    Default Rape allegations rock Villanova University

    As Action News exclusively reported at noon, sources confirm three Villanova University freshman football players are being investigated in connection with the alleged rape of a female student at the school.

    Records obtained by Action News show the girl reported the attack happened on campus between July 14th at 9:30 p.m. and July 15th at 1 a.m.

    She notified campus police on July 15th at 8:38 p.m.

    The university has started an internal investigation.

    It's unclear at this time if outside authorities are participating in the probe.

    Villanova officials are expected to make a statement on the allegations late this afternoon.

    One would hope some lessons were taken to heart via the Duke case. A methodical, rational approach is needed here, not a rush to judgement.

    Charges will not be filed against the alleged perpetrators in the Villanova rape case at this time because the accuser does not want to pursue the case, police said.

    A female student at the university reported that three incoming football players had forcibly raped her on July 14. The incident was reported to Villanova's Public Safety Department on July 15.
    Radnor Township Police released a statement on the investigation on Thursday. According to the statement, the victim during the course of an interview with police "made it clear that at this time she is not interested in the Radnor Police Department continuing any investigation in the pursuit of charges."

    Radnor Police Superintendent John Rutty said, "We respect the victim's right to make an informed, conscious decision as to their continued involvement."

    Rutty said that the victim can change her mind in the future, so the investigation will remain open.

    The announcement comes a day after Villanova University decided to rescind the admission of three men who had been scheduled to join the football team this fall.

    "After the initial investigation, the individuals in question were asked to leave our campus," said Villanova spokesperson Liz Walsh. "At Villanova, we take this incident very seriously.

    "This incident involves individuals who are known to each other. Based on that and all other facts we gathered, there is not a continuing threat to other students or to the employees here on the Villanova campus," said Walsh.

    The three players were asked to leave campus last Friday, and the university decided to kick the students out of school after an investigation.

    They were enrolled for one summer class, Walsh said.

    "Our primary concern has been the welfare of our students and particularly the students who have been involved in this situation," Villanova athletic director Vince Nicastro said. "We've tried to move forward with a great deal of respect for them and we trust that everyone else will do that as well."


    News of the allegations surprised students on campus taking classes this summer.

    "As a girl and not from the area, it does scare me because I would hope to feel safe on a campus like this," said Samantha Smerconish.

    "These are serious allegations and I think there should be investigation. I don't want to slap the guilty label on anyone right now, not before finding out all of the facts," said another student, Tony Maalouf.

    The university did post on its crime log that a student reported a sexual assault, something that is required by law.

    Villanova rescinded the admissions of three freshman football players last night after Radnor Township police said they were investigating the alleged sexual assault of a female student on the Main Line campus.
    "It was a report of forcible rape," university spokeswoman Liz Kennedy Walsh said.

    The incident happened between 9:30 p.m. July 14 and 1 a.m. July 15, according to the daily log recorded by the university's department of public safety. Head football coach Andy Talley and athletic director Vince Nicastro said they were not informed of the situation until July 18, when the players were questioned by the department and gave statements.

    "After they made their statements, and apparently other students had made statements as well, I was then informed about where [the investigation] was and the nature of the incident, and that it was some concern to the university," Nicastro said in Baltimore, where he was attending Colonial Athletic Association's football media day.

    The players, none of whom Nicastro or Talley identified, citing privacy regulations, were told to be out of their rooms by 6 p.m. Friday. University officials decided yesterday to remove the three players from school.

    "After a thorough investigation, the decision has been made to rescind their admission, which means these young men will not be a part of the Villanova community moving forward," Walsh said.

    "There's a code of conduct," she said. "Believe this: Student admissions get rescinded all the time. Students' admissions can get rescinded if they have a tough academic fourth quarter. This is not an unheard-of process. It states very clearly in the application that every applicant signs that every violation of the university code of conduct can result in the [rescinding] of your admission. . . . There was certainly behavior that was in violation of it."

    Radnor Township police released a brief statement that said the department "is investigating an alleged sexual assault at Villanova University."

    John L. Rutty, the township's superintendent of police, said in the statement that he would not comment on specifics because the investigation was continuing.

    The alleged victim was not associated with the football team, university officials said.

    Walsh said the university followed its policy in dealing with the woman.

    "We met with the young woman, counseled her, and discussed all of her available options, including reporting this incident to police," Walsh said, reading the university statement. "Ultimately, it's the student's decision whether or not to notify authorities, and Villanova's policy is not to do so without the consent of the student."

    The alleged victim has not gone to the police, Walsh said.

    Alison Kiss, program director for Security on Campus, a school watchdog group based in King of Prussia that focuses on crime, criticized the university for not issuing a statement for more than a week after the alleged incident occurred.

    She said the 1992 Clery Act requires all schools that receive federal funds to report campus crime in a timely manner if there is "a current or ongoing threat."

    In the university statement, Walsh said the incident was reported immediately. She also said the individuals involved were "known to each other, and based on this and all the facts gathered, it was determined that there was not a continued threat to other students and employees at Villanova."

    Talley, who is entering his 23d year as Villanova's coach, twice met with the three players after hearing of the incident, which he called "tremendously upsetting."

    "This is something that requires a lot of back-and-forth - privacy issues and the safety of the students involved," said Talley, who also was in Baltimore. "But for me and our coaching staff and our program, this particular situation is very disappointing. I'm hoping that everyone will come out of this in a safe and private way and that the process will be fair in due course."

    Talley met with the football team Monday to inform his players about what had happened and to discuss reports and rumors. The coach said the three incoming freshman players attended a summer course for about two weeks and stayed at the university.

    "They were taking classes," Talley said. "Although they were scholarship athletes, they paid for their room and board, and their tuition. So this three-credit course that they were taking was funded by their families."

    The sexual-assault allegation marked the second time in recent years that an athletic program at a Philadelphia-area school had been rocked by a serious campus incident. Three La Salle basketball players were charged in two rapes in 2003 and 2004, but the charges against one were thrown out, and a jury acquitted the two others.
