Default Van Halen discussion on NPRs "This American Life"

Didn't see this posted anywhere else. Its a podcast about the brown m+m story in depth. The story line has to do with contractual fine print.

I heard the story too. Pretty in depth VH content to lead into the topic. They said that the reason the brown M&M thing was put in there was to test if the people at the venue had read the rider. If there were brown M&Ms in the bowl, that meant they didn't read the contract and they had better recheck everything to make sure it was set up right. Maybe everyone already knew that, but it was new to me.

Yep, Roth went into great detail about this in his Crazy From The Heat autobiography in 1998. It's a very sound idea: Bury a line in the contract somewhere about no brown M&Ms in the candy bowl. Upon walking into the venue you discover some, then go ahead and line check every detail in the contract. This ensures that the venue's floor can physically support the stage, the electrical odds and ends are all sorted out and all other details are covered that if ignored, could lead to a crummy performance at best or catastrophe at worst.

I thought the consequences were the funny thing.

I had always heard, that if brown M&M's were found, the band could contractually cancel the gig, or trash the dressing room, their choice.

most of the arenas I know of hire caterers...so wouldn't this only insure that the caterer read the contract?

sure, if there are brown M&M's it would give you pause to wonder if your bottled water was at room temp or if there really were 4 types of cold cuts (not 3, not 5)

but I would hope that the same company doing the electrical, wouldn't be worrying about which imported beer was to be on ice and which was to be loaded into the busses

I think it's just indicative of their weird humor and their power to jerk a staff around, giving them the excuse to trash the backstage area.

i had always heard it was their way of seeing what they could get away with. That it was a joke on the staff who had to have some intern fish out the brown m&ms...not that it was some way of quickly assessing how well the local management read the contract....but hey, what do I know?

Whomever is in charge of the contract rider (the promoter for instance) overseas all things, be it the ashtrays, the sliced bologna or the concert stage. The chain of command makes this pragmatic, as all departments must be reviewed by and answer to the guy in charge. Where you work, the guy in charge of the vending machines is not the same guy in charge of the computer system, right?

I had ALWAYS heard, from the time it was ever first discussed, that it was to ensure the contract had been read in it's entirety. It was never in question as far as I knew. Dave even discusses it in an early interview (82' or 83'), might have been Letterman, the entire story behind the clause.

    I'll see if I can't find it......

evidently that is in fact the case, as Chef brought up that DLR talked about it at length in his book so I defer to both of you as well as DLR on this one.

Here's two Van Halen News Desk articles about the "no brown M&Ms" rule:

Wolfgang carries on Van Halenís ďNo brown M&MísĒ tradition
This one includes everything that DLR wrote about it in his book.

    Van Halenís Legendary M&Mís Rider
This one links to the actual tour rider.
