here.

    This is one issue that really gets my ire. And there is not a single politician in either party that has the backbone to do anything about it.

    Term limits my friends, get rid of career politicians, then and only then will people put country first over their party.

    Sorry for the rant, not into my second cup of coffee yet.

    i don't get that story at all. As a Canadian, one of the things that I am really jealous of in the States is how patriotic you all are. Flags flying at some many houses is a cool thing to see. I don't get why this kid would be told to stop being patriotic. Really stupid decision in my opinion.

    I know some people think extreme nationalism is a bad thing, and perhaps in some ways it is, but I would have to think the complete opposite is even worse. I don't even want to think about a country where no one cares. It shouldn't be a sin/crime/offense to be proud of the country you live in.

    1) I read the story three times and nary a mention of any Muslims. Never heard of any Muslims here in the US who felt offended by a US flag. Feel free to link me to a factual account of one.
    2) Seems to me the immediate problem here is a chickenshit superintendant who probably won't have his job for very long.
    3) I personally feel that I need to prove to NO ONE how American I am by flying a flag or not.....but anyone who feels the need to fly a US flag should feel free to do so. I mean, WTF?? It's America, last time I checked.

    Its unnerving how unpatriotic we are becoming. How many more years until independence day has no more meaning other than a day off of work? I have no problem with immigrants coming here and wanting to show their pride and admiration of their culture(Cinco De Mayo, Canada Day whatever)but don't come to me and tell me I can't be proud of mine, especially on a day like Veterans Day, or any other day for that matter. Political Correctness is a bad thing.

    The Supreme Court case of Tinker v. De Moines (1969) seems to be the most applicable as far as student speech goes. In it, the court found that students could wear black armbands to school to protest the Vietnam war. The decision says that schools would be able to restrict speech if it "would substantially interfere with the work of the school or impinge upon the rights of other students". Further, the school would need "evidence that it is necessary to avoid" this interference (http://scholar.google.com/scholar_ca...97139493194004). Maybe the guy thinks he does have it, but it does not sound like it to me.

    Besides, the CA educational code is actually more on the student's side than the court is:

    "(a) School districts operating one or more high schools ... shall not make or enforce a rule subjecting a high school pupil to disciplinary sanctions solely on the basis of conduct that is speech or other communication that, when engaged in outside of the campus, is protected from governmental restriction by the First Amendment ....

    (b) A pupil who is enrolled in a school at the time that the school has made or enforced a rule in violation of subdivision (a) may commence a civil action to obtain appropriate injunctive and declaratory relief as determined by the court. Upon motion, a court may award attorney’s fees to a prevailing plaintiff in a civil action pursuant to this section...."

    This is a supposedly educated Superintendent of a school district and the man can't speak intelligently?? What the hell does "the kids would do the American flag situation" mean??

    I want to ask if they banned the Hispanics in the school district from bring flags to school as well? Of course, this guy can't speak a complete sentence so getting an answer that you could understand would probably be futile but if this rule was put in place and everyone has to abide by it because it was like wearing gang colors to school then it might have some merit.

    A 13-year-old California boy who was told by school officials to remove a U.S. flag from his bike will once again be able to fly the Stars and Stripes as he rides on campus.

    Just before Veterans Day, officials at Denair Middle School told Cody Alicea to remove the American flag over concerns of his safety. The school cited complaints from other students. But on Friday, Superintendent Edward Parraz backtracked on that decision -- apparently in response to public outcry.

    The superintendent told a TV station that in its initial decision, the school was trying to avoid racial tensions stemming from an issue that arose when Hispanic students brought Mexican flags to school earlier this year (May 5) during an observance of "Cinco de Mayo." Liberty Counsel founder Mat Staver calls the school's reasoning "absurd."

    "This is the United States of America -- and this young boy has a right to be able to put a flag on the back of his bicycle," says Stave. "He wants to honor veterans, including his grandfather, who served in our country's military -- [and] he ought to be able to do that. The mere fear that someone might bring some kind of other flag as a hypothetical possibility is not a basis to censor, of all things, the United States Flag."

    Staver did send a letter to Superintendent Parraz, but tells OneNewsNow that it appears there is no need for further action.

    "Because it looks like now the school is going to be back-peddling a little bit," he explains. "We're just going to make sure that the school continues back-peddling and [that] this never happens again.

    "It shouldn't have ever happened to Cody in the first place -- and it shouldn't happen to anybody in the future."

    DENAIR, Calif. -- Controversy over the American flag is drawing hundreds of members of the American Legion Riders to Stanislaus County.

    They're coming to show support for the 13-year-old boy told he had to stop flying his flag at school.

    It's a story KCRA 3 broke last week that has gained international attention.

    Monday morning more than 500 members of the American Legion Riders will escort Cody Alicea to Denair Middle School. Beale Air Force Base said it will be sending planes to fly over Cody, and other are planning a flag walk in Alicea’s honor.

    “It’s nice that you know there is that many people on your side that stand behind you,” Alicea said.

    “Everyone is coming together tomorrow. I think the sleeping giant has been awoken and it’s about time,” said Robert Kisner, Alicea’s stepdad.

    “Cody is such a great boy. He is a great American, a great patriot,” said Bill Baker, a member of the American Legion Riders. “We want everybody in America to know they never have to be afraid to fly the American flag, ever.”

    Baker and the others rallied around Alicea after the Denair Unified School District told Alicea to take down the American flag waving atop his bicycle on campus.

    “I just wanted to support my country,” Alicea said.

    Kisner called KCRA 3 asking for help last week, and the story gained Alicea international support.

    Days later, Superintendent Ed Parraz apologized and told Alicea he could fly his flag once again.

    “He’s over whelmed and so am I. I can’t be more proud of him,” Kisner said.

    The superintendent said it initially told Alicea to take the flag down for his safety.

    Board members held an emergency meeting about the matter this afternoon and plan to further address the matter in another meeting later this week.
