Default Iowa Woman Sues Wal-Mart Over Fall in Puddle of Vomit

Almost two years later? How $5000 will cover "a number" of surgeries, disability, and legal fees?

Suit seeks $5,000 in damages from Wal-Mart over vomit incident

First came a puddle of vomit and a fall, then a classified advertisement and now a lawsuit against Wal-Mart.

June and James Medema of Blue Grass, Iowa, filed the suit May 22 in Scott County District Court, alleging that negligence led to June Medema suffering severe personal and permanent injuries in a June 13, 2005, fall at the Wal-Mart SuperCenter on West Kimberly Road in Davenport. The couple is asking for at least $5,000 in damages, according to the suit.

The suit does not make any specific allegations stating how the store was negligent in the incident.

John Simley, a spokesman for Wal-Mart, declined comment Tuesday.

“We haven’t seen the suit and we can’t comment on something we haven’t seen,” he said.

In mid-March, the Medemas’ attorney, Michael K. Bush of Davenport, ran a Quad-City Times classified advertisement looking for witnesses to the incident. At the time, he thought two other people also had slipped and fallen because of the puddle, but he received no responses to the advertisement.

June Medema suffered serious neck and upper back injuries from the fall, has undergone a number of surgeries and is disabled from work, Bush said in March.

Bush was unavailable for comment Tuesday.

Give me a freaking break. If this had any merit what so ever, she would be suing for a lot more then $5000 to cover medical expenses.

$5000 won't even cover the lawyer fees.

Same thing happened to me but they wouldn't allow my lawsuit to go forward. It had something to do with it being my own vomit, or so I was told.

That's splitting hairs if you ask me.

Seasonally here in South Florida, we have these characters known as "gypsies" that are well practiced at the "old slip and fall" routine. They usually demand around 2-3 grand to go away.

In one evening a few years ago, they hit seven stores on a stretch of Federal Highway (my store included). Believe it or not, most stores paid, in order to avoid further hassle (including bad publicity).

Needy folk as well, yet not these pricks. The fact is, these "slip and fall" artists are members of well organised outfits that travel the country, usually several feet ahead of the law. They are grifters and con artists, consisting of several families gathered as a tribe or clan.

And they rarely rat on each other when caught. Thusly they are quiet difficult to infilltrate and bring to justice. They also can make life miserable for the honest merchants that stand up to their form of extortion.

It's truly easier to give them a few bucks and send them on their collective way.

You're right. It just baffles me how people like that can have a clear conscious. I think most peoples' guilt would eat them alive. It would drive me crazy.

It probably is easier to give them a few bucks and send them on their way, but maybe if the law would start cracking down on it and make an example, things like this would cut down. It makes me absolutely disgusted!

Don't focus on the amount. The lawsuit asks for "at least" $5,000. This is likely a pleading requirement under Iowa law, i.e., in order for this particular court to have jurisdiction, the amount in controversy must be at least 5k. The claim will almost certainly be for far more than that.
