Default RIAA Says Ripping CDs to Your iPod is NOT Fair Use

RIAA Says Ripping CDs to Your iPod is NOT Fair Use
    February 15, 2006

It is no secret that the entertainment oligopolists are not happy about space-shifting and format-shifting. But surely ripping your own CDs to your own iPod passes muster, right? In fact, didn't they admit as much in front of the Supreme Court during the MGM v. Grokster argument last year?

    Apparently not.

As part of the on-going DMCA rule-making proceedings, the RIAA and other copyright industry associations submitted a filing that included this gem as part of their argument that space-shifting and format-shifting do not count as noninfringing uses, even when you are talking about making copies of your own CDs:

"Nor does the fact that permission to make a copy in particular circumstances is often or even routinely granted, necessarily establish that the copying is a fair use when the copyright owner withholds that authorization. In this regard, the statement attributed to counsel for copyright owners in the MGM v. Grokster case is simply a statement about authorization, not about fair use."

For those who may not remember, here's what Don Verrilli said to the Supreme Court last year:

"The record companies, my clients, have said, for some time now, and it's been on their website for some time now, that it's perfectly lawful to take a CD that you've purchased, upload it onto your computer, put it onto your iPod."

If I understand what the RIAA is saying, "perfectly lawful" means "lawful until we change our mind." So your ability to continue to make copies of your own CDs on your own iPod is entirely a matter of their sufferance. What about all the indie label CDs? Do you have to ask each of them for permission before ripping your CDs? And what about all the major label artists who control their own copyrights? Do we all need to ask them, as well?

P.S.: The same filing also had this to say: "Similarly, creating a back-up copy of a music CD is not a non-infringing use...."

Sure, I'll buy the album off of itunes and a hard copy from Tower Records so I have a copy for my car. Yeah, that makes perfect sense.
There is a shift taking place in the way people purchase media. Wake up!

RIAA Nazis can kiss my fucking ass.

If I pay for a CD, it is MINE.

If I want to rip the entire thing to my hard drive, an I-POD, or anything else, tough shit. I own it.

If I want to make mix CD's with songs from this and any other number of CD's and take them on a road trip, it is my right, as I own all of them.

If I want to use Van Hagar CD's for skeet shooting, tough shit. I paid for em (I plead temporary insanity)

If the RIAA wants to tell me that I don't own the thousands of CD's in my collection, then they better be writing me a big check right now

This clearly demonstrates the inane greed that is rampant in the industry.
It is this reason that i continue to visit "alternative" ways of gettting music.
Ive bought most of the music i have at least twice..from cassette to Cd, and lots of it 3 times.
This makes me feel even more defiant. Greed killed the radio star, not video!

I wonder what the RIAA thinks is a fair lifetime amount of $ that ea individual should have to spend on music? $1,000? $10,000?...more?
At what point has an individual demonstrated that they are not trying to rip food from the mouths of artists and are justified in using the product they have bought in any way they deem enjoyable?
Once you buy "Fair Warning" 3 different ways, you should have the right to download it from the internet for free and do what you please with it.

    Default faaahgettta about it

I'd love to see them try and stop us from using the music we purchased.

Whatever they try to do to stop it, someone will figure out how to hack it.

These guys should focus more on releasing GOOD MUSIC that would cause a person to actually PAY for it.

The RIAA can suck my dick. Soon they're gonna force us to cough up $12 for a new released single disc, and they're gonna prevent us from listening to it.

Im currently adding Genesis onto my online musical library. Just one of the 180 artists i have on this thing. Abacab is just one of the 800 albums i own.

Um, soon they're gonna charge you $12 just to mention the name Genesis in public.

So .....this post will cost you $24 plus tax. How would you like to pay for this, sir?
