    Default New Bohemians band member shot dead

    DALLAS, Texas (AP) -- Jeffrey Carter Albrecht, a keyboard player for the band Edie Brickell & New Bohemians, was shot to death early Monday while trying to kick in the door of his girlfriend's neighbor, police said.

    The neighbor, who was not immediately identified, was asleep in bed when he woke up around 4 a.m. to his wife screaming that someone was breaking into the house, according to a police report. The neighbor yelled through the door for Albrecht to leave and then fired his handgun through the door.

    Albrecht was shot in the head and died at the scene, police said.

    The neighbor believed a burglar was trying to break in and fired a shot through the door around 4 a.m., Dallas police spokesman Sgt. Gil Cerda said. The case is under investigation and no arrests have been made.

    News reports cited police saying Albrecht beat up his girlfriend and then tried to kick down the neighbor's door in a drunken rage. The couple had no history of domestic violence, but the girlfriend had bruises on her face, police said. She did not suffer serious injury.

    Albrecht apparently struck his girlfriend in the face several times and hit her in the back once she fell. She later managed to lock him out of the house, according to the reports.

    "He was at his girlfriend's house last night," said Danny Balis, Albrecht's roommate. "He left the house and went next door and -- for whatever reason, which we don't know -- he knocked on the neighbor's door. And from what I understand, he was persistent. I don't know if there was a verbal exchange, but the person panicked and fired a shot through the door."

    The death of Albrecht, who also played keyboard and guitar and sang in the Dallas rock band Sorta with Balis, stunned friends and those who knew him in the North Texas music community.

    "He is not a violent person," said Carrie Garcia, Sorta's manager. "He is cool as a cucumber, shy, always wanted to make a joke in a situation that may be a little tense."

    Albrecht, who went by his middle name, had been with the New Bohemians since 1999, according to the band's Web site. Albrecht played several times with Brickell's husband, Paul Simon, Garcia said. He also played with Texas musician Charlie Sexton, a renowned guitarist.

    Albrecht was working on a solo album that Balis called "the best thing he has ever done."

    "He was the best musician I've ever played with -- no question," Balis said. "He could play anything. It's a shame not enough people outside of Dallas heard him."

    When this came out, one of my friends came up with the more than apt description of "nerd hippies". Having joined the band in 1999, the deceased was not featured in this video.

    I've seen people pull this sort of shit after some hard drinking as well, especially Tequila or Whiskey.

    He would have been on the receiving end of the same sort of thing if he had tried to break into my house at 4 am.

    DALLAS - The shooting death of a member of Edie Brickell & New Bohemians appears to fall under state law permitting deadly force in self-defense, police said Tuesday.

    A grand jury will decide whether the man who shot Jeffrey Carter Albrecht will be indicted, but Sgt. Larry Lewis said Dallas police aren't pursuing charges.

    Police said Albrecht, 34, was inebriated and had been fighting with his girlfriend Monday before he was shot by a neighbor of the girlfriend.

    The neighbor, who was not immediately identified, woke up around 4 a.m. to his wife screaming that someone was breaking into the house, police said. The neighbor yelled through the door for Albrecht to leave and then fired his handgun through the door, hitting Albrecht in the head.

    "He yelled several verbal warnings, 'I'll shoot! I'll shoot!'," Lewis said. "From what we gather, he fired near the top of the door, hoping he would scare the person away."

    The homeowner, whose identity wasn't released, was not arrested.

    The shooting came two days after the enactment of a new state law, nicknamed the "Castle Doctrine," that gives Texans a stronger legal right to defend themselves with deadly force in their homes, cars and workplaces. Police and prosecutors, however, said the shooter appeared to be protected under an earlier law that allows a person to protect their property with deadly force to "prevent the other's imminent commission ... of criminal mischief during the nighttime."

    "In an incident like that you're well within your rights under the old law, as well as the new one, to use deadly force," Dallas District Attorney Craig Watkins said.

    Albrecht, who went by his middle name, had been a keyboard player for New Bohemians since 1999, according to the band's Web site. His death stunned friends and those who knew him in the North Texas music community.

    "I am heart broken," Edie Brickell wrote in an e-mail to The Associated Press on Tuesday.

    "We are all completely devastated by the news of Carter's death, and obviously still quite in shock," Brandon Aly, drummer for New Bohemians, wrote in another e-mail.

    Albrecht played several times with Brickell's husband, Paul Simon. He also played with Texas musician Charlie Sexton, a renowned guitarist.

    He also played keyboard and guitar and sang for Sorta, named in 2006 as the best local music act by the Dallas Observer.

    Edie Brickell & New Bohemians scored a breakout hit in 1989 with "What I Am." They broke up for several years but regrouped and put out an album last year.
