Default Lawyers Solicit Mother At Son's Casket

Think these guys are gonna get bombarded with hate mail this week?

Mother: Lawyers Solicited At Son's Casket

WARWICK, R.I. -- The mother of a teen killed by a drunken driver said two lawyers came to her son's wake and tried to sell their services while standing next to his casket.

Kathleen Gemma filed a complaint with the Supreme Court's attorney disciplinary board, saying the two should have left her alone while she was saying her last goodbyes to her son Anthony Gemma.

Gemma said one of the lawyers talked about his billboard.

Robert D'Amico and Jimmy Burchfield said they were not soliciting business. They said they were there to support the boy's father and that Gemma brought up the idea of pursuing legal action, something she denied.

Gemma said she and the boy's father, Steven Ricci, never married.

So far it looks like the good old "hit and run" media we are used to. There are more questions than answers so far:

-They say they were there to support the father. Did they know the father personally? If so, this story just took one big hit.
-So far it's a "he said she said." I hate lawyers as much as the next person, but I know from experience grieving mothers are certainly not in their right frame of mind at their child's wake, and sometimes drugged. She may not have realized she brought up legal action.
-Who else saw what happened? There are usually other people at wakes.
-Maybe the father (if he knew the lawyers) asked them to talk to her about action? Not that it makes it that much better, but a little.

Of course, they may have just been going after a quick buck like most lawyers. But I'll bet that if the lawyers are right, you won't hear about this again.

We have no idea what really happened but I think most will be inclined to believe the woman. You've got a woman who just lost her son and two lawyers at the wake dropping a sales pitch on her. Gonna be tough to save face on this one, innocent or not.

The father (or anyone else there) could have introduced them, she may have mentioned she was looking to take action and they told her, or maybe she recognized at least the one from the billboard.

GOOGLE SEARCH: A google search shows both lawyers are partners from the same law firm. The article makes it seem as though they may have been competitors (that's how I read it). Therefore, I am starting to be more inclined to believe the lawyers.

Why would TWO lawyers (partners no less) from the same firm rush to a wake to solicit a lawsuit? Doesn't happen much. They can send the little dogs to do that. The father probably was close to both and they wanted to pay their respects and the mother probably took something the wrong way. From the article, it does not seem like the parents are together anymore, so maybe she didn't realize they were there for the father.

Like I said before, lawyers are generally scum, but grieving mothers are usually not in a rational state of mind. I'll wait for the full story and some witnesses.

if the father was close to both why would the mother have filed a complaint? At the very best, their timing is pathetic. If they were a friend of the father I imagine they could have made a call at some point at not bothered her then.

One other possibility: maybe the father wanted to take action and invited them for business reasons. This story is the same poorly-written garbage indicative of the drive-by media today.

I think I covered that when I said it seemed as though they were not together. Maybe they hate each other? Who knows?

Again, you are dismissing their claim that SHE talked about a lawsuit. I refuse to rush to judgment.

you might be right about the writing but the story (any way you write it) doesn't speak well for the profession.

If I read this correctly ("the profession" meaning attornies), that's correct. I think that was the writer's point: to throw out an accusation without any of the facts yet gathered because what they had made for a "good" (read: emotional) story. The media can't wait to get stories out there, and many times after the dust settles, there is no story. This may be just that, and I would hate to see an innocent person convicted by the court of public opinion for no reason.

And again, this just could be a case of filthy lawyers. I'm just not buying it...yet.

sadly being judged by the public before a trial is part of life nowadays. But even if I give the lawyers here every benefit of the doubt the story still stinks a little.

That said, I don't think it's news worthy. Too many reporters + too few real stories = this crap.

I disagree with you here about this particular story. It's pretty straightforward the way it's written. It's written by the AP and offers no commentary, just what the mother says happened and what the lawyers say happened.

I don't have time to look right now but if you google something like the Providence Journal today there might be follow up articles with more details and opinions.

After I read the story I was thinking the exact same thing, LL. Damn you for beating me to it.

Hearse-chasing lawyers don't seem as aggressive in nature as the ambulance-chasing lawyers are. There may have been a little procrastination going on there.
