    10 year old boy kidnapped ... authorities helped -- caught on video


    Child pleads not to be taken from school bus, but is taken by authorities and turned over to Jean Philippe Lacombe, 41

    Deputy constables, working under San Antonio Judge Casseb's court order, took Jean Paul Lacombe, 10, from a school bus stop on Oct. 16, 2009, and handed him to his father, Jean Philippe Lacombe, 41, who is now wanted on charges of kidnapping and aggravated perjury, both third-degree felonies, as well as a charge of interference with child custody.

    The Bexar County district attorney's office obtained felony arrest warrants Monday, December 14, 2009 for a man accused of using the civil court system to help abduct his 10-year-old son from the boy's mother, who had legal custody of him.

    Authorities say Lacombe presented incomplete and misleading Mexican court documents to state District Judge Sol Casseb on Oct. 15 stating that he had rightful custody to his son, Jean Paul. The boy had moved to San Antonio with his mother, Berenice Diaz.

    In reality, however, the Mexican court system had given Diaz custody in 2005 after he failed to follow the court's visitation orders, according to prosecutors.

    Jean Philippe Lacombe, 41 was scheduled to show up with the boy the following Monday for a subsequent court hearing, but he and his son haven't been seen since.

    It wasn't the first time Lacombe was accused of abducting his son.

    Soon after a Mexican court gave Diaz custody of Jean Paul, Lacombe took him to his native country, France, where they lived for two years. Diaz tracked them there and sought authorities' help in getting her son back. A French court in 2007 ordered the child be returned to her.

    A millionaire, Lacombe could have used his money to go anywhere with the boy, said Miguel Ortiz, a family law attorney who represents Diaz.

    The Bexar County district attorney's office said it began investigating the most recent abduction this month after the mother made a plea for help in a story published in the San Antonio Express-News.

    Prosecutors waited until Monday to ask for the warrants because they had to work with the Mexican court system to make sure they had all court documents pertinent to the custody case, Reed said.

    Prosecutors aren't sure where Lacombe is, but prosecutors already have been in contact with the FBI and the U.S. Marshals Service, Reed said.

    If convicted, Lacombe could face up to 10 years in prison.

    Miquel Ortiz, the lawyer for the boy's mother, Berenice Diaz, says they believe the boy is in danger and is also without his medication.

    "The child is on daily medication for emotional problems stemming from the first kidnapping and now he's not taking it. That's our main concern," said Ortiz. "He has also made claims that his father physically abuses him."

    Diaz' attorney Ortiz claims that Lacombe tricked the court by giving them a document in Spanish one that was actually a warrant for his arrest in Mexico and claimed it was proof that the mother was not to have custody of Jean Paul.

    "He told the court that the document said [the mother] was not supposed to have access to the child, but really the document was a warrant for his arrest," said Ortiz. "Because the document was in Spanish, the court didn't know what it said."

    Ortiz says District Court Judge Sol Casseb just "believed the papers" when he ruled in favor of Lacombe.

    Wow! I don't care about all the details...I just know that there is one very frightened boy on that bus and it rips my heart out to watch that.

    Assuming this is true, this woman is about to become quite a bit more liquid. First though, find that boy!

    If I'm understanding this right, this was in a San Antonio court? How could someone there not be able to translate a document that was in Spanish? It seems mind boggling. I hope the kid is found safe.

    I don't know what is more shocking...that this guy had the balls to hand a court officer a warrant for his arrest, claiming it was a custody ruling

    or that the court officer had the arrest warrant in hand and never bothered to have it translated into English...something that should have been easily accomplished pretty much anywhere in America
