    Default Judge Allows Refunds On 'Explicit' Evanescence Album

    ----Parents suing because they want Wal-Mart to do the parents' job----

    A Washington County Circuit Court judge has ruled that people who bought an Evanescence live album at Wal-Mart stores in Maryland can get refunds for it, according to Billboard.com. Last Wednesday's (August 10) ruling partially settles a lawsuit brought by a Maryland couple, who complained that the copy of the record they bought included explicit lyrics but did not carry a parental warning sticker. The album, called Anywhere But Home, was released in November of 2004.

    Evanescence's label, Wind-Up Records, agreed to the refunds in exchange for having the claims against them dismissed. Anyone seeking a refund must show proof that they bought the album in a Maryland Wal-Mart outlet and that it was purchased before January 1, 2005.

    The couple, Trevin and Melanie Skeens, is still suing Wal-Mart for allegedly deceiving customers by selling the disc without a warning sticker.

    I have that CD/DVD set from Wal-Mart and but the DVD special features section is all beeped out. I didn't notice any "explicit" material on the actual concert, which is the same show as the CD.

    I think somewhere they say "gosh darnit" and "jeepers" in the song. And if they play it backwards it says "GET A LIFE YOU SCHMUCK!"

    Frankly I am offended...at the people who are SUING! How much are the suing for? And are they putting it towards their next book burning party?

    Who are these people Mr. and Mrs. Cleaver???

    Because, in today's fast paced world, if you can't trust Wal-Mart to raise your kids, you can you trust?

    Wal-Mart, the retail industry’s leader in marketing family-friendly entertainment, is not 100 percent in catching obscenities in the materials it sells.

    A Maryland couple has filed a lawsuit against the retailing giant because it is selling the new Evanescence live CD/DVD that contains profanity. The disc contains no Parental Advisory label on the outside packaging to alert parents to objectionable lyrics. If it did, Wal-Mart corporate policy prevents its sale in Wal-Mart stores.

    The lawsuit also names Evanescence’s label Wind-Up Records and distributor BMG Entertainment.

    Trevin and Melanie Skeens of Brownsville, Maryland, purchased the DVD as a birthday gift for their 13-year-old daughter and listened to the disc in the car. What they heard was the group’s rendition of the song Thoughtless, which contained the lyric “What the f*** you think it’s doing to me?” in the chorus.

    The Skeens were shocked since the free downloadable clip of that song on Wal-Mart.com had been edited to remove the obscenity.

    So, the Skeens filed a complaint in Washington County Circuit Court last month, asking Wal-Mart to remove the CD from the shelves of its Maryland stores or sell only edited versions.

    “I don’t want any other families to get this, expecting it to be clean,” Trevin Skeens told the Herald-Mail of Hagerstown, Maryland. “It needs to be removed from the shelves to prevent other children from hearing it.”

    Wal-Mart, historically known for taking customer complaints seriously, said it had no plans to remove the CD from store shelves.

    “While Wal-Mart sets high standards, it would not be possible to eliminate every image, word or topic that an individual might find objectionable,” Wal-Mart spokesman Guy Whitcomb told the Herald-Mail. He added that the company is investigating the matter.

    When asked to explain how the CD remained for sale even after the company had to edit the song for use on its Web site, Whitcomb said that the song sample was taken by Walmart.com, a separate division of Wal-Mart.

    Because Wal-Mart refuses to market adult materials, it has single-handedly forced record companies to produce cleaned-up versions of the music they offer if those companies wish to reach Wal-Mart customers.

    “Customers have come to count on Wal-Mart as an extra line of defense when protecting their children from corrupting media influences,” said Robert Knight, director of Concerned Women for America’s Culture & Family Institute. “But clearly, this is a line of protection parents can no longer count on.”

    “While we would expect such CDs to slip onto Wal-Mart’s shelves because record labels and distributors neglect adding the Parental Advisory label, either intentionally or unintentionally, we remain disappointed with the indifferent response of the Wal-Mart spokesman.

    “We encourage Wal-Mart to take this issue seriously, and remove the CD from its shelves nationwide until an edited version is made available,” he added. “And at the very least to remove the edited song sample from its Web site that implies that Wal-Mart is marketing a cleaned-up version of the song.”

    The Skeens are seeking an order requiring Wal-Mart to either censure or remove the music from its Maryland stores. It also seeks damages of up to $74,500 for each of the thousands of people who bought the music at Wal-Mart stores in Maryland.
