    Supreme Court Justice O'Connor Resigns

    Sandra Day O'Connor, the first woman Supreme Court justice and a decisive swing vote for a quarter-century on virtually all the major legal issues of our time, announced her resignation today.

    Because she is a moderate, her departure gives President Bush a major opportunity to alter the direction of the court if he so chooses.


    O'Connor's possible resignation has been rumored for months, although many thought Chief Justice William H. Rehnquist, who has been ailing with cancer, would go first.

    In anticipation of one or more departures, the White House has been stepping up preparations for a nomination and almost certainly would be ready to announce a choice soon.

    Outside advisers believe the front-runners are U.S. Court of Appeals Judges J. Michael Luttig of the 4th Circuit and John G. Roberts of the D.C. Circuit, both considered strong conservatives. Bush might also prevail upon his reluctant friend, Attorney General Alberto R. Gonzales, who would be the first Hispanic justice but is seen by some conservatives as unreliable on issues such as abortion and affirmative action.

    Other possible candidates include Appeals Judges Samuel A. Alito Jr. of the 3rd Circuit, Michael W. McConnell of the 10th Circuit, Emilio M. Garza of the 5th Circuit and J. Harvie Wilkinson III of the 4th Circuit. White House advisers doubt that Bush would elevate a current member of the Supreme Court to chief justice.

    Partisans began arming for a possible confirmation battle months ago and it was the subtext to the Senate battle over the Democratic minority's use of the filibuster to block Bush judicial appointments.

    Wow that is a shame...she and Kennedy were the only moderate centrist justices on the court...her opinions were always very balanced politcally and well reasoned legally...she was the swing vote on so many contentious issues, and now with Rehnquist probably on the outs, and John Paul Stevens in his 80s...the Bush presidency is going to have a major impact on our lives if it already hasn't...

    Actually Eisenhower always stated that the nomination of chief justice Earl Warren was one of his biggest mistakes...whats interesting there is Warren helped Ike out in California during the election helping him win it, and for the most part Ike wanted someone else to take cj Fred Vinson's spot...but because Warren was such a loyal Republican (and Ike thought he had a brilliant legal mind) and in fact Warren was brilliant...Its funny to think (these days) that Warren...a staunch republican...ended up heading the most liberal supreme courts in the history of the US (Terry v.     thank god bush will have a chance to restore some order to the Court.

    stevens just presided over one of the worst trampeling of individual rights in the history of the Court when it ruled in favor of the New London land grab.

    and his liberal pals were all there supporting the decision.

    leading the dissent in an effort to protect individual land rights were all the conservatives.

    Well to be honest Gonzalez is actually also considered closer to the center then some of the other possible nominees...and besides the Gitmo detainee stuff (in which he was just towing the company line) he probably would not be a far too radically "right/conservative" choice...

    I just hope that someway another moderate can be chosen to take her place....I'm not sure that will be possible, but here's to it happening anyway.
