    Prosecutor: 3 Charged With Aruba Murder

    ORANJESTAD, Aruba -- Three young men detained in the disappearance of an Alabama teenager have been charged with murder since their arrest more than three weeks ago, Aruba's chief prosecutor told The Associated Press on Friday.

    The charges were not announced at the time to protect the feelings of the family of 18-year-old Natalee Holloway, said Attorney General Karin Janssen.

    "At the time, we didn't want to upset the (Holloway) family talking about murder while they searched," Janssen said.

    Janssen, who has said several times in the past three weeks that no one was charged in the case, said they also kept the information quiet in order not to compromise their investigation. Authorities have said they have no physical evidence suggesting Holloway is dead.

    Janssen said 17-year-old Joran van der Sloot, 17, and two Surinamese brothers who are his friends have been charged since their arrest _ 10 days after Holloway disappeared on May 30.

    Also Friday, Aruba's government defended its handling of the investigation, saying many of the criticisms arose from misunderstandings of the Dutch legal system used on the Caribbean island.

    Police have been criticized for letting more than a week go by without detaining the three young men last seen with Holloway and for waiting 16 days after she went missing before searching van der Sloot's home.

    Ruben Trapenberg, spokesman for Prime Minister Nelson Oduber, said the government has put 21 detectives on the case.

    Trapenberg also mentioned the 70 Dutch Marines on the island who helped in initial searches and were called back Thursday to comb the island again.

    "They do not bungle cases," Trapenberg told The Associated Press. "Aruban police and prosecutors are professional forces that have been successful."

    Prosecutors have an 89 percent conviction rate on the Dutch Caribbean island, he said. Violent crime is rare in the tourist haven.

    Asked why two of three suspects were transported together, apparently giving them the opportunity to compare or arrange their stories, Trapenberg said that was done to secretly monitor what they might tell each other.

    Late Thursday, CNN captured images of van der Sloot, and Deepak Kalpoe handcuffed together, being put in a car to leave San Nicolas prison. It wasn't clear where they were being taken.

    The Kalpoe brothers and van der Sloot were the last ones seen with Holloway the night she disappeared. Police questioned the three that same day but did not detain them until June 9. Two other people, including van der Sloot's father, Paul, an island judicial official, were detained and released.

    "One of the techniques is that after hearing separate stories and getting nowhere, prosecutors will have suspects confront each other," said Trapenberg. "The U.S. system might be different, but this technique has worked in the past here."

    Trapenberg also said that police initially did not have any cause to hold the young men: "If they had arrested them immediately, they would never have collected evidence."

    Natalee's mother, Beth Holloway Twitty, has repeatedly criticized investigators, saying that if she did not get answers soon she would believe they were protecting someone _ probably Joran van der Sloot because of his father's position.

    "Prosecutors couldn't even attempt a cover-up because they know better than anyone that this case is under a microscope," Trapenberg said.

    This is going to sound really sick, but I have wondered from the start of this if those boys took her body over to the north side of the island and threw her in the ocean over there. The first time my husband and I went to Aruba we went on a island tour and the guide showed us a place on the north side of the island where tourists are taken on the north side of the island with loaves of bread to feed the sharks that all stay over there. He told us that no one ever wind surfs over at that part of the island because of all of the sharks over there.

    I was reading about this in People mag and the pic of those guys does make one wonder about this.

    It's so sad, her poor family.

    I've got an 18 year old daughter also but she barely leaves the house much less the country.

    Report: Aruba has new Holloway lead

    SAN JUAN, Puerto Rico (AP) -- Aruban authorities reportedly have a new witness in the disappearance of Alabama teen Natalee Holloway and plan to conduct another search for her body on the Dutch Caribbean island.

    The witness provided specific information that prompted investigators to organize a search in sand dunes along the northern tip of the island, said Gerald Dompig, Aruba's deputy chief of police, in an interview with CBS television's "48 Hours Mystery" program.

    Dompig said investigators will use cadaver dogs to search near a lighthouse and believe that someone took steps to carefully hide Holloway's body -- perhaps burying her twice.

    The witness "wanted to talk about the fact that he knew more about the whereabouts of Natalee," Dompig said, according to a partial transcript of the interview, scheduled for broadcast on Saturday.

    "The information that this person gave was too specific to just be a story that was just made up by someone."

    Aruban authorities declined to comment on the report Wednesday.

    Holloway's mother, Beth Twitty of Mountain Brook, Alabama, said she's aware of the program, but had "no idea" how it would be presented.

    "I'm just waiting to see it Saturday night," Twitty said.

    Holloway, 18, was last seen leaving a bar with Dutch national Joran van der Sloot and Surinamese brothers Deepak and Satish Kalpoe. No one has been charged in her disappearance and the investigation has produced a number of false leads.

    In January, Aruban investigators searched sand dunes on the northwest coast of the island with more than 50 officers. At the time, Dompig said police had considered the dunes a place of interest since the investigation began and had searched them before.

    I don't want to sound rude, but from the very beginning I always thought that she was thrown to the sharks.
    I just hope her family can have some sort of closure from this whole thing.

    Natalee Holloway died from cardiac arrest caused by an accidental drug overdose, a source has told The O'Reilly Factor.



    "The Factor has learned from sources we have to protect that Natalee Holloway, the 18-year-old Alabama woman who disappeared two years ago in Aruba, died from cardiac arrest brought on by an overdose of cocaine," Bill O'Reilly said on his Thursday program.

    The theory offered by the source, a top law enforcement official, could not be confirmed independently because Holloway's body has not been found.

    Holloway was vacationing with friends on the Caribbean resort island when she disappeared the night of May 30, 2005.

    She was last seen getting into a car with Deepak and Satish Kalpoe and Joran van der Sloot. They were arrested but later released.

    The three have maintained that they were not involved in her disappearance.

    ORANJESTAD, Aruba - The father of missing American teenager Natalee Holloway will relaunch a search for evidence of her remains in waters off Aruba, he said Thursday after police re-arrested three suspects in her 2005 disappearance.

    While authorities searched the sea to depths of 330 feet, Dave Holloway told The Associated Press that he believes his 18-year-old daughter was thrown into deeper waters — a belief based on talks with a police official and a private forensic expert.

    Holloway said a private boat owner is providing divers, sonar equipment and the ability to map the ocean floor.

    "It's like this: we've searched all the land areas ... It's common knowledge on the island that if someone were to dispose of the body, it would be out in the ocean," he said by telephone

    Holloway said he would alert police on the Dutch Caribbean island if anything is found.

    Suspects in Holloway case to appear in Aruba court Friday

    A court hearing in Aruba on Friday will consider whether authorities were right to re-arrest two brothers in connection with the disappearance of an Alabama teenager more than two years ago.


    Deepak and Satish Kalpoe, now 24 and 21 respectively, were arrested on Wednesday in Aruba. A third suspect, Joran van der Sloot, was arrested in the Netherlands the same day.

    The men apparently were the last people to see Natalee Holloway alive after she left a bar in Aruba.

    Prosecutors said the three arrests came because of "new material in the investigation." No information was immediately available about what new evidence led to the arrests.

    Hans Mos, Aruba's chief public prosecutor, said only that the evidence is "so important that we think we should have arrested these three guys, which we did yesterday."

    Aruban police interrogated the Kalpoes on Wednesday, Aruban prosecutor Dop Kruimel said.

    At Friday's preliminary arrest hearing, the judge can authorize their detention for eight more days, meaning police have that much time to produce evidence. The suspects then go before a judge again, Kruimel said.

    All three men were arrested in 2005 but released because of insufficient evidence.

    The Kalpoes were detained early in the investigation, and re-arrested August 26, 2005, on suspicion they acted "together with other people" in raping and killing the Alabama teen, according to the prosecutor's office at the time.

    The men are now charged with "involvement in the voluntary manslaughter of Natalee Holloway or causing serious bodily harm to Natalee Holloway, resulting in her death," Aruban prosecutors said.

    This week's arrests, Aruban prosecutors said, "are in line with the public prosecutor's decision to ultimately decide on the prosecution of the suspects in this case by the end of 2007. This intention was recently disclosed to both brothers."

    A district court judge in the Netherlands ordered Thursday that van der Sloot be extradited to Aruba for questioning. He was to leave as soon as possible, authorities said.

    Holloway was on vacation in May 2005 with about 100 classmates celebrating their graduation from Mountain Brook High School near Birmingham, Alabama.

    The group had planned to leave Aruba the next day, and Holloway's packed bags and passport were found in her hotel room after she failed to show up for her flight.

    Van der Sloot and the Kalpoes were the last people seen with Holloway as she left Carlos'n Charlie's nightclub in Oranjestad, Aruba, about 1:30 a.m. on May 30, 2005. The men have maintained they had nothing to do with her disappearance. She has not been found. View a timeline of the case »

    The Kalpoes have told police they dropped Holloway and van der Sloot off near a lighthouse at a beach on the northern tip of the island after they left the nightclub.

    Van der Sloot's mother has said her son told her he was on the beach with Holloway but left her there alone because she wanted to stay.

    Thursday, she told The Associated Press by telephone that investigators had recently questioned her family and the Kalpoe family.

    "I think it's ridiculous after 2½ years to be doing this," she told the AP.

    Aruban prosecutors said detectives from the Netherlands have been reviewing the Holloway case at the request of authorities in Aruba. The Dutch detectives were on the island as recently as last month to complete the investigation.

    "Aruban police never stopped investigating this case, but we came to sort of a standstill in 2006, and we didn't see any more leads," Mos said, adding that new evidence arose after Aruban authorities asked Dutch police to help review the investigation.

    Aruba's criminal justice system is based on Dutch law and the Napoleonic code, legal experts say. In Aruba, authorities can make an arrest if they have reasonable suspicion that someone knows about or is involved in a crime. Magistrates investigate cases and judges determine a suspect's guilt or innocence. There are no jury trials.

    I guess I must've missed this, but it sure seems like Van Der Sloot knew (and still knows) more than he did. I didn't know he admitted to being there when she died and dumping the body in the ocean. Did we just all miss this?

    LOS ANGELES (AP) - A judge refused to dismiss a defamation suit Tuesday against CBS and television psychologist "Dr. Phil" McGraw brought by two brothers who were questioned in the disappearance of Natalee Holloway.

    William Cremer, the lead attorney for Surinamese brothers Deepak and Satish Kalpoe, praised the decision by Superior Court Judge Edward A. Ferns.

    "I'm going to take Dr. Phil down," he said outside the courtroom.

    The ruling came a day after ABC's "20/20" aired a secretly recorded conversation involving Joran Van der Sloot, who also has been interrogated by Aruban authorities on Holloway's May 2005 disappearance. In the tape, Van der Sloot claims that Holloway died on the beach while they were kissing, and that he tried to revive her but failed. He said that the teen's body was dumped in the ocean and that it would never be found.

    Joseph Tacopina, a lawyer for Van der Sloot, said that his client was not responsible for the Alabama teenager's death and that the tapes do not amount to a confession. Last week, Van der Sloot said he was lying in those conversations and denied that he had anything to do with Holloway's disappearance.


    The Kalpoes, who have maintained they had nothing to do with Holloway's disappearance, sued in December 2006, claiming the "Dr. Phil" talk show altered portions of a taped conversation between Deepak Kalpoe and a private investigator to "create false, incriminating, and defamatory statements that the plaintiffs engaged in criminal activity against Natalee Holloway."

    The brothers also contend the TV show implied they helped kill Holloway and got rid of her body. Their suit claims defamation, invasion of privacy, emotional distress, fraud, deceit and civil conspiracy.

    Cremer said the taped remarks by Van der Sloot, which were secretly recorded by a Dutch crime reporter, help his clients' defamation case.

    "It pretty much exonerates my boys, doesn't it?" Cremer said.

    In their dismissal motion, attorneys for CBS Television and McGraw maintained lawyers for the Kalpoes did not meet deadlines to produce all documents they have demanded concerning the criminal case investigation against the brothers in Aruba.

    But the judge gave the Kalpoes' lawyers another five days to satisfy the document deadline.

    "The documents are relevant to the most fundamental issues in this case," Ferns stated in his ruling. "There is no other (information) which can substitute for the documents sought by the defendants due to the nature of this case."

    In June, another judge dismissed a wrongful death case against the Kalpoes by Holloway's parents, ruling the Los Angeles Superior Court did not have jurisdiction. The parents maintained the brothers conceded jurisdiction when they sued CBS and McGraw in Los Angeles.
