    Student sues over missing Xbox

    A Madeira man who is a student at Yale University claims in a lawsuit that US Airways stole a video game console from his luggage during a flight, and he wants $1 million in compensation.

    Jesse Maiman, 21, filed the suit Monday in Hamilton County Common Pleas Court.

    In it, he noted that he took a Dec. 17, 2008, flight from New Haven, Conn., to Cincinnati/Northern Kentucky International Airport. Included in his luggage for that trip was his Xbox 360, which had a specialized hard drive and components he said cost more than $1,000.

    When he picked up his luggage after landing, though, he noticed how light it was. He opened the bag, the suit noted, and he saw that everything was there except the video-game console and its accompanying components.

    He immediately went to a US Airways representative at the airport to report what he called a theft.

    What followed, his suit alleges, was weeks of "an unconscionable 'run-around' " that saw him write or speak to five airline employees who gave him what he considered to be nonresponsive answers.

    "This was an annoyance that they really hoped not to deal with," Maiman said.

    "That thing was my DVD player," Maiman, a junior film studies major, said. He was the 2006 Madeira High co-valedictorian.

    The suit seeks to have the airline pay him $1,700 for the loss of the gaming system and for "non-economic distress" of at least $25,000, but "in the maximum amount allowable by law or, in the alternative, in the sum of $1,000,000."

    A US Airways spokeswoman said the airline was unaware of the lawsuit.

    "We haven't been apprised of any lawsuit yet, but regardless of the figure in the complaint, there are federal loss limits applicable to all airlines on their liability for lost luggage and belongings, which are currently set at $3,300 per bag," Valerie Wunder, a US Airways spokesperson, said in an e-mail. "Further, our publicly available baggage policies specifically exclude liability for electronics checked in luggage."

    If this moron had put it in his carry-on, this wouldn't be an issue, and he would have saved the money it cost to check that bag. I mean...COME ON! Would you put your laptop computer in a checked bag? If the freakin Xbox was so important to you, keep it with you.
    The truly frightening part is this guy was admitted to one of the top schools in the country, yet has this little common sense?

    If I could play Devil's Advocate here:

    If the value was truly $1,000 (or there about), and he really was getting the runaround, I can see why there is a lawsuit. He is probably just "seeking" the maximum for effect and to get their attention.

    Think of it this way: If you had your custom built Frankie on the flight (takes about $1000 to build) and it suddenly turned up missing, you'd be pissed too. Then, if the airline isn't giving you any answers and refuses to handle the situation for which they are responsible, what other course of action could you pursue?

    I'm against frivolous lawsuits as much as anyone else, but just because it's a "video game player" doesn't make the true value worth any less. Don't pay any attention to the million dollars--he obviously won't get that, but if the airline is found to have not handled the situation properly resulting in lost goods, there could be some punitive damages awarded by the court--as provided by our legal system.

    If he had a $800 lawsuit, do you really think a) a lawyer would take the case and b) the airline would take it seriously?

    Chances are they settle out of court anyway, which is precisely what the kid wants anyway but they refuse to do.

    you're right but it would seem that a court should still kick this back to some sort of mediation or small claims or something...that and it's a damn shame that customer service is so piss poor that stuff like this has to come to a point where litigation is the only option.

    An Atlanta-area teen is suing her former school district for using a Facebook photo of her in a bikini as part of a student seminar on the importance of exercising caution when uploading photos to the web.



    Chelsea Chaney, now a college freshman, says the Fayette County Schools Director of Technology found the photo on her Facebook page, and used it in a district-wide Internet safety seminar to illustrate the maxim "once it's there, it's there to stay."

    Having apparently left the seminar hall before the director had a chance to explain the Streisand effect, Chaney decided to take her story to the local ABC affiliate WSB-TV, which proceeded to air a two-minute excuse to show Chaney in a bikini standing next to a cut-out of the artist formerly known as Snoop Dogg.

    "I was embarrassed. I was horrified," Chaney told Channel 2's Action News. "It never crossed my mind that this would ever, ever happen to me."

    Chaney's lawyer Pete Wellborn told the station he believes the director broke several laws, including "Federal law, state law, and violations of the United States Constitution."

    The district used the photo "out of context to suggest that Chelsea is a promiscuous, abuser of alcohol," the attorney said.

    Wellborn is helping Chaney sue the district for $2 million. Why so much? Because "she wants her claim to be taken seriously," according to Channel 2.

    A spokesman for the district said it was unlikely Chaney's case would hold up in court.

    Did you ever see the documentary about the lady and the McDonalds coffee? You know the case that became the catalyst for the whole "Frivolous Lawsuit" push. Interesting how some of the key facts of the case were, um overlooked/not reported by the media....things that make you go hmmm, indeed.

    Well said. I was shocked when I saw that movie. I genuinely felt bad for that old lady. The injuries were horific.
