    Default Connecticut woman wins $8 million cigarette lawsuit...

    A Norwich, CT woman who suffered from larynx cancer has been awarded $8 million in a lawsuit brought against the maker of Salem cigarettes, the first victory over a tobacco company in New England, her lawyer said.

    Barbara Izzarelli, 49, had her cancerous larynx removed in 1997 after smoking for about 25 years. She filed a suit in 1999, claiming the R.J. Reynolds Tobacco Co. made a dangerous and defective product, designed cigarettes to addict its users and acted with reckless disregard for the safety of consumers.



    On Wednesday, a federal court jury in Bridgeport agreed with her.

    Her lawyer, David S. Golub, of Stamford, called it a landmark case, the first smoker’s suit to come to trial in Connecticut.

    “This is a very significant disability,” Golub said. “And 95 percent of all larynx cancer is linked to smoking.”

    “There were times I never thought this was going to happen,” Izzarelli said Thursday. “I hope this is a lesson for tobacco companies.”

    Izzarelli, who has four children, must breathe through a tube in her throat. She cannot eat solid food or smell. She can function most ways, such as driving, shopping and other things, but cannot work.

    “I can’t go anywhere there could be chemicals or dust,” she said.

    Golub used R.J. Reynolds documents stating that the company needed to set nicotine levels in cigarettes in such a way as to “assure consumers for 25 years.” He also established that Reynolds marketed to young consumers.

    “Barbara Izzarelli was targeted by Reynolds when she was 12 years old with a product specifically designed to addict her,” Golub said in his closing argument.

    The jury set Izzarelli’s damages at more than $13 million, but assigned 58 percent of the guilt to the company and 42 percent to Izzarelli, reducing her total to $8 million.

    One of the key witnesses in the case was Dr. Thomas Lesnik, of Norwich, an ear, nose and throat surgeon.

    Lesnik could not be reached for comment Thursday.

    The Associated Press quoted an R.J. Reynolds spokesman as saying the company was disappointed and planned to appeal. Company spokesman David Howard could not be reached for comment Thursday.

    Still at issue is the amount of punitive damages, which could be as high as $16 million under federal law.

    Fucking no good comes from cigarettes. If there ever was a tool of the devil, it's cigarettes. There is not one beneficial thing about cigarette smoking from the smell to the pollution they cause.

    Hmmm. She had larynx cancer after smoking for 25 years.

    Seems to me that the cigarettes were not defective at all.

    I called some lawyers when my mother was dying of COPD in 2002. They all said I could not win.I only wanted money for the medical expenses and the nurses for her home care nothing else. She started smoking way before warning labels were put on the packs.

    we don't know that her parents condoned the behaviour. My sister smoked (though I don't think as early as 12) against our mom's (and I'm pretty sure our dad's) wishes. Maybe she should sue her "friends" who got her started and kept her going!

    then she should sue her friends too!

    my point was about accepting personal responsibility....I'm around the same age and at the age of 12 I knew that smoking was bad for you...it's not like it's just come to light in the last few years

    I'm thinking, once you put a cigarette in your mouth you can't sue anybody.

    Nobody forces you. Nobody tells you to do it. People can pressure you. People can influence you.

    But in the end it's your decision.


    People like this woman make me sick. She smokes for 25 years. Gets cancer and survives. And as if she doesn't feel lucky enough she feels she needs to get some money out of all this.

    It's funny how the people who are dying of lung cancer and know they are probably going to die, they don't complain about the tobacco companies. They don't bother suing. In the end they know that they made the decision to smoke. It's these shitheads that beat the cancer that feel like they are owed something.

    I don't know what's worse. The fact that this stupid woman sued or that the courts actually awarded her the money.

    Either way. If somebody in my family smoked and died of lung cancer, it would take every muscle and every bit of restraint in my body from smacking the shit out of people like this.
