Default Sharon Stone Loses Physical Custody of Son

I saw this when I clicked on a post voivod had put in the Valerie thread. Wow, what in the world did she do? I think you usually have to screw up pretty bad to lose permanent physical custody of your child especially when you're the mom.

"Exclusive Breaking News: "Entertainment Tonight" has obtained a court minute order confirming Sharon Stone has lost physical custody of her 8-year-old son Roan, despite her court pleas to change the arrangement.

According to court documents detailing a September 12, 2008 custody hearing, Phil Bronstein "shall have permanent sole physical custody of child. Court finds that Respondent (Sharon Stone) failed to meet her burden of proof and denies Respondent's (Sharon Stone's) request for modification of custody." The judge also notes this order is permanent unless there is a change of circumstances. However, all of Sharon's visitation, holiday and vacation rights remain unchanged.

This information from a September 12th minute order is a dramatic change from a custody order obtained by ET in October of 2007 that states Stone's ex, newspaper editor Phil Bronstein and the actress had "joint legal and physical custody" at that time.

Stone and Bronstein divorced in early 2004."

It isn't all that shocking in regard to the child's best interest. The October 2007 finding states that the parents had "joint legal and physical custody". Stone wanted to amend that to priority custody, yet failed to show that she was capable of maintaining a stable environment for the child and now the father has been awarded sole custody.

The child has not been totally taken away either, as a simple glance at the article reveals that "all of Sharon's visitation, holiday and vacation rights remain unchanged".

Having a court control when you can and cannot see your child is a bit different. Plus it's just visitation. That is way different from raising your child every day and seeing them all the time.

Can't imagine going through that with any of my kids.

Maybe he saw that one scene in "Basic Instinct" and cried out "don't make me go back there"!

Then before filing the petition she should have done a better job at proving her capabilities as a sole parent, and then provided the burden of proof the court required.

Exactly. I don't understand how she went from shared custody to losing all but visitation rights which would seem to indicate she isn't capable of taking care of her kid. I would think she would be able to afford adequate child care.

Definitely. She obviously wasn't responsible enough to provide her burden of proof before rendering its decision. Gotta agree with you there.

What about them? They had absolutely nothing to do with the case. This concerns the custody of the child she adopted with her former husband.

Yes, but if the mother is unfit to take care of one child what of the others who don't have a second parent to look out for them?

I think it's a pissing contest among parents regarding schools...

the judge denied Stone's request to have Roan attend school in Los Angeles, saying the child was to “permanently stay in San Francisco,” Singer added.

“The court order of 2007 provided that Roan was to go to school in San Francisco. Sharon went to court to try and modify the existing order...She wanted the court to modify the order so her child could go to school in Los Angeles. But the court felt that, for whatever reason, that she did not meet a burden to move him out of San Francisco during the school year.”

Stone filed court papers back in April seeking a change in the boy's primary residence.

Per a minute order filed Sept. 12 and obtained by E! News, a judge determined that Bronstein, a former editor of the San Francisco Chronicle, "provide a more structured continuity, stable, secure and consistent home that...Roan needs." (View the document.)

If Stone relocates to San Francisco, where Bronstein and now Roan reside, or if Bronstein moves away from the Bay Area, the order can be revisited.

Pointing out a line in the order reading that there is to be no change in Stone's "custody, visitation, holiday and vacation schedule," Singer emphasized that the Basic Instinct star had "not lost any iota of custody or visitation that she had before."

“She thought it was best at this young age that she had these two younger children to have her older son be with them and the court didn’t want to modify the order. She loves her son and felt it would be better to have her child in Los Angeles.”

Well that is certainly different than what was stated by the first article which stated she lost physical custody. Why am I not surprised that the wording was such as to create a sensation rather than explain what happened which is basically nothing.

Sharon Stone has so overreacted to her 8-year-old son's health issues that she suggested he get a Botox treatment for his smelly feet, according to the judge in the actress's custody case.

In Superior Court papers, the judge also said Stone "delegates many of her parenting responsibilities to third parties" and has "simply refused" to participate in counseling unless her "schedule is accommodated and her demands are met."

"Such conduct on the part of any parent ... is unacceptable and does not serve the child's best interest," the San Francisco judge writes in the document, which is a tentative statement on Stone's motion to modify custody.

The judge has turned down Stone's request to move her son Roan to Los Angeles, where she lives, from his father Phil Bronstein's home in San Francisco. The actress is allowed visitation time with the child, getting some weekends and holidays.

Saying that Stone is "unable to provide the structure, continuity and reliability that Roan needs, and candidly, deserves," the judge cited examples of Stone's overreactions, including her incorrect belief her son was suffering a spinal illness and her suggestion of using Botox for foot odor.

According to the papers, "As Father appropriately noted, the simple and common sense approach of making sure Roan wore socks with his shoes and used foot deodorant corrected."

    Stone's representatives declined to comment.

Bronstein, 57, and Stone, 50, married in 1998. They adopted Roan in 2000 and divorced in 2004.
