    Just came back from Mad Anthony's Cafe where there were some cool picks of Mikey with the Atomic Punks... I am curious though that Russ still gets to play his black and white striped Charvel in public. I figured Ed would have been against it. Anyone have any ideas about it???

    he bought it pre lawsuits?....its not red and white striped?......hes not selling it?.....it looks like a wayne charvel, maybe hi and ed have a deal or something?. im not sure if eddie can own the rights to putting any kind(any color) of criss crossing stripes on something. that would seem kinda rediculous. i can understand the red with white/black stripes,thats pretty synonimous with eddie/van halen......

    Ed has or claims to have the right to any color that's in a criss crossing pattern and so claims to have the intellectual property rights for the B&W,Maroon/silver, B&Y or R\W\B pattern.
    I have a law firm that looked into it and they pretty much said that "any color" criss crossing was a little over the line, if it was to be challenged it probably wouldn't hold up, just like the 5150 numbers that they said couldn't be sold, they backed off of that quite quickly when people were actually contesting it but his colors and his patterns are his.
    As for anyone, you can make as many EVH striped guitars that you want for yourself, it does not become illegal till you sell them for profit.
    But if one wanted I guess he could link a profit to the fact that he plays a replica guitar in a tribute band that makes a profit from it or some crap like that.

    I'd be surprised if Russ' guitar was made just for him as the Wayne striped guitar (both in B&W and R/W/B) were sold at retail music stores (I saw them at Guitar Center) about 1.5 to 2 years ago, pre lawsuit.

    Ed does not like anyone using his striped stuff, I doubt hthey really have his blessing, I could be wrong though.

    Just an observation - If the guy from AP couldn't use a guitar that bore someone else's trademark in public, then surely you would be risking a lawsuit by playing a Fender Strat or singing through a Shure mic or wearing Levi jeans. All of these bear trademarks, too. Has anyone ever really tested the validity of EVH's legal assertions?
