    He has a full page ad in guitar world this month... I mean, it's cool if you play an EVH replica, or an EVH inspired striped guitar, but when you use such a blatant ripoff as your main promotional tool... geez. (This doesn't apply to VH cover band players )

    I mean, the guy puts pics of this guitar out there to see super obviously, and there is almost more emphasis on the guitar than his music.

    I think it's people like this who cause Ed and friends to get so pissed and start going after the immensely talented replica builders like the guys on here.

    3) The "music"...decent, but just a little too "Eastern Happiness" for me. My take: He wants to be the go-to guy for Bollywood's gay-porn soundtrack business, in a "gay" Vai sort of way.
    4) That whole "sanskrit English" font...you guessed it: gay.

    Even thought it is a variant of what looks to be a cross between the black and white Frankenstein and the red white and black versions, making it your main ax in publicity photos isn't very smart at all.... All I know is that it would probably be hard going up against Ed's high power lawyers, so why put yourself in that position if you can help it?

    On a side note, I thought you guys might enjoy taking a tour down EVH memory lane guitar wise.

    The pattern of the strips it nothing like Ed's so he has nothing to worry about, Ed could'nt do a thing about it. Ed has a copyright on VERY specific patterns, NOT the color Red-White and Black and any variation of taping you can do!..that would be ridiculous. does it LOOK like a EVH inspired guitar!..sure, is it a replica?..in my opinion no. So Ed's lawyer can try any crap they want, it's never gonna stick.

    You could be right, but I'm sure Ed's lawyers can apply enough pressure to make him crack, even if they don't really have a leg to stand on.

    You know, I'd like to know exactly what Ed has copyrighted - what the legal document actually says. To me, it sounds kind of abstract, like it could leave a lot of gray area. I wonder if it has subjective terms like, "bearing a resemblance to..."

    you can't copyright a "bearing resemblance" and things like that. it has to be DEAD ON specific.

    as to putting pressure on him, they can do that, but if he has a brain, he's already check with his record company's lawyer to check..and they surely to him Ed's lawyer don't have a case. AND..the guy's not in the US if i recall.

    So what, is there a clause that copyrights "a 2-in. cherry red and 1.5-in. white stripe at a 64 degree angle intersecting a 1.5-in. black stripe at a 14 degree angle?" That sounds ridiculous. On the other extreme, you can't copyright "anything that reminds anyone of anything Van Halen related."

    Basicaly from what i understand, in order to copyright his Frankenstrat for exemple, Ed has to proove he did or commission the work, document the guitar from every angle possible, then ask for a copyright on THIS model, and any other model would go trough the same process basicaly. so TECHNICALY..you could change a few strips on your EVH design and call it your own and ED would need to spend countless amount of $$$ to get you to stop it.

    I believe it reads something like "a pattern of criss-crossing and intersecting lines over a solid colored background" or something like that, but I can't find it at the moment.

    Right. Who's to say what counts as a "derivative" work? And maybe "distinctive" is a subjective term.

    I'm not a lawyer; I'm not going to pretend I know about this kind of thing.
